01-04 January 2016 Daily Human Rights Report – (01/001) Curfew in Cizre…
Curfew in Cizre district of Şırnak reached its 122th day as of 4 January 2016. Cabbar Taşkın (40) was shot on 1 January 2016 during the operations of Security Forces in Cudi quarter. Since the neighbourhood was under fire and besieged, he could not be hospitalised. He was found dead early in the morning.
Kumru Ayer (60), Şirin Ayer (56) and Mehmet Ayer (83) were wounded when their house was shot with a shell during the artillery shootings against Cudi and Nur quarters. Şükrü Duymak (45) was also wounded in the garden of his house. Nazlı Ipek Uğur (35) and Mine Çağrıcı were wounded when Special Forces opened fire in their neighbourhood.
Hüseyin Naycı (45) was shot at head and wounded on 2 January 2016 in Konak quarter when he was trying to take in his vehicle the children who were caught between two fires.
Nihat Aşan (22) was shot and heavily wounded on the same day when he was standing in the doorway of his house in Dicle quarter. U.G. (7-boy) was shot at leg in Cudi quarter and hospitalised.
Sezai Burçin (43) was shot to death during the operations conducted on 3 January 2016 in Yafes quarter.
(01/002) Curfew in Silopi…
Curfew in Silopi district of Şırnak reached its 22th day as of 4 January 2016.
On 1 January 2016, Ömer Yalman (45) was shot at chest by the police and heavily wounded when he was fleeing heavy attacks of Security Forces in Başak quarter to Barbaros quarter. Since his relatives could not hospitalise him, Ömer Yalman died on the street.
Ömer Maslu (70) was shot to death by the Security Forces during the operations conducted on 2 January 2016 in Karşıyaka quarter.
Yusuf Yağcı who was among 4 persons wounded with shrapnel on 3 January 2016 in Barbaros quarter died. His wife Şaziye Yağcı, Zübeyde Ezer (35) and Hikmet Akın (29) were heavily wounded.
(01/003) Curfew in Sur…
After 7 hours of suspension, curfew and operations in Sur district of Diyarbakır reached its 25th day as of 1 January 2016.
Melek Alpaydın (38) was killed on 3 January 2016 when their house was shot in İskenderpaşa quarter. According to the footages revealed by the press, the house was shot by a tank. 2 persons were also wounded during the incident.
(01/004) Operations and Attacks in the Southeast…
1 police officer died and 5 police officers were wounded during an armed clash that broke out on 1 January 2016 in Cizre district of Şırnak where curfew and blockade were imposed.
On the night of 1 January 2016, a military vehicle was attacked with rocket launcher in Cizre district of Şırnak. 1 soldier died and 4 soldiers were wounded during the attack.
1 soldier reportedly died during an armed clash that broke out on 1 January 2016 in Karşıyaka quarter of Silopi district in Şırnak.
2 police officers died, 1 soldier and 1 police officer were wounded when a booby-trapped bomb exploded.
13 soldiers were wounded on 2 January 2016 during the armed clashes and bomb attacks in several quarters of Sur district in Diyarbakır.
(01/005) Death in Detention / Repatriation Centre …
According to the news appeared in the press on 2 January 2016, the Rojavan refugee Dilo Derviş (20) died in the Repatriation Centre in Aşkale district of Erzurum. S/he was arrested during a demonstration in Adana and released by the court. But instead of being released, s/he was transferred to Aşkale Repatriation Centre.
Her/his relatives were reportedly called by the officials from the Repatriation Centre, but they were not informed about the cause of death.
Her/his lawyer Tugay Bek made a public statement and alleged that his client Dilo Derviş was killed during a raid conducted on the allegations of a riot in the Aşkale Repatriation Centre. He added that the centre was known with poor living conditions and torture allegations.
(01/006) Investigations, Detentions and Arrests on the Allegations of Insulting State President……
The imam Bakır Kutlu (Baki Kutlu) who was released after being detained on 29 December 2015 to testify on the allegations of “defending self-governance declarations during Friday sermons” was arrested on 1 January 2016 on the allegations of “insulting the State President”. He was arrested in Şırnak Court House where he was called to testify in connection with the incident.
(01/007) Attacks against Curfew Protests…
The police intervened the march organised by the Democratic Youth Associations Federation (Demokratik Gençlik Dernekleri Federasyonu – DEM-GENÇ) members on 2 January 2016 in Bingöl and dispersed the crowd by using tear gas. 8 persons were detained during the police intervention.
The police intervened Peoples’ Democratic Party (HDP) and Peoples’ Democratic Congress (HDK) activists who gathered on 3 January 2016 on Galatasaray Square in İstanbul to march towards Taksim Square and detained 14 persons.
3 members of the music band Emeğe Ezgi (Tune for Labour) who made a call for a curfew protest on 2 January 2016 on Galatsaray Square were detained.
(01/008) Co-Mayor on Trial…
According to the news appeared in the press on 2 January 2016, Public Prosecutor in Suruç prepared an indictment against the Co-Mayor of Suruç district of Şanlıurfa province Orhan Şansal against whom an arrest warrant was issued on the allegations of “being member of an illegal organisation”. Orhan Şansal is on the run.
The indictment wants the defendant to be sentenced to a term of imprisonment up to 44 years on the allegations of “recruiting members to an illegal organisation” and “finding and providing financial resources to an illegal organisation”. Şanlıurfa Heavy Penal Court No 2 will start to hear the case.

Evin Keve, Co-Mayor of Çatak district in Van province, who was detained during a house raid on 3 January 2016 was arrested on the same day in connection with the self-governance declaration.
Emine Esmer, Co-Mayor of Silopi district in Şırnak province, and her driver Cemal Yiğit were detained on 2 January 2016.
İbrahim Fidan who was detained in Silvan district of Diyarbakır was arrested on 1 January 2016 on the allegations of “being member of an illegal organisation”.

(01/010) Curfew in Cizre…
Curfew and blockade in Cizre district of Şırnak reached its 23th day as of 5 January 2016. And the operations and attacks of the Security Forces continued.
Kazım Tonğ who was shot at head and hospitalised while taking his children from the shelter to home died on 4 January 2016 in Batman Regional State Hospital.
Ali Tetik who was heavily wounded when Security Forces opened fire on 27 December 2015 also died on 5 January 2015.

Curfew in Silopi district of Şırnak reached its 23th day as of 5 January 2016.
Security Forces conducted operations on 4 January 2015 in Barbaros and Şehit Harun Boy quarters with 7,000 officers. The quarters were also attacked with tanks and heavy machine guns. The residents of the quarters were taken from their houses to a sports hall. Security Forces reportedly forced the civilians to leave to district.
(01/012) Person Shot by the Police in Diyarbakır…
The police randomly opened fire on 4 January 2016 in Yenişehir and Bağlar districts of Diyarbakır. Mehmet Oyan was wounded for being shot at his back in Yenişehir district and Abdurrahman Yakut was wounded when being shot at his face in Bağlar district.
Y.T. (6-boy) was also wounded when the police opened random fire on 3 January 2015 in Yenişehir district.
(01/013) Operations and Attacks in the Southeast…
A police officer and 2 soldiers died when they were opened fire on 4 January 2016 in Sur district of Diyarbakır.
One of the soldiers Kenan Karabacaklı allegedly died when his rifle accidentally fired.
Governorate of Bingöl announced on 4 January 2016 that 19 regions in Genç, Solhan, Yayladere, Adaklı and Karlıova districts of the province were decided to be temporary security zones for 15 days. Entrance of civilians to the security zones was also banned.

Worker’s Health and Job Safety Assembly announced on 5 January 2016 that at least 137 workers died in December 2015 during work accidents due to untaken security measures. At least 1730 workers died in the year 2015.

On 4 January 2016, Telecommunication Communication Directorate (TİB) banned access to the web site of the periodical Umut Gazetesi “www.umutgazetesi.org”.
(01/016) Public Statement Intervened in İstanbul…
The police intervened the members of Youth Federation (Gençlik Federasyonu) when they wanted to make a public statement on 4 January 2016 in front of a newspaper to protest in the false news appeared in the paper about the member of the federation S.A. (17). The police detained 7 members of the federation under beatings.
(01/017) KCK Trial Concluded in Van…
Van Heavy Penal Court No 1 concluded on 4 January 2016 to hear the case against 10 persons including mayors and executives of dissolved Peace and Democracy Party (BDP) launched on charges of “being member of an illegal organisation”. The case was launched after a KCK operation conducted in Van in the year 2012.
The court sentenced Van Co-Mayor Bekir Kaya and BDP Chair for Van province Cüneyt Caniş to 15 years’ imprisonment. The court also sentenced former Başkale Mayor İhsan Güler to 9 years, former Bostaniçi Mayor Nezahat Ergüneş to 13 years, former Edremit MayorAbdülkerim Sayan to 9 years, former Özalp Mayor Murat Durmaz to 12 years, former BDP executives Veli Avcı to 15 years, M. Emin Yıldız to 12 years, Halis Çakır to 12 years, Derviş Polat to 9 years, Metin Adogit to 13 years and 6 months, Mihribah Şah to 12 years, Hecer Saruhan to 8 years.

