(07/001) Operations and clashes in South-east…Soldier Ali Sabancı who had been abducted on the road between Bingöl and Diyarbakır Provinces on 7 June 2012 was released on 29 June 2012. Two soldiers were killed and another one was wounded in the clash between Turkish Armed Forces and Kurdistan Workers’ Party’s (PKK) armed wing People’s Defence Forces (HPG) in the vicinity of Karataş Gendarmerie Headquarters in Çukurca District of Hakkâri Province on 29 June 2012.

Three civilians were wounded with the explosion of the bomb left under a car in Kulp District of Diyarbakır Province on 29 June 2012. Murat Varlıel, the driver who has been carrying bread to Kuşlıca and Karaoğlan Gendarmerie Headquarters in Ovacık District of Tunceli Province was abducted on 2 July 2012.

Yunus Cin a temporary village guard killed with the explosion in the sentry point in Beytüşşebap District of Şırnak Province on 30 June 2012.

Veysel Çelik, the Justice and Development Party (AKP) Kulp District Branch Chairperson, who had been abducted on 13 May 2012 was released on 29 June 2012.

(07/002) Death in prison…

Erkan Erol (39) was allegedly committed suicide by putting his head inside a bucket full of water in the toilets in Bursa E Type Closed Prison on 28 June 2012.

(07/003) Death in prison…

Abdulvahit Kılıç (43) who committed suicide in Diyarbakır D Type Closed Prison by cutting his throat to protest the incommunicado prison conditions of Abdullah Öcalan and the incident in which 13 prisoners were killed in Şanlıurfa E Type Closed Prison was sent to Midyat (Mardin) M Type Closed Prison without proper medical treatment. He committed suicide by hanging himself on 29 June 2012.

(07/004) Suicide attempt in prison…

Hakan Yılmaz a pre-trial detainee in Diyarbakır D Type Closed Prison fired himself ablaze reported on 1 July 2012. He was hospitalised and his condition was reportedly stable.

(07/005) Extra-judicial killing in Şanlıurfa Province…

Ebas Henifi Elo who attempted to cross the border between Syria and Turkey was killed by the soldiers in Kobani Region of Şanlıurfa Province on 1 July 2012.

(07/006) Torture and ill-treatment in detention…

On 29 June 2012 Yunus Kılıç (27), made an official complaint to Dargeçit Chief Public Prosecution Office and claimed that he was beaten and detained by the police team in the road check point in Dargeçit District of Mardin Province and he was again beaten in the headquarters that he was taken on 27 June 2012.

(07/007) Coercion in prison…

147 prisoners were transferred to Sincan (Ankara) Prison for Juveniles and Females from Şanlıurfa E Type Closed Prison after the fire in which 13 prisoners were killed reported on 2 July 2012.

(07/009) Ongoing KCK/TM main case…

Diyarbakır Heavy Penal Court No. 6 went on hearing the case against 152 defendants -99 of them are pre-trial detainees, 19 fugitives- who had been detained in the Koma Ciwaken Kurdistan-Kurdistan Communities League /Assembly of Turkey (KCK/TM), the KCK is the intend to organize the Kurdish people as an umbrella organization that includes Kurdistan Workers Party (PKK), operations on 14 April, 11 and 17 June and 25 December 2009 on charges of “constituting an illegal structure and acting in the context of it” on 29 June 2012 2012. Diyarbakır Heavy Penal Court No. 6 went on reading the evidences and allegations against defendant Ümit Aydın and the witness account of the informant İrfan Dündar. The hearing was adjourned to 29 September 2012.

(07/010) Convicted student…

On 29 June 2012 İzmir Penal Court of Peace No. 5 sentenced E.Ç. to 5 months of imprisonment in connection with throwing eggs in order to protest the Minister Egemen Bağış in Ege University on 8 Aralık 2011 on charges of “intentionally wounding public officer”. Another student A.D. was acquitted in the case on the grounds that the elements of the offence did not occur.

(07/012) Convicted lawyer…

On 28 June 2012 Adana Heavy Penal Court No. 6 sentenced Şiar Rişvanoğlu to 2 years and 4 months and 3 days of imprisonment in connection with his speech in Roj TV on 3 May 2010 on charges of “making propaganda of an illegal organisation via media” under Article 6 of Anti-Terror Law.

Lawyer Şiar Rişvanoğlu had said that “we should demand a commission which will confidentially investigate political murders, plots, massacre in Botaş wells, mass massacres, rapes in Kurdistan”.

(07/013) Tried former deputy…

On 1 July 2012 Ankara Penal Court of First Instance No. 21 accepted the indictment against Sevahir Bayındır former deputy of Şırnak Province from the Peace and Democracy Party (BDP) in connection with his speech in Kurdish in the First Regular Grand Congress of the party in 2010 on charges of “violating the law on political parties”.

