5 May 2016 – An anonymous blog post published on May 1, 2016 named the Pelican Brief (Pelikan Dosyası) generated a lot of interest in Turkey. It appeared to be an attempt from within the ruling Justice and Development Party (AKP) to actively target Prime Minister Ahmet Davutoğlu and discredit him.

The diatribe came just a few days after Davutoglu’s authority over the grassroots of the party were stripped on April 29, a move that was seen by many Turkey observers as an attempt to consolidate President Erdoğan’s power. As Al-Monitor columnist Mustafa Akyol put it, “[The brief’s] significance lay in not just whom it attacked, but also on whose behalf it appeared: Recep Tayyip Erdogan, Turkey’s all-powerful president”.

The Pelican Brief shares its name with a 1993 Hollywood movie, which focused on a political corruption case in the US. What created such as storm over the Turkish version was that it was written from what appeared to be a pro-Erdoğan angle and was supported by several pro-Erdoğan journalists. Its message was clear: There is growing discontent with Prime Minister Davutoğlu from President Erdoğan and his party, the AKP.

The Turkish Twitter phenomenon, whistleblower Fuat Avni — Ankara’s Deep Throat — said on April 19 that Erdoğan was planning a move that would be a “coup against Davutoğlu,” which would be effective on April 29. Avni said the “pelican” of Berat and Serhat had started to fly, implying that Erdoğan’s son in law Berat Albayrak and his brother are behind the brief. It was also said that other “birds” are set to come for Davutoğlu.

The piece begins by talking about the many conspiracies about Turkey, which is a common line from Erdoğan supporters, and goes on to discredit Davutoğlu as a failure and a renegade who has sought to branch out on his own, undermining Erdoğan’s will. It accuses Davutoğlu of trying to overthrow Erdoğan, indirectly supporting the PKK and aligning himself with unscrupulous characters in his quest for power.

During his first decade in power, President Recep Tayyip Erdogan won widespread respect as a mediator working to resolve international issues. He largely settled Turkey’s problems with neighboring countries, advocated democratic values and presided over a dynamic economy, cashing in on the reputation he had earned. From 2002 through 2012, Turkey’s exports increased fourfold, from $36 billion to $152 billion, boosting economic prosperity and employment in the country.In recent years, however, the tide has turned. Erdogan’s new problems with neighbors sounded alarm bells for exports, which have dropped to $144 billion. In a medium-term economic program announced at the end of 2015, the government’s projection for this year’s exports was $155.5 billion. The data from the first four months of 2016, however, show that this target is nothing but a dream, with Turkish companies destined to sell even less to international markets this year compared with 2015. Außerhalb der Gesetze: Die unheimliche „Task Force“ des Heiko Maas

Die sogenannte “Task Force“, die auf Betreiben von Justizminister Heiko Maas das Internet von „Hate Speech“ reinigen soll, arbeitet ohne gesetzliche Grundlage. Das geht aus einem Schreiben hervor, welches – und jetzt wird es spannend – im Justizministerium höchstselbst verfasst wurde.

Zu verdanken haben wir diese Informationen dem Informatiker Hadmut Danisch, der im Februar dieses Jahres  ein Auskunftsersuchen nach Informations-, Freiheits- und Presserecht an das Bundesjustizministerium gerichtet hat. Den Inhalt des Auskunftsersuchens mit allen darin enthaltenen Fragen finden Sie hier.

Zunächst versuchte der Pressesprecher des Ministeriums mit einem etwas obskuren Anruf, die unangenehme Post auf dem kleinen Dienstweg vom Tisch zu bekommen. „Er stellte mir das gerade so dar, als habe das Ministerium nur so neutral und unbeteiligt den äußeren Ablauf (des Gründungstreffens der Taskforce / meine Anmerkung) ermöglicht, Räume und Getränke gestellt, und Facebook & Co nur so eine Art Selbstfindungserlebnis ermöglicht“, erinnert sich Danisch an das Telefonat.

Ansonsten lautete die Botschaft des Ministeriumssprechers: „Aber eigentlich hätten sie damit fast gar nichts zu tun, denn sie seien ja auf gar keinen Fall irgendwie eine Zensur- oder Aufsichtsbehörde, das dürften sie ja auch gar nicht, dafür fehle ja die Rechtsgrundlage, das ließe die Verfassung ja auch gar nicht zu. Das wollten sie auf gar keinen Fall sein“.

Nun gilt folgendes: Laut bestehender Verfassungsrechtsprechung (Beispiel: Demorecht am Frankfurter Flughafen) kann sich der Staat seinen verfassungsrechtlichen Pflichten und Verboten nicht durch Umwege in privatrechtliche Konstruktionen entziehen.