The police conducted house raids on 4 January 2016 in Seyhan and Yüreğir districts of Adana and detained 16 persons on the allegations of “being member of an illegal organisation”.
Mehmet Erik (23) who was shot and wounded by the police in Cizre district Şırnak was arrested on 4 January 2016 in the hospital in Batman on the allegations of “being member of an illegal organisation”.

(01/019) Curfew in Silopi…
Curfew in Silopi district of Şırnak reached its 24th day as of 6 January 2016. And the operations and attacks of the Security Forces consisting of 10,000 officers continued.
4 persons were reportedly killed during the attacks of Security Forces on 4 January 2016 in Karşıyaka quarter. The bodies were taken to Silopi State Hospital, but the identification of the bodies was prevented. A group of persons including MPs were also not allowed to visit the crime scene.
3 of the persons were identified as Silopi Peoples Assembly Co-Chair Pakize Nayır, Democratic Regions Party (DBP) Assembly member Sêvê Demir and KJA aktivist Fatma Uyar. The 4th person was not identified.
MPs made a public statement concerning the incident and announced that the persons could have been killed under torture after being capture alive on the grounds that the bodies were almost impossible to identify.
The killed persons reportedly made a phone call after being wounded and asked for help by saying “you have to reach us in 10 minutes, otherwise we will die”.
DBP Co-Chair for district Gülşen Özden also made a public statement and announced: “I had a phone call at about 19:35. The caller said they were shot and asked for ambulance. Few minutes later, they called again and said they need immediate help. They were losing blood and wanted us to reach them in 10 minutes before they die. I asked the MPs to send an ambulance. And I kept calling the number, but they did not answer again.”
Gülşen Özden also announced that 3 women and 1 man were opened fire when they were trying to pass the stream to reach Yeşiltepe quarter on the grounds that Karşıyaka quarter was evacuated. They were wounded and took shelter under a bridge where they made the phone calls.
Peoples’ Democratic Party (HDP) MP for Şırnak province Leyla Birlik also made a statement: “The faces of the bodies were beyond recognition. Therefore I believe they were executed like Hacı Birlik. When they made the phone calls, Seve was wounded. But now her face was smashed, I could identify her from her beautiful hairs and hands. If she had the facer before the call, that person would have said that Seve was dead. This incident resembles to Hacı Birlik case in many aspects.”
37 persons were detained during the operations allegedly conducted to forcibly evacuate the district. After denying for hours, Security Directorate announced that Dicle News Agency (DİHA) correspondent Nedim Oruç was among the detainees.
Hasan Uysal who was shot at back and right arm and wounded while going to his neighbour’s house on 20 December 2015 in Cudi quarter was detained on 5 January 2016 in the hospital after having 4 operations. He was arrested on the same day.
(01/020) Persons Killed in Şırnak…
On 4 January 2016, Special Forces conducted operations with armoured vehicles in Dicle quarter of Şırnak. 2 unidentified persons were reportedly killed during the attacks of the Security Forces.
(01/021) Curfew in Cizre…
Curfew and blockade in Cizre district of Şırnak reached its 24th day as of 6 January 2016. And the operations and attacks of the Security Forces continued.
Fatma Acet (40) who had heart attack on 5 January 2016 due to the heavy bombings of the tanks in Cudi quarter. She died at home on the grounds that the ambulance was not allowed to enter the quarter.
According to the news appeared in the press on 6 January 2016, Besna Zırığ (50) also had heart attack for the same reason and died.
(01/022) Person Killed by the Police in Şırnak…
Çetin Taşar (19) was shot at head and killed on the night of 5 January 2016 in Bahçelievler quarter of Şırnak when Security Forces opened fire during operations conducted with armoured vehicles. Although curfew was not imposed in Şırnak, Security Forces continues attacks and conducting operations in the quarters in the centre of the province.

According to the official announcement, 1 temporary village guard died and 1 soldier was wounded during an armed clash that broke out on 5 January 2016 in Sur district of Diyarbakır.
A civilian-dressed soldier was shot to death on 6 January 2016 in Bahçelievler quarter of ırnak where operations were ongoing.
(01/024) Tahir Elçi Investigation…
According to the news appeared in the press on 5 January 2016, the criminal investigation concerning the killing of Tahir Elçi was concluded.
108 empty cases and bullets were collected nearby the crime scene on Balıkçılarbaşı and in Yeni Street where 2 police officers and Tahir Elçi were killed. According to the criminal report, 28 different weapons were fired during the incident. The criminal investigation also revealed that the police officer Cengiz Erdur was killed with the gun which escaping U.Y. was seen throwing in the footages of the incident.
(01/025) Condition of Prisoners…
According to the news appeared in the press on 5 January 2016, Celal Şeker incarcerated in Diyarbakır D-type Prison lost his ability to walk. Celal Şeker was given medical reports by several hospitals certifying that he was not able to live in the prison on himself. Despite the reports, he was not pardoned and released.
He needs to receive dialysis treatment; he is also suffering from heart valve failure, vascular occlusion, umbilical hernia, hypertension, and pulmonary cyst. He also lost sight of one eye.

Telecommunication Communication Directorate (TİB) also banned on 5 January 2016 access to the new web site of the DİHA (Dicle News Agency) “www.diclehaber.pw/tr”. The number of the banned domains of DİHA reached 28.
(01/027) Attacks against Curfew Protests…
Sozdar Acar and Baran Aydın who were detained during the protest staged in Bingöl were arrested on 5 January 2016 on the allegations of “attempting to overthrow constitutional order”. They were among 10 members of the Democratic Youth Associations Federation (Demokratik Gençlik Dernekleri Federasyonu – DEM-GENÇ) who were detained during the protest and the detainees were reportedly subjected to torture in Bingöl Security Directorate.
On 5 January 2016, Special Forces conducted operations in İskenderpaşa quarter of Sur district where allegedly curfew was not imposed and detained 3 persons protesting in the blockade in Sur.
(01/028) Political Party Premises Raided in Diyarbakır…
On 5 January 2016, Special Forces raided the premises of Democratic Regions Party (DBP) in Diyarbakır. After the search in the premises, DBP Assembly member Zeynep Altunkaynak and Dicle University Medical School student Şakir Karataş were detained. Security Forces blockaded the premises and fired in the air to disperse the crowd gathered nearby the premises to protest in the raid and detentions.
(01/029) Operations throughout Turkey…
Security Forces conducted house raids on 5 January 2016 against the houses of Democratic Regions Party (DBP) and Peoples’ Democratic Party (HDP) members and executives in Tatvan district of Bitlis and detained 15 persons.
The gendarmerie conducted raids in Patnos district of Ağrı and detained 4 persons. Detainees were reportedly taken to 3rd Commando Regimental Command.
The police conducted raids on 5 January 2016 against the student dormitories and student houses in Van. At least 10 students including Jin News Agency (JINHA) correspondent Rojda Oğuz were detained during the operations.
Special Forces conducted operations in Bulanık district of Muş and detained 20 persons including the Co-Mayor of Bulanık district Rahmi Çelik.
The police conducted raids on 6 January 2016 in Edirne. 13 persons including HDP Co-Chair for central district Selahattin Karatoprak were detained on the allegations of “making propaganda of an illegal organisation”.
The police conducted raids on 6 January 2016 in Van and detained Van Co-Mayor Bekir Kaya’s driver Abdurrahman Abi and guard Müslüm Aslan.
HDP Assembly member Nizamettin Öztürk who was detained on 5 January 2016 in Ağrı was arrested on the same day on the grounds that his conviction in a court case was approved by the Court of Cassation. He was sentenced to 3 years 1 month and 15 days’ imprisonment.
7 persons including 5 children who were among 16 persons detained during house raids in Seyhan and Yüreğir districts of Adana were arrested on 5 January 2016 on the allegations of “committing crime in the name of an illegal organisation without being a member of the organisation”.