(07/014) Explosion in İstanbul Province…

Material damage took place with the explosion of a bomb left near a car in Beyoğlu District of İstanbul Province on 30 June 2012.

(07/015) Intervention to the commemoration in İstanbul Province…

Three members of the Independent Revolutionary Class Platform/Bağımsız Devrimci Sınıf Platformu (BDSP) were detained as they were distributing leaflets that calls for the commemoration of Madımak Massacre (2 July 1993) on Esenyurt District of İstanbul Province on 30 June 2012.

(07/016) Explosion in Diyarbakır Province…

Material damage took place with the explosion of six sound bombs in different parts of the city in Diyarbakır Province on 1 July 2012.

(07/017) Home raids in Adana Province…

Three people were detained in home raids in Adana Province on 1 July 2012.

(07/018) Muş’ta Home raids in Province…

Cihat Sami who had wounded in the clash in the rural part of Beşdam Village of Malazgirt District of Muş Province on 27 June 2012, and his father Mustafa Sami who has been living in the vicinity, in Alkan (Quçereş) Village were arrested on charges of “being a member of an illegal organisation” and “helping and harbouring an illegal organisation” on 1 July 2012.

(07/019) Home raids in Siirt Province…

Five of the six detainees who had been detained in home raids on Bilgili and Görendoruk Villages after the attack on the military convoy in Eruh District of Siirt Province on 26 June 2012 were arrested on charges of “helping and harbouring an illegal organisation” on 1 July 2012.

(07/020) Temporary security zones in Hakkâri Province…

On 25 June 2012 Hakkâri Governorate declared 15 zones in Hakkâri Province as temporary security zones and banned the trespassing of the civilians between 26 June-6 July 2012 and reported on 29 June 2012.

(07/021) Investigation on the murder of Musa Anter…

A suspect accused of murdering Musa Anter, a prominent Kurdish author, was arrested yesterday by a court in the south-eastern province of Diyarbakır.

Hamit Yıldırım, who was detained in the south-eastern province of Şırnak on June 29, some 20 years after the murder took place, denied all accusations in his interrogation in court. The court cited strong suspicion of offense in its arrest ruling. Anter was killed in an armed attack in 1992. The prime suspect, Yıldırım, was photographed recently for the first time in Şırnak by daily Sabah. The murder case, which would have been dropped in three months due to the statute of limitations, has been extended for 10 more years due to the new development.

Hamit Yıldırım, a member of Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM), was arrested by Diyarbakır Heavy Penal Court No. 7 on 2 July 2012.

(07/023) Operations and clashes in South-east…

Two militants were killed in the clash between Turkish Armed Forces and Kurdistan Workers’ Party’s (PKK) armed wing People’s Defence Forces (HPG) on the road between Tunceli and Ovacık on 2 July 2012.

A police officer was killed and another one was wounded in the armed attack on the sentry point of the officer in front of the entrance of the container city –a temporary place for the survivors of the earthquake- in Van Province on 2 July 2012.

First Lieutenant Murat Hasırcıoğlu (27), who had been wounded in the attack on Yeşiltaş Border Headquarter in Dağlıca Region of Yüksekova District of Hakkâri Province on 19 June 2012 died in the hospital on 2 July 2012.

Zümeyra Can a temporary village guard was abducted by HPG militants in Büyükağaç Village of Çatak District of Van Province on 1 July 2012. Hayrullah Tanış, the Justice and Development Party’s (AKP) district Branch Chairperson, was abducted in Gürpınar District of Van Province on 2 July 2012.

(07/024) Torture and ill-treatment in İstanbul Province…

Ahmet Koca (23) had been beaten by ten police officers as he was stopped in road check on the grounds that he talked Kurdish on the phone in Fatih District of İstanbul Province on 18 June 2012.

Ministry of Interior Affairs had launched an investigation after the footage that documents the incident revealed out and five police officers -M.A., A.D., A.E., F.K., S.A.- were removed from office on 20 June 2012.

Istanbul Governorate removed two others on 21 June 2012 and an investigation was launched against Ahmet Koca on charges of “insulting” and resisting police officers”.

It is reported that an investigation was launched against Ahmet Koca on charges of “resisting police officers” with the complaint of the officers who got a medical document of unable to work for five days on 21 June 2012. İstanbul Chief Public Prosecution Office finalised the indictment against Ahmet Koca on “charges of resisting the police officers” asked for the imprisonment of Koca up to 5 years and send the indictment to be evaluated to Penal Court of First Instance on 2 July 2012.

The indictment against the officers was not finalised yet.

(07/025) Excessive use of force by law enforcement officers…

Şemsettin Murat, claimed that he was apprehended, hand cuffed and beaten with a baton by a police officer during an ID check in Şahinbey District of Gaziantep Province on 29 June 2012. Although Şemsettin Murat was taken to Şahinbey Security Directorate he was not officially detained.

Juveniles in Niğde E Type Closed Prison set their beds ablaze to protest the ban of smoking in the juvenile’s ward on 2 July 2012.

(07/027) Ongoing KCK/TM Main Case in İstanbul Province…

İstanbul Heavy Penal Court No. 15 began to hear the case against 205 defendant -140 of them pre-trial detainees and 23 of them were fugitives- on 2 July 2012.

Some of the defendants replied to the questions about the identities in Kurdish and the head of the court recorded the replies as “language other than Turkish was used” to the report of the hearing.

The lawyers of the defendants asked the court for lack of jurisdiction decision; and to give permission for Kurdish defences and to reject the indictment and to remove the communication records from the indictment. The court declined all the demands and adjourned the hearing to 3 July 2012.

Istanbul Chief Public Prosecution Office had finalised the indictment against 193 people -147 of the pre-trial detainees- who had been detained in various dates in the framework of KCK investigation and sent the 2401 pages of indictment for the evaluation of Istanbul Heavy Penal Court No. 15 on 19 March 2012. Writer Ragıp Zarakolu had been charged with “helping and harbouring an illegal organisation” under Article 220/7 and Prof. Dr. Büşra Ersanlı had been charged with “being an executive of illegal organisation”.

İstanbul Heavy Penal Court No. 15 released Writer Ragıp Zarakolu, Muhsin Yenisöz, İrfan Hülakü, Lütfü Balbal, Ali Geritli, Songül Karatagna, Nahit Onat, Zeynal Çelik, Neci Elmas, Burhanettin Toprak, İsmail Zeybek, Evrim Öztürk, Yasin Yalçın, Cemalettin Görbegir, Alaattin Güneş on the grounds that the probability that the qualification of the charges could be change and the conditions of the evidences as well as taking the period of time spent in prison as pre-trial detainees.

(07/028) Finalised KCK investigation in Ankara Province…

Ankara Chief Public Prosecution Office finalised the indictment against 15 female trade unionist and charged them with “being a member of an illegal organisation” under Article 314 of TPC “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law and sent the indictment to Ankara Heavy Penal Court No. 11 to be evaluated on 14 June 2012.

Fifteen trade unionist were detained in Ankara Province on 13 February 2012 in the framework of KCK investigation and nine of them were arrested KESK Women Secretary Canan Çalağan, Eğitim-Sen Branch No. 1’s member Hatice Beydilli, SES Ankara Branch’s Women Secretary Nurşat Yeşil, KESK’s former executive Belkıs Yurtsever, Tüm Bel-Sen Women Secretary Güler Elveren, SES Women Secretary Bedriye Yorgun, Eğitim Sen Branch No. 1’s member of Evrim Oğraş, SES Ankara Branch Executive Hülya Mendilligil, Eğitim-Sen Branch No. 2’s Women Secretary Güldane Erdoğan while 6 of them were released KESK’s former Women Secretary Songül Morsümbül, BES’s member Leman Kiraz, Eğitim-Sen Ankara Branch’s member Meral Hız, Eğitim-Sen Ankara Branch’s members Nezahat Aslan and Şefika Şimşek on 17 February 2012.

(07/029) Finalised KCK case in Van Province…

On 2 July 2012 Van Heavy Penal Court No. 3 sentenced Kamuran Parlak, Cafer Koçak, Mehmet Sıddık Gül and Tevfik Say to 12 years of imprisonment each; Ferzende Abi, İbrahim Kızılkaya and Mustafa Ayaz to 7 years and 6 months of imprisonment each; Ebru Öndil, Eylem Açıkalın, Kemile Atabay, Kerem Çağıl, Mesut Aslan, Resul Edemen, Yıldız Tekin and Zihni Karakaya to 6 years and 3 months of imprisonment each on charges of “being a member of an illegal organisation -Koma Ciwaken Kurdistan-Kurdistan Communities League /Assembly of Turkey (KCK/TM), the KCK is allegedly intended to organize the Kurdish people as an umbrella organization that includes Kurdistan Workers Party (PKK)” under Article 314 of TPC.

17 defendants had been detained in the operation against KCK in Van Province on 24 December 2009.

M.H. who had been detained by the gendarmerie soldiers during an ID check in the vicinity of Ballıtaş Village of Aşkale District of Erzurum Province on 2 July 2012 was arrested on charges of “being a member of an illegal organisation” and sent to Erzurum H Type Closed Prison .

(07/031) Operations and clashes in South-east…

A militant was killed and another one was wounded in the clash between Turkish Armed Forces and Kurdistan Workers’ Party’s (PKK) armed wing People’s Defence Forces (HPG) in the rural area between Şiran District of Gümüşhane Province and Alucra District of Giresun Province on 3 July 2012.