(01/030) Curfew in Cizre…
Curfew and blockade in Cizre district of Şırnak reached its 26th day as of 8 January 2016. And the operations and attacks of the Security Forces continued.
Bişeng Goran (12) was shot to death when Special Forces opened fire against a family on 6 January 2016. The family was trying to leave their house in Cudi quarter with white flags due to the intensives bombings of the tanks.
Nidar Sümer (17) and Halis Sümer (45) were shot to death by the Special Forces on 7 January 2016 in Dağkapı quarter when they wanted to go to their neighbour’s house to take some water.
Osman Tekin (50) who was shot to death by the Special Forces on 7 January 2016 in front of his house on Yokuşlu Street in Cudi quarter died of blood loss on the grounds that the ambulance was not allowed to enter the street.

Curfew in Silopi district of Şırnak reached its 26th day as of 8 January 2016.
The body of Hasan Yağmur (42) who was missing since being brought to Yenişehir closed sports hall by the Security Forces on 2 January 2016 was found on 7 January 2016 in Karşıyaka quarter. He was shot with a single bullet and allegedly died of blood loss.
The only unidentified person who was among 4 persons killed by the Security Forces on 4 January 2016 in Karşıyaka quarter was identified as İslam Atak (20).
Aydın Mete (16) who was missing after leaving the house on 2 January 2016 was found dead on 6 January 2015 in his neighbourhood in Şehit Harun quarter. Aydın Mete’s cousin Mehmet Mete (10) was also killed on 21 December 2015.

Curfew in Sur district of Diyarbakır reached its 29th day as of 8 January 2016. The person who was killed on the night of 24 December 2015 was identified as Aziz İlhan (47).
(01/033) Curfew in Dargeçit…
Fatma Kılıç who was heavily wounded when Security Forces opened fire against her house in Safa quarter on 23 December 2015 in Dargeçit district of Mardin died on 7 January 2016 in Mardin State Hospital. Necim Kılıç (67) and her daughter Sabahat Kılıç (28) were also killed during the attack. Curfew in Dargeçit was lifted on 29 December 2015.

Kerem Akyürek (19) ve Hasan Akyüz were shot to death on 7 January 2016 when Security Forces opened fire to Dilek Street in Fırat quarter of Nusaybin district in Mardin. Curfew was not imposed in Fırat quarter.
(01/035) Killings by Unidentified Assailants in Diyarbakır…
Bodies of 2 males were found on 7 January 2016 in Beşpınar quarter of Çınar district in Diyarbakır. According to the crime scene investigation by the Public Prosecutor, both persons were shot at head from close distance. After the forensic examination in Diyarbakır Gazi Yaşargil Training and Research Hospital, the bodies were identified as gas station operators Galip Gezginci (47) and Engin Şahinli (32).

The teacher Mevlüde Ketani who was living in an apartment close to Suriçi quarter where curfew was imposed was shot at home on 6 January 2016. She was heavily wounded and hospitalised. Eğitim-Sen (union in education sector) executive for Diyarbakır branch Emine Gül made a public statement and announced that Mevlüde Ketani was shot while taking his children in a more secure room on the grounds that the clashes intensified. Buildings close to Sur district were also targeted with bombs and bullets
(01/037) Operations throughout Turkey…
Students Collectives (Öğrenci Kolektifleri) member and university student Emre Yılmaz who was detained during the house raids conducted on 6 January 2016 in Mersin was arrested on the same day on the allegations of “being member of an illegal organisation” and “making propaganda of an illegal organisation”.
Special Forces conducted house raids on 6 January 2016 in Derik district of Mardin and detained 7 persons. The reason of the operations was not disclosed.
Anti-Terror branch reportedly detained 2 persons during house raids conducted in Menemen district of İzmir.
Hadi Taşar, Halit Taşar and Şeyhmus Taşar who were taking the body of Çetin Taşar (19) to hospital were detained in Şırnak. The detainees were the relatives of Çetin Taşar who was shot to death from an armoured vehicle on 6 January 2016.
Uğur Özenç Özyürek and Muhammet Halit Kaya who were detained in Ceylanpınar district of Şanlıurfa and brought to İstanbul were arrested on 6 January 2016 on the allegations of “being member of an illegal organisation” and “making propaganda of an illegal organisation”.
Dicle News Agency (DİHA) correspondent Nedim Oruç who was among 37 persons detained during operations in Silopi district of Şırnak was arrested on 6 January 2016 on the allegations of “making propaganda of an illegal organisation”.
7 persons including MEYA-DER (solidarity association for people who lost their relatives in Mesopotamia) executive Hamdullah Kılıç who were detained in Patnos district of Ağrı were arrested on 7 January 2016 on the allegations of “being member of an illegal organisation”.
Security Forces conducted operations on 7 January 2016 against the Democratic Regions Party (DBP) and Peoples’ Democratic Party (HDP) members and executives in Burdur and detained 9 persons.
KJA member Bilmez Cengiz who was detained in Mersin was arrested on 7 January 2016 on the allegations of “being member of an illegal organisation” and “making propaganda of an illegal organisation”.
DBP Assembly member Hüseyin Arasan who was detained in Siirt was also arrested on the allegations of “being member of an illegal organisation” and “making propaganda of an illegal organisation”.
(01/038) Municipality Raided in Van…
On 6 January 2016, the police raided Municipality of Erciş district in Van on the grounds that an arrest warrant was issued against the Municipality Assembly member Mehmet Sayat.
When municipality executives wanted to see the official warrant, the police rejected the demand and left the municipality after searching for Mehmet Sayat.

Curfew in Sur district of Diyarbakır reached its 32nd day as of 11 January 2016.
Rozerin Çukur (17) was reportedly shot to death by the snipers on 8 January 2016 in front of her house in Fatihpaşa quarter.

Curfew and blockade in Cizre district of Şırnak reached its 29th day as of 11 January 2016. And the operations and attacks of the Security Forces continued.
Tanks and armoured vehicles conducted operation in Nur quarter on the night of 7 January 2016. The bodies of university student Tayfur Yaşlı and Şivan Cebrail Mungan were found in the morning on 8 January 2016.
Murat Ekici (22) and Murat Egül (24) were killed when a house in Cudi quarter was shot by the tanks on 9 January 2016.
Halil Özkül (21) was shot to death on 9 January 2016 in Dağkapı quarter when Security Forces opened fire while going to market for shopping.
Rahime Göral (18) was wounded with shrapnel in the garden of her house in Nur quarter.
Ahmet Zırığ who was allegedly wounded when gendarmerie soldiers opened fire on 10 January 2016 in Cudi quarter died on the grounds that the ambulance was not allowed to enter the quarter.
Şükrü Coşkun and Nebi Katlay were reportedly died during heavy armed clashes on the night of 9 January 2016 on Mezbahane Street in Cudi quarter.
On the same night, Ali Bağdur (25) was shot to death during operations of Security Forces in Nur quarter.
The body of mentally retarded Mehmet Hacı Tongut who was missing for the last 4 days was found on 10 January 2016 in Yasef quarter.
Handicapped H.E. (17- boy) was shot by the snipers and wounded on 10 January 2016 in Nur quarter.
S.G. (14-boy) who was shot and wounded on 9 January 2016 was detained before his treatment being completed.
Mehmet Şirin Erdinç who was shot when Security Forces opened fire in Nur quarter and hospitalised died on 10 January 2016 in Cizre State Hospital.

Special Forces conducted a house raid early in the morning on 10 January 2016 in Edremit district of Van. According to the official announcement by Van Governorate, an armed clash broke out during the raid. 12 alleged PKK militants and police officer Önder Ertaş died, 2 police officers were wounded during the clash.
The clash allegedly continued for 2 hours and the police prevented entrance to the neighbourhood.
Eyewitness and a committee from Van Bar Association declared that 11 of the killed persons were shot at head. The last person was shot in the belly.
According to the statements of the eyewitnesses, 12 persons were civilian dressed. Despite the announcement of Governorate of Van, only an AK47 (Kalashnikov) rifle was seized in the house. The photographs of the dead persons were allegedly taken after placing weapons beside the bodies.
Peoples’ Democratic Party (HDP) MP Lezgin Botan made a public statement concerning the incident: “The bodies already started to stink. How is it possible? How can bodies start to stink in only few hours? Maybe they were killed somewhere else and brought here.” Lezgin added that Security Forces opened fire without making a warning and 3 persons who left the house raked for minutes.
Lezgin Botan also stated relying on the information gathered from the hospital that alleged PKK militants were shot at the right side of their heads: “There are many bullet wounds on the bodies. But they might have been executed if we consider the bullets on right side of the heads.”
He continued: “Although the Governorate declared that Security Forces made a call for surrender, all witnesses stated the opposite. The Governorate alleges that those persons were followed for a long period. So we need to ask why there is no previous attempt to detain these persons. We have the suspicion that Security Forces were there to execute those persons. They were all civilian dressed. Governorate announced several firearms were seized after the clash. Well, where are all those weapons?”
Meanwhile, 9 of the killed persons were identified as Fuat Akdemir, Ekrem Mete, Fazıl Kuş, M.Sıdık Orhan, Naim Tekin, Ümit Ürgen, Deniz Aşkan, Ahmet Özer, Şaban Günay.