Four militants were wounded in the clash on the road of Tunceli-Ovacık Province on 2 July 2012.

Two police officers and a civilian were were wounded with the explosion of the land mine as the police armoured vehicle was passing by in the vicinity of Kapıköy Border Gate in Saray District of Van Province on 3 July 2012.

The indictment against the officers was not finalised yet. On 3 July 2012 İstanbul Chief Public Prosecution Office take the account of the 11 police officers after the official complaint of Ahmet Koca. The officers declined the charges and they were released after their accounts.

(07/033) Ongoing KCK/TM Main Case in İstanbul Province…

İstanbul Heavy Penal Court No. 15 went on hearing the case against 205 defendants -140 of them pre-trial detainees and 23 of them were fugitives- on 3 July 2012.

Some of the lawyers were not hindered to enter the hearing by the gendarmerie. The lawyers who could enter also left the hall on the grounds that the judges did not do anything to change the situation. After the break the court attempted to get the identities of the defendants. But the defendants stated that they would not give the information without the presence of their lawyers and turned their backs to the judges. Thereupon the court decided for another break.

After the second break two lawyers get into the hall as representatives. In the afternoon the reading of the indictment was initiated. Lawyer Emine Şeker, asked the court for the reading of the whole indictment on the grounds that her two clients did not see it. Lawyer Müşir Deliduman demanded the court the indictment to be read by the prosecutor, not by the TRT announcer also demanded that the delegation be alternate members. The court declined the demands and did not give permission to Deliduman to talk again. Thereupon the defendants turn their backs again to the court to protest. Consequently the court adjourned the hearing to 5 July 2012. Istanbul Chief Public Prosecution Office had finalised the indictment against 193 people -147 of the pre-trial detainees- who had been detained in various dates in the framework of KCK investigation and sent the 2401 pages of indictment for the evaluation of Istanbul Heavy Penal Court No. 15 on 19 March 2012. Four-hundred-twenty prisoners were transferred from Mardin E, Diyarbakır E, Diyarbakır D, Siirt E, Batman M, Midyat (Mardin) M Type Closed Prisons to Silivri Prison Campus, Bergama (İzmir) M, Ordu E and Giresun E Type Closed Prisons against their will on 3 July 2012.

(07/035) Convicted person…

On 3 July 2012 İstanbul Heavy Penal Court No. 10 sentenced Uğur Ok 6 years and 3 months of imprisonment on charges of “being a member of an illegal organisation –the Communist Youth Organisation affiliated to the Marxist Leninist Communist Party (MLKP)” under Article 314 of TPC. Uğur Ok, Socialist Youth Association (SGD) member, had been detained in the operation in İstanbul Province in 2009.

(07/036) Coercion in prison…

Lawyers Mazlum Dinç, Rezan Sarıca, and Hüseyin Boğatekin were not allowed to visit their client Abdullah Öcalan on 3 July 2012 on grounds that the ship that would carry them to İmralı Island was out of order.

(07/037) Tried deputy…

On 3 July 2012 İstanbul Heavy Penal Court No. 10 went on hearing the case against Sebahat Tuncel, the Peace and Democracy Party’s (BDP) İstanbul Deputy, on charges of “being a member of an illegal organisation” under Article 314 of TPC. The court adjourned the hearing on the grounds that Sebahat Tuncel and her lawyers did not participate the hearing.

(07/038) Indictment against the journalist…

Chief Public Prosecution Office finalised the indictment against Journalist Ahmet Şık in connection with his speech after his release by İstanbul Heavy Penal Court No. 16 on 12 March 2012 in front of the Silivri Prison Campus on charges of “threatening public officers” and “insulting officers due to their duty” and sent the indictment to be evaluated to Silivri Penal Court of First Instance No. 2 on 3 July 2012.

Thirty-nine judges and prosecutors became injured party in the indictment in which the prosecutor asked for the imprisonment of Ahmet Şık up to 12 years and 8 months.

(07/039) Banned Festival…

Ministry of Interior Affairs banned the annual “Festival of Trimming the Sheep’s Wool Culture, Art and Plateau” which will be held in Laleş Plateau in Beytüşşebap District of Şırnak Province on the grounds that “opposing to the Law No. 2911 on Meetings and Demonstrations” reported on 4 July 2012.

Three members of the People’s Front who have been distributing communiques against the demolition of slums in Altınşehir Quarter of Küçükçekmece District of İstanbul Province were detained on 2 July 2012.

(07/041) Operations and clashes in South-east…

HPG militants stopped the two cars on the road between Ilıcak and Çığlı Village of Beytüşşebap District of Şırnak Province and burned down the cars and abducted th two drivers on 4 July 2012.