The lawyers’ group from Diyarbakır Bar Association Bar following the investigation on the killing of Tahir Elçi announced on 11 January 2016 that new information was revealed concerning the incident.
- According to the report on ballistic investigation, the evidences No 42 and No 47 collected from the crime scene were missing.
- The assignment letters for the police officers who were on duty on the day Tahir Elçi was killed were issued 15 days after the incident. Relying on the revealed information, the lawyers announced that Security Directorate was not prepared and did not take necessary security measures. Aksaray Heavy Penal Court started on 11 January 2016 to hear the retrial of police officer Ahmet Şahbaz launched in connection with the killing of Ethem Sarısülük on 1 June 2013 during Gezi Park demonstrations in Ankara.
The case was transferred from Ankara to Aksaray for security reasons. The rejected the demand for the arrest of the defendant and adjourned the hearing to 4 April 2016.
Ankara Heavy Penal Court No 6 concluded on 3 September 2014 to hear the case against police officer Ahmet Şahbaz and reduced at first the life imprisonment for “intentional killing” to 21 years for “killing someone with possible intention”. The court increased the sentence to 28 years for committing the crime on duty. But then the sentence was reduced to 7 years 9 months 10 days relying on “unjust provocation”, “good conduct of the defendant at the hearings” and “matter of discretional extenuation”.
1st Penal Chamber at the Court of Cassation quashed the verdict on procedural grounds and did not deal with the merits of the case. The Chamber also rejected the release demand of Ahmet Şahbaz. But Ahmet Şahbaz was released on 3 September 2015 to be tried without remand.

The attack was organised by Saudi Arabia born Syrian citizen Nabil Fadlı (27) and the bomb exploded in a tourist group nearby the German Fountain. 10 tourists died, 15 persons were wounded during the attack.

1128 academics who were signatories of the petition “Academics for Peace” were pointed as targets by the State President Recep Tayyip Erdoğan. The petition was demanding the government to end curfews and operations in blockaded districts Sur, Cizre and Silopi.
Public Prosecutors and the universities started investigations against the academics after the signatories of the petition were heavily criticized by both President Recep Tayyip Erdoğan and Prime Minister Ahmet Davutoğlu for “supporting terrorism”.
Chief Public Prosecutor in İstanbul announced on 14 January 2016 that an ex officio investigation was launched against all 1128 academics.
Ümran Roda Suvağcı, lecturer at the School of Foreign Languages in Hakkari University, was detained on 14 January 2016 in connection with the investigation started by the Public Prosecutor in Hakkari. Ümran Roda Suvağcı was released after testifying with the Public Prosecutor
Operations were conducted against the signatories on 15 January 2016 in Kocaeli, Bursa and Bolu. 21 persons including HRFT founder Ümit Biçer were detained in Kocaeli. 2 academics were also detained in Bolu.

The police raided the houses of Ülkü Güney, Selime Güzelsarı and Barış Kılıçbay in Bolu and searched the houses.
The signatories Şule Akköse Aydın, Aylin Çakı and Gökhan Yavuz Demir were detained in the campus of Uludağ University in Bursa.
Meanwhile the doors of the signatories’ offices in Gazi University (Ankara) and Selçuk University (Konya) were signed by ultra-nationalists. Threatening letters were also stapled on the doors.

Balıkkesir Heavy Penal Court No 2 continued on 15 January 2016 to hear the case against the police officer Ahmet Kuş (29) launched on charges of the killing Abdullah Cömert (22) with a tear gas canister on 3 June 2013 in Hatay during Gezi Park demonstrations. The case was transferred to Balıkesir Heavy Penal Court No 2 for security reasons. The indictment wants the defendant to be sentenced to a term of imprisonment up to 25 years for “killing with eventual intent”.
Only lawyers and members of the Ayvalıtaş family were allowed to attend the hearing. The court rejected the demand for the arrest of defendant and adjourned the hearing to 19 February 2016. The court decided at the previous hearing to write Forensic Institute to ask for the completion of the report demanded by the court or present an excuse for not preparing the report.

Ankara Heavy Penal Court No 5 continued on 15 January 2016 to hear the case against 9 persons including former Diyarbakır Gendarmerie Commander Colonel Eşref Hatipoğlu and former Kızıltepe Gendarmerie Deputy Commander Hasan Atilla Uğur launched in connection with the disappearances of 22 persons in detention and/or killings by unidentified persons in Mardin and its districts between the years 1992 and 1996. 4 soldiers and 5 village guards are on trial in this case.
The lawyers demanded recusation on the grounds that the judges were biased, preventing the defendants to be tried, and sent the files of the case to the Supreme Board of Judges and Prosecutors (HSYK) without legal basis. The court adjourned the hearing to 27 April 2016 to wait for the decision of a higher court on the demand.
The court ruled at a previous hearing to send the files of the case to the Supreme Board of Judges and Prosecutors (HSYK) relying on the position of the Eşref Hatipoğlu and Hasan Atilla Uğur on the day of crime. Since the HSYK did not reply, the court adjourned the hearing to 15 January 2016.
Similar to the previous cases concerning disappearances in detention, killings by unidentified persons and extra-judicial executions, the lawyers of the defendants applied to the Court of Cassation to transfer the case to another province for security measures. The Court of Cassation decided to send the case to Ankara Heavy Penal Court No 5.

Anadolu (İstanbul) Heavy Penal Court No 8 continued on 18 January 2016 to hear the case against Mehmet Görkem Demirbaş (19) and Cengiz Aktaş launched in connection with the killing of Mehmet Ayvalıtaş (21). On 2 June 2013, the defendants drove their car into the crowd during a Gezi Park demonstration in Ümraniye district of İstanbul and caused the death of Mehmet Ayvalıtaş.

Van Heavy Penal Court No 2 continued on 19 January 2015 to hear the case against police officers in connection with the death of Afghani refugee Lütfullah Tacik (17) as a result of beatings on 31 May 2015 in Van. The indictment wants the police officer Serdar Oran to be sentenced for “simple wounding and causing death by intentional wounding” and the police officer Hasan Özgür Özdemir for “misconduct of duty”.
Police officer Serdar Oran testified at the hearing through the SEGBİS tele-conference system. The court rejected the demand of lawyers to be intervening party with case and adjourned the hearing to 10 March 2016.
Lütfullah Tacik (17) who was detained by the soldiers on 16 May 2014 while trying to pass the border illegally in Iğdır and transferred to the Repatriation Centre of the Foreigner’s Department in Van on 26 May 2014 to be deported was beaten by a police officer for lying about his age.
Lütfullah Tacik had cerebral haemorrhage when the police officer Serdar Oran working at Illegal Migration and Human Trafficking Department of Foreigner’s Department beat him. He was hospitalised, but died on 31 May 2014.

Cihan Karaman was heavily wounded with shrapnel on 22 January 2016 in Cudi quarter. When the ambulance was not allowed to enter the quarter, he had to walk about 2 km to reach an ambulance. But he had to get back due to heavy bombings in the quarter. ECtHR also took interlocutory injunction decision concerning the condition of Cihan Karaman, but he died on 23 January 2016.
28 persons who allegedly had a meeting on 23 January 2016 in a house on Caferi Sadık street in Cudi quarter were wounded when the house was shot by a tank. According to the news, some of the persons were heavily wounded and 1 person died on 24 January 2016. The bodies of Cihan Kahraman and another person were also in the same house.

Anadolu Heavy Penal Court No 5 continued on 22 January 2016 to hear the case launched against 399 prisoners in connection with the prisons operation conducted in Ümraniye Prison in İstanbul on 19 December 2000 on charges of “uprising against prison administration”, “possessing explosives” and “wounding people”. During the prisons operation “Return to life” conducted in several prisons simultaneously 32 persons died, 7 prisoners died during the operation in Ümraniye Prison.
In his opinion as to the accusations at the previous hearing, the Public Prosecutor wanted the defendants to be acquitted. The court followed the demand of the Public Prosecutor and acquitted all the defendants.