HPG militants stopped a car in Çatak District of Van’ın Province and abducted two construction workers on 4 July 2012.

(07/042) Excessive use of force by municipal police…

Nubar Veske, a rice and pea meal peddler, was beaten with sticks and pepper gas was sprayed on his face by the municipal police on the grounds that he did not remove the mobile counter in Fatih District of İstanbul Province reported on 4 July 2012. Serdar Çoksöver, Serkan Çoksöver, Şaban Özer and Ramazan Yılmaz who tried the interfere the incident were also beaten and Serkan Çoksöver’s wrist was cut in the incident.

Derik Governorate, decided to shut down the House to Support Education affiliated to the Derik Municipality on the grounds that it violates the degrees reported on 4 July 2012.

(07/044) Convicted persons…

Van Heavy Penal Court No. 3 sentenced Bazi Bor to 19 years and 6 months of imprisonment on charges of “being a member of an illegal organisation” under Article 314 of TPC and “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law; Mesut Delen to 6 years and 3 months of imprisonment on charges of “being a member of an illegal organisation” under Article 314 of TPC and acquitted the other three defendants -Ayhan Kaçak, Servet Aslan and Mehmet Nasır Kaya on 4 July 2012.

Five defendants including the Democratic Society Party’s (DTP) Van Province Central District Chairperson Bazi Bor had been arrested on the grounds that they had been recruiting militants to the Kurdistan Workers’ Party’s (PKK) armed wing People’s Defence Forces (HPG) in Van Province on 5 August 2010.

(07/045) KCK operation in Diyarbakır Province…

Twenty-one people –including BDP’s Dicle District Chairperson Cemal Sert- were detained in the raids on Dicle Municipality, BDP’s District office and houses with the order of Diyarbakır Chief Public Prosecution Office in Dicle District of Diyarbakır Province on 4 July 2012.

Nine people including Mayor Mustafa Uyguner have reportedly warrants for their arrest.

Three sounds bombs left in three different places caused material damage in Mersin Province on 5 July 2012.

Zemin Demirel a reader of Kızıl Bayrak (Red Flag) Magazine, who had been detained in Adana Province on 3 July 2012 was arrested on the grounds that his sentence (10 months of imprisonment) on charges of ““making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law was approved by the Supreme Court of Appeal’s Penal Chambers No. 9.

Thirteen people were detained in synchronised home raids of the Fighting with Terrorism Department teams in the framework of the Al-Qaida operation in Gaziantep Province on 4 July 2012.

BDP’s District Branch’s former Chairperson Mustafa Yabalak and a person allegedly HPG militant were detained in home raid of the Fighting with Terrorism Department teams in Lêman (Lican) Village of Bahçesaray District of Van Province on 4 July 2012.

(07/050) Home raids in Erzurum Province…

Four people including the BDP district executives Servet Kamış and İbrahim Kerez were detained in synchronised home raids in Karayazı District of Erzurum Province on 4 July 2012.

The soldier Vahdettin Kaya who had been abducted on the road between Bitlis and Diyarbakır Provinces on 21 June 2012 was reportedly escaped during the operation to save him on 4 July 2012.

(07/052) The case on the death in prison shuttle…

Abdülsetter Ölmez (35), Sinan Aşka (18), İsmet Evin (33), Akif Karabalı (24) and Medeni Demir (47) had lost their lives due to the fire, in prison shuttle which has been carrying them from Van Province to İstanbul, started in the vicinity of Pınarbaşı District of Kayseri Province on 16 September 2011.

Kayseri Heavy Penal Court No. 1 accepted the indictment against the commander and vice commander of the gendarmerie team “causing the death of more than one person with negligence” and the first hearing will be held on 1 October 2012.

(07/053) Violence in Quoran Course…

On 5 July 2012 Diyarbakır Heavy Penal Court No. 4 sentenced 11 defendants to 7 years and 1 month of imprisonment each on charges of “being a member of an illegal organisation” under Article 314 of TPC and “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law and another defendant to 9 years of imprisonment with the same charges.

Twelve defendants had been detained in the raid on the Democratic Solution Tent in Kızıltepe District of Mardin Province on 28 March 2011 and then eventually arrested.

İstanbul Heavy Penal Court No. 15 went on hearing the case against 205 defendants -140 of them pre-trial detainees and 23 of them were fugitives- on 5 July 2012.

The court declined all the demands of the lawyers except the reading of the whole indictment and adjourned the hearing to 6 July 2012. Istanbul Chief Public Prosecution Office had finalised the indictment against 193 people -147 of the pre-trial detainees- who had been detained in various dates in the framework of KCK investigation and sent the 2401 pages of indictment for the evaluation of Istanbul Heavy Penal Court No. 15 on 19 March 2012. Ankara Chief Public Prosecution Office had finalised the indictment against 15 female trade unionist and charged them with “being a member of an illegal organisation” under Article 314 of TPC “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law and sent the indictment to Ankara Heavy Penal Court No. 11 to be evaluated on 14 June 2012.