Erciş (Van) Penal Court of First Instance No 3 continued on 21 January 2016 to hear 2 separate cases against Dicle News Agency (DİHA) correspondent İdris Yılmaz launched on charges of “insulting the State President” and “being member of an illegal organisation”.
In the case launched according to the Article 7/2 of Anti-Terror Law on charges of “being member of an illegal organisation”, the court decided to release İdris Yılmaz to be tired without remand and adjourned the hearing to 15 February 2016.

The body of an unidentified male was found on 24 January 2016 in Dicle quarter. Bodies of 2 males were also found in Dağkapı quarter on the same day. 2 bodies were brought to Şırnak State Hospital for autopsy. One of the persons was identified as Rüzgar Yıldızgörer (25).
On 23 January 2016, a house on Caferi Sadık street in Cudi quarter was shot by a tank. According to the news, there were 28 persons in the house and some of the persons were heavily wounded during the attack. The wounded persons were not allowed to be hospitalised and Selami Yılmaz died on 25 January 2016 of blood loss.

The curfew in Cizre district of Şırnak reached its 51st day as of 1 February 2016.
According to the news gathered, paramedic teams were not allowed on 23 January 2016 to reach a house on Caferi Sadık street in Cudi quarter where 23 persons including wounded ones reportedly took shelter.
The persons in the house were not able to access to fresh water and the wounds were dressed with cottons taken out of pillows.
One of the wounded persons in the house Nusret Bayer died on 27 January 2016 of blood loss.
Another wounded person Ferhat Karaduman reportedly lost his conscious on 29 January 2016.
Sultan Irmak (15) also died of blood loss on 30 January 2016.
Peoples’ Democratic Party (HDP) Group Deputy Chairperson İdris Baluken, HDP MPs Meral Danış Beştaş and Osman Baydemir visited Ministry of Interior Affairs on 27 January 2016 to discuss the condition of the wounded persons. They started hunger strike at the Ministry of Interior Affairs when their demands were rejected.
ECtHR did not take interlocutory injunction decision upon appeal by the lawyers concerning the condition of the persons in the house, but wanted them to apply to the Constitutional Court.
The Constitutional Court also did not take any decision concerning the demand on 27 January 2016 on the grounds of “missing documents”. The Court also asked the lawyers the names of the persons stuck in the house.
The names and the conditions of the persons in the house on Caferi Sadık street were revealed on 29 January 2016. According to the news gathered, 7 persons died in the house for not being hospitalised. And there were also 16 wounded persons and 9 persons taking care of them.
The names of the wounded persons reportedly were Mahmut Yavuzel, Feride Yıldız, Ferhat Saltıkat, Ali Fırat Kalkan, Mustafa Vartiyak, Tahir Çiçek Rıdvan Ekinci, Dersim Aksay, İslam Balıkesir, Serdar Pişkin, Ferhat Karaduman, Sercan Uğur, Rohat Aktaş, Fehmi Dinç.
The remaining 9 persons were Hacer Aslan, Gülistan Üstün, Sakine Şiray, Berjin Demirkaya, Ramazan İşçi, Mahmut Duymak, Kasım Yana, Osman Gökhan, İzzet Gündüz.
11 women who wanted to go to the house on 31 January 2016 by carrying white flag were detained by the Security Forces on the allegations of “defying the curfew”.

The body of Rüzgar Yıldızgörer (25) was found on the street on 24 January 2016. Security Forces prevented his/her family to leave Cizre district when they wanted to go to Şırnak on 26 January 2016 to identify the body. Abdullah Yıldızgörer was also detained.

Blockade and operations in Sur district of Diyarbakır reached its 53rd day as of 1 February 2016.
Sub-Governorate of Sur declared curfew on 27 January 2016 in Abdaldede, Alipaşa, Lalebey, Süleyman Nazif and Ziya Gökalp including Melikahmet Avenue. The number of the quarters in Sur where curfew was imposed reached 11.
A house in Hasırlı quarter was shot by a canon on 31 January 2016 and the attack caused fire in the house. An 80-year-old man was reportedly wounded with shrapnel during the explosion.
It was revealed that the person who was shot to death on 2 December 2015 on Şêx Said (Dağkapı) Square for opening fire against the police officers was not Güler Eroğlu. After the blood samples did not match with the family of Güler Eroğlu, the person was identified as Mizgin Koçyiğit.

S.K. and C.T. who were travelling from Adana to İstanbul by coach on 30 January 2016 were detained when they arrived to Harem terminal in İstanbul. They were reportedly detained upon denunciation of the host of the bus alleging that there was the emblem of a terrorist organisation on the cell phone of the detainees. S.K. and C.T. were released after testifying at Üsküdar Security Directorate.
Jülide Yazıcı, Heja Türk, Çağrı Kurt and Mehtap Demirci who were among 6 persons detained during house raids conducted on 28 January 2016 in 8 districts of İstanbul were arrested on 29 January 2016 on the allegations of “being member of an illegal organisation”.

Curfew in Cizre district of Şırnak reached its 122th day as of 4 January 2016.
Cabbar Taşkın (40) was shot on 1 January 2016 during the operations of Security Forces in Cudi quarter. Since the neighbourhood was under fire and besieged, he could not be hospitalised. He was found dead early in the morning.
Kumru Ayer (60), Şirin Ayer (56) and Mehmet Ayer (83) were wounded when their house was shot with a shell during the artillery shootings against Cudi and Nur quarters. Şükrü Duymak (45) was also wounded in the garden of his house.
Nazlı Ipek Uğur (35) and Mine Çağrıcı were wounded when Special Forces opened fire in their neighbourhood.
Hüseyin Naycı (45) was shot at head and wounded on 2 January 2016 in Konak quarter when he was trying to take in his vehicle the children who were caught between two fires.
Nihat Aşan (22) was shot and heavily wounded on the same day when he was standing in the doorway of his house in Dicle quarter. U.G. (7-boy) was shot at leg in Cudi quarter and hospitalised.

Curfew in Silopi district of Şırnak reached its 22th day as of 4 January 2016.
On 1 January 2016, Ömer Yalman (45) was shot at chest by the police and heavily wounded when he was fleeing heavy attacks of Security Forces in Başak quarter to Barbaros quarter. Since his relatives could not hospitalise him, Ömer Yalman died on the street.
Ömer Maslu (70) was shot to death by the Security Forces during the operations conducted on 2 January 2016 in Karşıyaka quarter.
Yusuf Yağcı who was among 4 persons wounded with shrapnel on 3 January 2016 in Barbaros quarter died. His wife Şaziye Yağcı, Zübeyde Ezer (35) and Hikmet Akın (29) were heavily wounded.

After 7 hours of suspension, curfew and operations in Sur district of Diyarbakır reached its 25th day as of 1 January 2016.
Melek Alpaydın (38) was killed on 3 January 2016 when their house was shot in İskenderpaşa quarter. According to the footages revealed by the press, the house was shot by a tank. 2 persons were also wounded during the incident.

1 police officer died and 5 police officers were wounded during an armed clash that broke out on 1 January 2016 in Cizre district of Şırnak where curfew and blockade were imposed.
On the night of 1 January 2016, a military vehicle was attacked with rocket launcher in Cizre district of Şırnak. 1 soldier died and 4 soldiers were wounded during the attack.
1 soldier reportedly died during an armed clash that broke out on 1 January 2016 in Karşıyaka quarter of Silopi district in Şırnak.
2 police officers died, 1 soldier and 1 police officer were wounded when a booby-trapped bomb exploded.

According to the news appeared in the press on 2 January 2016, the Rojavan refugee Dilo Derviş (20) died in the Repatriation Centre in Aşkale district of Erzurum. S/he was arrested during a demonstration in Adana and released by the court. But instead of being released, s/he was transferred to Aşkale Repatriation Centre.
Her/his relatives were reportedly called by the officials from the Repatriation Centre, but they were not informed about the cause of death.
Her/his lawyer Tugay Bek made a public statement and alleged that his client Dilo Derviş was killed during a raid conducted on the allegations of a riot in the Aşkale Repatriation Centre. He added that the centre was known with poor living conditions and torture allegations.

The imam Bakır Kutlu (Baki Kutlu) who was released after being detained on 29 December 2015 to testify on the allegations of “defending self-governance declarations during Friday sermons” was arrested on 1 January 2016 on the allegations of “insulting the State President”. He was arrested in Şırnak Court House where he was called to testify in connection with the incident.