Ankara Heavy Penal Court No. 11 accepted the indictment on 2 July 2012 and the first hearing will be held on 24 October 2012. Yasin Anman (19) had been detained in the protest in Van Province on 18 May 2011. The court declined the demand of the defendant to make their legal argument in Kurdish.

Silivri Penal Court of First Instance No. 1 accepted indictment against Hasan Basri Özbey the lawyer of Doğu Perinçek, the chairperson of the Workers’ Party, who has been tried in the first Ergenekon case in connection with his speeches he made during the hearings on charges of “insulting the public officers” under Article 125 of the TPC on 5 July 2012.

Ten out of the twenty-one people –including BDP’s Dicle District Chairperson Cemal Sert- who had been detained in the raids on Dicle Municipality, BDP’s District office and houses with the order of Diyarbakır Chief Public Prosecution Office in Dicle District of Diyarbakır Province on 4 July 2012 were arrested in the framework of the KCK investigation on 5 July 2012.

Staff Colonel Levent Kerim Uça who has been a pre-trial detainee in Maltepe Army Prison in the framework of the “Sledgehammer Action Plan Investigation” since 22 August 2011, had an operation on 2 February 2012 for the removal of the tumour from his brain. He should stay in the hospital for 3 months but he transferred to the prison 2 weeks after the operation, reported on 8 March 2012.

Levent Kerim Uça has to use medication for epilepsy due to the side-effects of the operation and is under the risk having a crisis anytime. He also faces with the risk of losing his sight unless he does not have a proper medical treatment.

Oğuz Topal who had been arrested and sent to Metris T Type Closed Prison in connection with the incidents in the Labour Day in Şişli District of İstanbul Province on 1 May 2012, had dislocation in his right wrist on 7 March 2012. Oğuz Topal should have a medical operation otherwise he would face with impairment reported on 8 July 2012.

On 6 July 2012 Üsküdar Heavy Penal Court No. 1 went on hearing the case against 399 pre-trial detainees and convicts who had been in Ümraniye (İstanbul) Prison in connection with the “Back to Life Operation” in which 32 people were killed in 20 prisons on 19 December 2000 on charges of “rioting against the administration of the prison”, “having explosives” and “wounding”. Seven prisoners had been killed during the operation in Ümraniye Prison that day.

The court adjudicated issue warrant of apprehension for the defendants who did not make legal arguments and adjourned the hearing to 19 November 2012.

(07/076) The Case on the massacre of Bilge (Kertê) Village…

On 16 February 2012 the Supreme Court of Appeals had ratified most of the sentences handed out by a local court in the case of the Bilge village massacre that took place in the south-eastern province of Mardin in 2009.

The appeals court approved the decision to sentence Mehmet Çelebi, the principal case suspect, to aggravated life imprisonment in connection with the murders of 43 people but overturned the ruling in the case of one victim.

The court decided to defer the ruling against Mehmet Çelebi in the case of his victim Fesih Çelebi and wait for the forensics report, as the suspect claimed there was an affair between his wife and the victim. Mehmet Çelebi also alleged their children were born of that affair and requested a DNA test, according to reports.

The court approved the ruling to sentence four other suspects to aggravated life imprisonment 44 times, as well as the decision to acquit four other suspects, according to reports.

A criminal court in the central province of Çorum had ruled to sentence Mehmet Çelebi to aggravated life imprisonment 44 times along with four other suspects. The court had also sentenced 14-year-old suspect M.Ş.Ç. to 15 years of imprisonment 44 times, suspect A.Ç. to 15 years, and suspect M.Ç., who was tried without arrest on claims of shooting in the air, to six months in prison.

The hearing of the appeals court was also held in Çorum due to security reasons, according to reports.

Bilge village made the headlines in Turkey after assailants raided the former village head’s home during his daughter’s engagement ceremony in the south-eastern province of Mardin on May 4, 2009, killing 44 people, including seven children and a pregnant woman. The assailants were from the same village and included relatives of the people at the celebration.

Mehmet Çelebi’s brother Süleyman Çelebi, another suspect in the case, had apparently committed suicide by hanging himself in prison on April 27, 2011, leading to speculations the murder was meant to silence him. Following Süleyman Çelebi’s conviction, suspicions focused on his brother Mehmet Çelebi as the mastermind of the massacre.

Çorum Heavy Penal court went on hearing the case after the overturn verdict of the Supreme Court on 6 July 2012. M.Ç.’s lawyer Eşref Kaya, asked the court to adjourn the hearing on the grounds that the result of the DNA test of Fesih Çelebi did not arrive yet. The court approved the demand and adjourned the hearing to 9 August 2012.