The police intervened the march organised by the Democratic Youth Associations Federation (Demokratik Gençlik Dernekleri Federasyonu – DEM-GENÇ) members on 2 January 2016 in Bingöl and dispersed the crowd by using tear gas. 8 persons were detained during the police intervention.
The police intervened Peoples’ Democratic Party (HDP) and Peoples’ Democratic Congress (HDK) activists who gathered on 3 January 2016 on Galatasaray Square in İstanbul to march towards Taksim Square and detained 14 persons.
3 members of the music band Emeğe Ezgi (Tune for Labour) who made a call for a curfew protest on 2 January 2016 on Galatsaray Square were detained.

According to the news appeared in the press on 2 January 2016, Public Prosecutor in Suruç prepared an indictment against the Co-Mayor of Suruç district of Şanlıurfa province Orhan Şansal against whom an arrest warrant was issued on the allegations of “being member of an illegal organisation”. Orhan Şansal is on the run.
The indictment wants the defendant to be sentenced to a term of imprisonment up to 44 years on the allegations of “recruiting members to an illegal organisation” and “finding and providing financial resources to an illegal organisation”. Şanlıurfa Heavy Penal Court No 2 will start to hear the case.

Evin Keve, Co-Mayor of Çatak district in Van province, who was detained during a house raid on 3 January 2016 was arrested on the same day in connection with the self-governance declaration.
Emine Esmer, Co-Mayor of Silopi district in Şırnak province, and her driver Cemal Yiğit were detained on 2 January 2016.
İbrahim Fidan who was detained in Silvan district of Diyarbakır was arrested on 1 January 2016 on the allegations of “being member of an illegal organisation”.

Curfew and blockade in Cizre district of Şırnak reached its 23th day as of 5 January 2016. And the operations and attacks of the Security Forces continued.
Kazım Tonğ who was shot at head and hospitalised while taking his children from the shelter to home died on 4 January 2016 in Batman Regional State Hospital.
Ali Tetik who was heavily wounded when Security Forces opened fire on 27 December 2015 also died on 5 January 2015.

The residents of the quarters were taken from their houses to a sports hall. Security Forces reportedly forced the civilians to leave to district.

The police randomly opened fire on 4 January 2016 in Yenişehir and Bağlar districts of Diyarbakır. Mehmet Oyan was wounded for being shot at his back in Yenişehir district and Abdurrahman Yakut was wounded when being shot at his face in Bağlar district.

One of the soldiers Kenan Karabacaklı allegedly died when his rifle accidentally fired.
Governorate of Bingöl announced on 4 January 2016 that 19 regions in Genç, Solhan, Yayladere, Adaklı and Karlıova districts of the province were decided to be temporary security zones for 15 days. Entrance of civilians to the security zones was also banned.

Van Heavy Penal Court No 1 concluded on 4 January 2016 to hear the case against 10 persons including mayors and executives of dissolved Peace and Democracy Party (BDP) launched on charges of “being member of an illegal organisation”. The case was launched after a KCK operation conducted in Van in the year 2012.
The court sentenced Van Co-Mayor Bekir Kaya and BDP Chair for Van province Cüneyt Caniş to 15 years’ imprisonment. The court also sentenced former Başkale Mayor İhsan Güler to 9 years, former Bostaniçi Mayor Nezahat Ergüneş to 13 years, former Edremit MayorAbdülkerim Sayan to 9 years, former Özalp Mayor Murat Durmaz to 12 years, former BDP executives Veli Avcı to 15 years, M. (01/019) Curfew in Silopi…
Curfew in Silopi district of Şırnak reached its 24th day as of 6 January 2016. And the operations and attacks of the Security Forces consisting of 10,000 officers continued.
4 persons were reportedly killed during the attacks of Security Forces on 4 January 2016 in Karşıyaka quarter. The bodies were taken to Silopi State Hospital, but the identification of the bodies was prevented. A group of persons including MPs were also not allowed to visit the crime scene.
3 of the persons were identified as Silopi Peoples Assembly Co-Chair Pakize Nayır, Democratic Regions Party (DBP) Assembly member Sêvê Demir and KJA aktivist Fatma Uyar. The 4th person was not identified.
MPs made a public statement concerning the incident and announced that the persons could have been killed under torture after being capture alive on the grounds that the bodies were almost impossible to identify.
The killed persons reportedly made a phone call after being wounded and asked for help by saying “you have to reach us in 10 minutes, otherwise we will die”.
DBP Co-Chair for district Gülşen Özden also made a public statement and announced: “I had a phone call at about 19:35. The caller said they were shot and asked for ambulance. Few minutes later, they called again and said they need immediate help. They were losing blood and wanted us to reach them in 10 minutes before they die. I asked the MPs to send an ambulance. And I kept calling the number, but they did not answer again.”
Gülşen Özden also announced that 3 women and 1 man were opened fire when they were trying to pass the stream to reach Yeşiltepe quarter on the grounds that Karşıyaka quarter was evacuated. They were wounded and took shelter under a bridge where they made the phone calls.
Peoples’ Democratic Party (HDP) MP for Şırnak province Leyla Birlik also made a statement: “The faces of the bodies were beyond recognition. Therefore I believe they were executed like Hacı Birlik. When they made the phone calls, Seve was wounded. But now her face was smashed, I could identify her from her beautiful hairs and hands. If she had the facer before the call, that person would have said that Seve was dead. This incident resembles to Hacı Birlik case in many aspects.”
37 persons were detained during the operations allegedly conducted to forcibly evacuate the district. After denying for hours, Security Directorate announced that Dicle News Agency (DİHA) correspondent Nedim Oruç was among the detainees.
Hasan Uysal who was shot at back and right arm and wounded while going to his neighbour’s house on 20 December 2015 in Cudi quarter was detained on 5 January 2016 in the hospital after having 4 operations. He was arrested on the same day.

On 4 January 2016, Special Forces conducted operations with armoured vehicles in Dicle quarter of Şırnak. 2 unidentified persons were reportedly killed during the attacks of the Security Forces.

Fatma Acet (40) who had heart attack on 5 January 2016 due to the heavy bombings of the tanks in Cudi quarter. She died at home on the grounds that the ambulance was not allowed to enter the quarter.
According to the news appeared in the press on 6 January 2016, Besna Zırığ (50) also had heart attack for the same reason and died.

Çetin Taşar (19) was shot at head and killed on the night of 5 January 2016 in Bahçelievler quarter of Şırnak when Security Forces opened fire during operations conducted with armoured vehicles. Although curfew was not imposed in Şırnak, Security Forces continues attacks and conducting operations in the quarters in the centre of the province.

According to the news appeared in the press on 5 January 2016, the criminal investigation concerning the killing of Tahir Elçi was concluded.
108 empty cases and bullets were collected nearby the crime scene on Balıkçılarbaşı and in Yeni Street where 2 police officers and Tahir Elçi were killed. According to the criminal report, 28 different weapons were fired during the incident. The criminal investigation also revealed that the police officer Cengiz Erdur was killed with the gun which escaping U.Y. was seen throwing in the footages of the incident.

According to the news appeared in the press on 5 January 2016, Celal Şeker incarcerated in Diyarbakır D-type Prison lost his ability to walk. Celal Şeker was given medical reports by several hospitals certifying that he was not able to live in the prison on himself. Despite the reports, he was not pardoned and released.
He needs to receive dialysis treatment; he is also suffering from heart valve failure, vascular occlusion, umbilical hernia, hypertension, and pulmonary cyst. He also lost sight of one eye.

Sozdar Acar and Baran Aydın who were detained during the protest staged in Bingöl were arrested on 5 January 2016 on the allegations of “attempting to overthrow constitutional order”. They were among 10 members of the Democratic Youth Associations Federation (Demokratik Gençlik Dernekleri Federasyonu – DEM-GENÇ) who were detained during the protest and the detainees were reportedly subjected to torture in Bingöl Security Directorate.
On 5 January 2016, Special Forces conducted operations in İskenderpaşa quarter of Sur district where allegedly curfew was not imposed and detained 3 persons protesting in the blockade in Sur.

On 5 January 2016, Special Forces raided the premises of Democratic Regions Party (DBP) in Diyarbakır. After the search in the premises, DBP Assembly member Zeynep Altunkaynak and Dicle University Medical School student Şakir Karataş were detained. Security Forces blockaded the premises and fired in the air to disperse the crowd gathered nearby the premises to protest in the raid and detentions.

The gendarmerie conducted raids in Patnos district of Ağrı and detained 4 persons. Detainees were reportedly taken to 3rd Commando Regimental Command.
The police conducted raids on 5 January 2016 against the student dormitories and student houses in Van. At least 10 students including Jin News Agency (JINHA) correspondent Rojda Oğuz were detained during the operations.
Special Forces conducted operations in Bulanık district of Muş and detained 20 persons including the Co-Mayor of Bulanık district Rahmi Çelik.

HDP Assembly member Nizamettin Öztürk who was detained on 5 January 2016 in Ağrı was arrested on the same day on the grounds that his conviction in a court case was approved by the Court of Cassation. He was sentenced to 3 years 1 month and 15 days’ imprisonment.

Bişeng Goran (12) was shot to death when Special Forces opened fire against a family on 6 January 2016. The family was trying to leave their house in Cudi quarter with white flags due to the intensives bombings of the tanks.
Nidar Sümer (17) and Halis Sümer (45) were shot to death by the Special Forces on 7 January 2016 in Dağkapı quarter when they wanted to go to their neighbour’s house to take some water.
Osman Tekin (50) who was shot to death by the Special Forces on 7 January 2016 in front of his house on Yokuşlu Street in Cudi quarter died of blood loss on the grounds that the ambulance was not allowed to enter the street.

The body of Hasan Yağmur (42) who was missing since being brought to Yenişehir closed sports hall by the Security Forces on 2 January 2016 was found on 7 January 2016 in Karşıyaka quarter. He was shot with a single bullet and allegedly died of blood loss.
The only unidentified person who was among 4 persons killed by the Security Forces on 4 January 2016 in Karşıyaka quarter was identified as İslam Atak (20).
Aydın Mete (16) who was missing after leaving the house on 2 January 2016 was found dead on 6 January 2015 in his neighbourhood in Şehit Harun quarter. Aydın Mete’s cousin Mehmet Mete (10) was also killed on 21 December 2015.

Bodies of 2 males were found on 7 January 2016 in Beşpınar quarter of Çınar district in Diyarbakır. According to the crime scene investigation by the Public Prosecutor, both persons were shot at head from close distance. After the forensic examination in Diyarbakır Gazi Yaşargil Training and Research Hospital, the bodies were identified as gas station operators Galip Gezginci (47) and Engin Şahinli (32).

Eğitim-Sen (union in education sector) executive for Diyarbakır branch Emine Gül made a public statement and announced that Mevlüde Ketani was shot while taking his children in a more secure room on the grounds that the clashes intensified. Students Collectives (Öğrenci Kolektifleri) member and university student Emre Yılmaz who was detained during the house raids conducted on 6 January 2016 in Mersin was arrested on the same day on the allegations of “being member of an illegal organisation” and “making propaganda of an illegal organisation”.
Special Forces conducted house raids on 6 January 2016 in Derik district of Mardin and detained 7 persons. The reason of the operations was not disclosed.
Anti-Terror branch reportedly detained 2 persons during house raids conducted in Menemen district of İzmir.
Hadi Taşar, Halit Taşar and Şeyhmus Taşar who were taking the body of Çetin Taşar (19) to hospital were detained in Şırnak. The detainees were the relatives of Çetin Taşar who was shot to death from an armoured vehicle on 6 January 2016.

On 6 January 2016, the police raided Municipality of Erciş district in Van on the grounds that an arrest warrant was issued against the Municipality Assembly member Mehmet Sayat.

On the same night, Ali Bağdur (25) was shot to death during operations of Security Forces in Nur quarter.
The body of mentally retarded Mehmet Hacı Tongut who was missing for the last 4 days was found on 10 January 2016 in Yasef quarter.
Handicapped H.E. (17- boy) was shot by the snipers and wounded on 10 January 2016 in Nur quarter.
S.G. (14-boy) who was shot and wounded on 9 January 2016 was detained before his treatment being completed.
Mehmet Şirin Erdinç who was shot when Security Forces opened fire in Nur quarter and hospitalised died on 10 January 2016 in Cizre State Hospital.
(01/041) House Raid and Armed Clash Allegation in Van…
Special Forces conducted a house raid early in the morning on 10 January 2016 in Edremit district of Van. According to the official announcement by Van Governorate, an armed clash broke out during the raid. 12 alleged PKK militants and police officer Önder Ertaş died, 2 police officers were wounded during the clash.
The clash allegedly continued for 2 hours and the police prevented entrance to the neighbourhood.
Eyewitness and a committee from Van Bar Association declared that 11 of the killed persons were shot at head. The last person was shot in the belly.
According to the statements of the eyewitnesses, 12 persons were civilian dressed. Despite the announcement of Governorate of Van, only an AK47 (Kalashnikov) rifle was seized in the house. The photographs of the dead persons were allegedly taken after placing weapons beside the bodies.
Peoples’ Democratic Party (HDP) MP Lezgin Botan made a public statement concerning the incident: “The bodies already started to stink. How is it possible? How can bodies start to stink in only few hours? Maybe they were killed somewhere else and brought here.” Lezgin added that Security Forces opened fire without making a warning and 3 persons who left the house raked for minutes.
Lezgin Botan also stated relying on the information gathered from the hospital that alleged PKK militants were shot at the right side of their heads: “There are many bullet wounds on the bodies. But they might have been executed if we consider the bullets on right side of the heads.”
He continued: “Although the Governorate declared that Security Forces made a call for surrender, all witnesses stated the opposite. The Governorate alleges that those persons were followed for a long period. So we need to ask why there is no previous attempt to detain these persons. We have the suspicion that Security Forces were there to execute those persons. They were all civilian dressed. Governorate announced several firearms were seized after the clash. Well, where are all those weapons?”
Meanwhile, 9 of the killed persons were identified as Fuat Akdemir, Ekrem Mete, Fazıl Kuş, M.Sıdık Orhan, Naim Tekin, Ümit Ürgen, Deniz Aşkan, Ahmet Özer, Şaban Günay.

The lawyers’ group from Diyarbakır Bar Association Bar following the investigation on the killing of Tahir Elçi announced on 11 January 2016 that new information was revealed concerning the incident.
- According to the report on ballistic investigation, the evidences No 42 and No 47 collected from the crime scene were missing.
- The assignment letters for the police officers who were on duty on the day Tahir Elçi was killed were issued 15 days after the incident. Relying on the revealed information, the lawyers announced that Security Directorate was not prepared and did not take necessary security measures. Aksaray Heavy Penal Court started on 11 January 2016 to hear the retrial of police officer Ahmet Şahbaz launched in connection with the killing of Ethem Sarısülük on 1 June 2013 during Gezi Park demonstrations in Ankara.
The case was transferred from Ankara to Aksaray for security reasons. The rejected the demand for the arrest of the defendant and adjourned the hearing to 4 April 2016.
Ankara Heavy Penal Court No 6 concluded on 3 September 2014 to hear the case against police officer Ahmet Şahbaz and reduced at first the life imprisonment for “intentional killing” to 21 years for “killing someone with possible intention”. The court increased the sentence to 28 years for committing the crime on duty. But then the sentence was reduced to 7 years 9 months 10 days relying on “unjust provocation”, “good conduct of the defendant at the hearings” and “matter of discretional extenuation”.
1st Penal Chamber at the Court of Cassation quashed the verdict on procedural grounds and did not deal with the merits of the case. The Chamber also rejected the release demand of Ahmet Şahbaz. But Ahmet Şahbaz was released on 3 September 2015 to be tried without remand.

1128 academics who were signatories of the petition “Academics for Peace” were pointed as targets by the State President Recep Tayyip Erdoğan. The petition was demanding the government to end curfews and operations in blockaded districts Sur, Cizre and Silopi.
Public Prosecutors and the universities started investigations against the academics after the signatories of the petition were heavily criticized by both President Recep Tayyip Erdoğan and Prime Minister Ahmet Davutoğlu for “supporting terrorism”.
Chief Public Prosecutor in İstanbul announced on 14 January 2016 that an ex officio investigation was launched against all 1128 academics.

Balıkkesir Heavy Penal Court No 2 continued on 15 January 2016 to hear the case against the police officer Ahmet Kuş (29) launched on charges of the killing Abdullah Cömert (22) with a tear gas canister on 3 June 2013 in Hatay during Gezi Park demonstrations. The case was transferred to Balıkesir Heavy Penal Court No 2 for security reasons. The indictment wants the defendant to be sentenced to a term of imprisonment up to 25 years for “killing with eventual intent”.
Only lawyers and members of the Ayvalıtaş family were allowed to attend the hearing. The court rejected the demand for the arrest of defendant and adjourned the hearing to 19 February 2016. The court decided at the previous hearing to write Forensic Institute to ask for the completion of the report demanded by the court or present an excuse for not preparing the report.