F.Ş. was beaten in Çarşı Police Station by 6 officers and the physician gave a medical report that claims that “no evidences of beating was found” in Kuşadası District of Aydın Province on 4 July 2010. Later the footage of the CCTV was revealed out.

On 10 July 2012 Diyarbakır Heavy Penal Court No. 4 went on hearing the case against Sevda Çağdaş a member of the Socialist Party of the Oppressed (ESP) who had been detained in Koşuyolu Park after the activity organised by the Human Rights Association’s (IHD) Diyarbakır Branch for the “forced disappearance incidents” on 26 May 2012 and eventually arrested on 27 May 2012 on the grounds that she threw stones to the law-enforcement in the Newroz Celebrations in Diyarbakır Province on 18 March 2012.

In the hearing despite the negative expert report –she could not be identified in the photographs- the court adjudicated to prolong the detention process till the next hearing on 18 September 2012.

Adana Heavy Penal Court No. 8 accepted the indictment against three members of the Socialist Democracy Party (SDP) -Ali Okutan (19), Dersim Dinçer (19) and Bedrettin Akdeniz (20)- in connection with the Newroz Celebrations in Mersin Province on 20 March 2012 –they had been detained and eventually arrested on 2 May 2012- reported on 12 July 2012.

The prosecutor asked their imprisonment up to 30 years each on charges of “being a member of an illegal organisation” under Article 314 of TPC, “acting on behalf of an illegal organisation”, “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law, “having risky and illegal materials”, “resisting officers”, “intentionally wounding” and “harming public goods”. The first hearing will be held on 27 September 2012.

İstanbul Heavy Penal Court No. 15 went on hearing the case against 205 defendants -140 of them pre-trial detainees and 23 of them were fugitives- on 13 July 2012.

Prof. Dr. Büşra Ersanlı is among the defendants and charged with “being the executive of the illegal organisation”.

The lawyers asked for the release of their clients and right to defend themselves in their native language. The court released Prof. Dr. Büşra Ersanlı, Kemal Karagöz, Kazım Şeker, Büşra Beste Önder, Canşah Çelik, Erdoğan Baysan, Medeni Demirkapu, Zekiye Ayık, Cüneyt Özil, Birgül Arvas, Suna Varsak, İbrahim Ethem Yıldız, Mehmet Sıddık Kumek, Uğur Taşdemir, Nizamettin Özmen and Mustafa İpek and adjourned the hearing to 1 October 2012.

Istanbul Chief Public Prosecution Office had finalised the indictment against 193 people -147 of the pre-trial detainees- who had been detained in various dates in the framework of KCK investigation and sent the 2401 pages of indictment for the evaluation of Istanbul Heavy Penal Court No. 15 on 19 March 2012. Writer Ragıp Zarakolu had been charged with “helping and harbouring an illegal organisation” under Article 220/7 and Prof. Dr. Büşra Ersanlı had been charged with “being an executive of illegal organisation”.

İstanbul Heavy Penal Court No. 15 released Writer Ragıp Zarakolu, Muhsin Yenisöz, İrfan Hülakü, Lütfü Balbal, Ali Geritli, Songül Karatagna, Nahit Onat, Zeynal Çelik, Neci Elmas, Burhanettin Toprak, İsmail Zeybek, Evrim Öztürk, Yasin Yalçın, Cemalettin Görbegir, Alaattin Güneş on the grounds that the probability that the qualification of the charges could be change and the conditions of the evidences as well as taking the period of time spent in prison as pre-trial detainees.

Prisoners Durmuş Kırbıyık and Selim Köse who had been transferred from Samsun E Type Closed Prison to Bafra (Samsun) L Type Closed Prison on 30 June 2012 were beaten by the guardians who were called as “Robocop” by the ordinary prisoners and threatened with death. They were attacked in the dormitory by other prisoners with broken bottles. The incident was revealed out with the official complaint of Durmuş Kırbıyık and Selim Köse on 13 July 2012. Durmuş Kırbıyık was hospitalised due to the cuts in his ear, face and armpit.

(07/122) Operations and clashes in South-east…

Two soldiers and 3 militants were killed and two soldiers were wounded in the clash between Turkish Armed Forces and Kurdistan Workers’ Party’s (PKK) armed wing People’s Defence Forces (HPG) in Kel Mehmet Mountain between Uludere and Beytüşşebap District of Şırnak Province on 14 July 2012.

A temporary village guard was killed in the clash in the vicinity of Akarca Village of Sarıseki Municipality of İskenderun District of Hatay Province on 14 July 2012.

Fifteen police officers were wounded with the explosion of the mine as the police shuttle that was carrying the officers to the polygon of the security directorate in Van Province on 14 July 2012.