Ankara Heavy Penal Court No 5 continued on 15 January 2016 to hear the case against 9 persons including former Diyarbakır Gendarmerie Commander Colonel Eşref Hatipoğlu and former Kızıltepe Gendarmerie Deputy Commander Hasan Atilla Uğur launched in connection with the disappearances of 22 persons in detention and/or killings by unidentified persons in Mardin and its districts between the years 1992 and 1996. 4 soldiers and 5 village guards are on trial in this case.
The lawyers demanded recusation on the grounds that the judges were biased, preventing the defendants to be tried, and sent the files of the case to the Supreme Board of Judges and Prosecutors (HSYK) without legal basis. The court adjourned the hearing to 27 April 2016 to wait for the decision of a higher court on the demand.
The court ruled at a previous hearing to send the files of the case to the Supreme Board of Judges and Prosecutors (HSYK) relying on the position of the Eşref Hatipoğlu and Hasan Atilla Uğur on the day of crime. Since the HSYK did not reply, the court adjourned the hearing to 15 January 2016.
Similar to the previous cases concerning disappearances in detention, killings by unidentified persons and extra-judicial executions, the lawyers of the defendants applied to the Court of Cassation to transfer the case to another province for security measures. The Court of Cassation decided to send the case to Ankara Heavy Penal Court No 5.

Anadolu (İstanbul) Heavy Penal Court No 8 continued on 18 January 2016 to hear the case against Mehmet Görkem Demirbaş (19) and Cengiz Aktaş launched in connection with the killing of Mehmet Ayvalıtaş (21). On 2 June 2013, the defendants drove their car into the crowd during a Gezi Park demonstration in Ümraniye district of İstanbul and caused the death of Mehmet Ayvalıtaş.
After reading the expert’s report on crime scene investigation, the court adjourned the hearing to 3 March 2015.

Van Heavy Penal Court No 2 continued on 19 January 2015 to hear the case against police officers in connection with the death of Afghani refugee Lütfullah Tacik (17) as a result of beatings on 31 May 2015 in Van. The indictment wants the police officer Serdar Oran to be sentenced for “simple wounding and causing death by intentional wounding” and the police officer Hasan Özgür Özdemir for “misconduct of duty”.
Police officer Serdar Oran testified at the hearing through the SEGBİS tele-conference system. The court rejected the demand of lawyers to be intervening party with case and adjourned the hearing to 10 March 2016.
Lütfullah Tacik (17) who was detained by the soldiers on 16 May 2014 while trying to pass the border illegally in Iğdır and transferred to the Repatriation Centre of the Foreigner’s Department in Van on 26 May 2014 to be deported was beaten by a police officer for lying about his age.
Lütfullah Tacik had cerebral haemorrhage when the police officer Serdar Oran working at Illegal Migration and Human Trafficking Department of Foreigner’s Department beat him. He was hospitalised, but died on 31 May 2014.

Anadolu Heavy Penal Court No 5 continued on 22 January 2016 to hear the case launched against 399 prisoners in connection with the prisons operation conducted in Ümraniye Prison in İstanbul on 19 December 2000 on charges of “uprising against prison administration”, “possessing explosives” and “wounding people”. During the prisons operation “Return to life” conducted in several prisons simultaneously 32 persons died, 7 prisoners died during the operation in Ümraniye Prison.
In his opinion as to the accusations at the previous hearing, the Public Prosecutor wanted the defendants to be acquitted. The court followed the demand of the Public Prosecutor and acquitted all the defendants.

The body of an unidentified male was found on 24 January 2016 in Dicle quarter. Bodies of 2 males were also found in Dağkapı quarter on the same day. 2 bodies were brought to Şırnak State Hospital for autopsy. One of the persons was identified as Rüzgar Yıldızgörer (25).

The curfew in Cizre district of Şırnak reached its 51st day as of 1 February 2016.
According to the news gathered, paramedic teams were not allowed on 23 January 2016 to reach a house on Caferi Sadık street in Cudi quarter where 23 persons including wounded ones reportedly took shelter.
The persons in the house were not able to access to fresh water and the wounds were dressed with cottons taken out of pillows.
One of the wounded persons in the house Nusret Bayer died on 27 January 2016 of blood loss.
Another wounded person Ferhat Karaduman reportedly lost his conscious on 29 January 2016.
Sultan Irmak (15) also died of blood loss on 30 January 2016.
Peoples’ Democratic Party (HDP) Group Deputy Chairperson İdris Baluken, HDP MPs Meral Danış Beştaş and Osman Baydemir visited Ministry of Interior Affairs on 27 January 2016 to discuss the condition of the wounded persons. They started hunger strike at the Ministry of Interior Affairs when their demands were rejected.
ECtHR did not take interlocutory injunction decision upon appeal by the lawyers concerning the condition of the persons in the house, but wanted them to apply to the Constitutional Court.
The Constitutional Court also did not take any decision concerning the demand on 27 January 2016 on the grounds of “missing documents”. The Court also asked the lawyers the names of the persons stuck in the house.
The names and the conditions of the persons in the house on Caferi Sadık street were revealed on 29 January 2016. According to the news gathered, 7 persons died in the house for not being hospitalised. And there were also 16 wounded persons and 9 persons taking care of them.
The names of the wounded persons reportedly were Mahmut Yavuzel, Feride Yıldız, Ferhat Saltıkat, Ali Fırat Kalkan, Mustafa Vartiyak, Tahir Çiçek Rıdvan Ekinci, Dersim Aksay, İslam Balıkesir, Serdar Pişkin, Ferhat Karaduman, Sercan Uğur, Rohat Aktaş, Fehmi Dinç.
The remaining 9 persons were Hacer Aslan, Gülistan Üstün, Sakine Şiray, Berjin Demirkaya, Ramazan İşçi, Mahmut Duymak, Kasım Yana, Osman Gökhan, İzzet Gündüz.
11 women who wanted to go to the house on 31 January 2016 by carrying white flag were detained by the Security Forces on the allegations of “defying the curfew”.
Selim Turay was shot to death by the Security Forces during an armed clash that broke out on 26 January 2016 in Cudi quarter.
The body of Rüzgar Yıldızgörer (25) was found on the street on 24 January 2016. Security Forces prevented his/her family to leave Cizre district when they wanted to go to Şırnak on 26 January 2016 to identify the body. Abdullah Yıldızgörer was also detained.

Blockade and operations in Sur district of Diyarbakır reached its 53rd day as of 1 February 2016.
Sub-Governorate of Sur declared curfew on 27 January 2016 in Abdaldede, Alipaşa, Lalebey, Süleyman Nazif and Ziya Gökalp including Melikahmet Avenue. The number of the quarters in Sur where curfew was imposed reached 11.
A house in Hasırlı quarter was shot by a canon on 31 January 2016 and the attack caused fire in the house. An 80-year-old man was reportedly wounded with shrapnel during the explosion.
It was revealed that the person who was shot to death on 2 December 2015 on Şêx Said (Dağkapı) Square for opening fire against the police officers was not Güler Eroğlu. After the blood samples did not match with the family of Güler Eroğlu, the person was identified as Mizgin Koçyiğit.

Hafis Aslan who was detained during house raids conducted in Karayazı district of Erzurum was arrested on 28 January 2016 on the allegations of “being member of an illegal organisation”.
Baki Erdal, İpekyolu Municipality Assembly Member, was detained during a house raid on 28 January 2016 in Tuşba district of Van.
Special Forces conducted operations on 31 January 2016 in Şemdinli district of Hakkari and detained 5 persons.
HDP Co-Chair for Adaklı district Sait Güvenç, DBP Co-Chair for Adaklı district Yılmaz Direk, HDP executive Tuncay Direk and Mesut Kaya were detained during house raids conducted in Bingöl.
Seyithan Tekbaş, Abdulbari Akbaş, Muhtilah Dağ, Mehmet Şirin Sakur who were among 5 persons detained during house raids in Erciş district of Van were arrested on 31 January 2016 on the allegations of “being member of an illegal organisation”.
S.K. and C.T. who were travelling from Adana to İstanbul by coach on 30 January 2016 were detained when they arrived to Harem terminal in İstanbul. They were reportedly detained upon denunciation of the host of the bus alleging that there was the emblem of a terrorist organisation on the cell phone of the detainees. S.K. and C.T. were released after testifying at Üsküdar Security Directorate.
Jülide Yazıcı, Heja Türk, Çağrı Kurt and Mehtap Demirci who were among 6 persons detained during house raids conducted on 28 January 2016 in 8 districts of İstanbul were arrested on 29 January 2016 on the allegations of “being member of an illegal organisation”.