The train machinist and his helper were wounded in the explosion of the bomb placed on the railroad in the vicinity of İslahiye District of Gaziantep Province on 15 July 2012.

Temporary village guards Zümeyra Can and İsmail Can who had been abducted from Büyükağaç Village of Çatak District of Van Province on 1 July 2012 were released on 12 July 2012.

On 14 July 2012 İzmir Heavy Penal Court No. 10 went on hearing the case against Halit Bilgiç in connection with the songs he sang in Kurdish and Turkish in the election meeting of Labour, Democracy and Freedom Bloc in Bodrum District of Muğla Province on 12 June 2011. The court adjudicated to postpone the prosecution against the defendant for three years basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the third Judiciary Reform Package on 5 July 2012.

(07/124) İntervention to the meeting Diyarbakır Province…

The meeting of the Peace and Democracy Party (BDP) and Democratic Society Congress which had been planned to be held in Diyarbakır Province on 14 July 2012 was banned by Diyarbakır Governorate on 8 July 2012.

The BDP and DTK called for the meeting on 14 July 2012 despite the ban decision.

Diyarbakır Governorate and Security Directorate took extraordinary security measures from 13 July 2012 and did not allow anyone to enter the city on 14 July 2012.

Six people were detained in the home raids in Bağlar District of Diyarbakır Province on 13 July 2012.

Law-enforcement officers used excessive power and sprayed gas to the people that attempted to go the meeting area. Even the stock of the gas bombs was reportedly consumed and the reserve stock was brought.

Deputy Pervin Buldan was wounded with gas bomb canister; deputy Ayla Akat Ata was wounded with a hit from her eye; Deputy Mülkiye Birtane was wounded from various parts of her body. Deputy Gültan Kışanak was dragged on the ground and Deputy Emine Ayna fell down due to pressured water. Law-enforcement detained the wounded from the hospitals.

Diyarbakır Governorate made a statement on 15 July 2012 and claimed that ten police officers were wounded and 25 people who effected from gas bombs, applied to the hospitals and 85 people were detained during the intervention to the meeting.

According ot the news agencies 79 people -56 civilians and 23 police officers- were wounded and 87 people were detained.

The court declined the demand of the defendants to make their legal argument in Kurdish. The court released all the pre-trial detainees after taking their legal arguments and adjourned to 29 November 2012.

On 15 July 2012 Kulp Chief Public Prosecution Office declared the investigation confidential after the news concerning the interrogation of the 37 soldiers.

Twenty-two out of the 28 members and executives of the Peace and Democracy Party (BDP) who had been detained in synchronised home raids of the Fighting with Terrorism Department teams in the framework of the KCK investigation in Şanlıurfa, İstanbul, Ankara, Eskişehir, Muş and Diyarbakır Provinces on 8 May 2012 were arrested on 11 May 2012.

On 14 July 2012 the indictment against 28 people was returned back to the Diyarbakır Chief Public Prosecution Office by Diyarbakır Heavy Penal Court No. 6 on the grounds that the court do not have the authority of jurisdiction due to the Law No. 6352 which came into force as a part of the Third Judiciary Reform Package on 5 July 2012.

Ankara Heavy Penal Court No. 11 went on hearing the case against 23 members of the Democratic Society Party’s (DTP) Women Assembly including the Peace and Democracy Party’s (BDP) Istanbul Deputy, Sebahat Tuncel, on charges of “praising crime and criminal” under the Article of 215/1 of TPC on 17 July 2012.

The prosecutor asked the court to postpone the prosecution against the defendant basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the Third Judiciary Reform Package on 5 July 2012. The court adjourned the hearing for the preparation of the legal arguments of the defendants’ lawyers.

On 4 December 2008 Diyarbakır Heavy Penal Court No. 5 had sentenced Diyarbakır Deputy Leyla Zana to 8 years of imprisonment in connection with her speeches on charges of “being a member of an illegal organisation” under Article 314/2 of TPC. The court then raised the sentence to 12 years because it was a terror crime and dropped it to 10 years due to her good conduct in the hearings.

The Supreme Court of Appeal’s Penal Chamber No. 9 annulled the verdict of the local court on the grounds that “lack of defence”. Diyarbakır Heavy Penal Court No. 6 went on hearing the case against Leyla Zana on 17 July 2012. The court adjudicated to postpone the prosecution against the defendant basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the Third Judiciary Reform Package on 5 July 2012.

(07/150) Police officers tried in connection with the incidents in Diyarbakır Province…

On 18 July 2012 Diyarbakır Heavy Penal Court No. 1 went on hearing the case against officers of Ankara Security Directorate Special Task Department -B.Ö., H.A. and N.Ö. – on charges of killing 14 year-old Mahsun Mızrak in the funeral in which 14 people were killed and 400 people were arrested in Diyarbakır Province on 28 March 2006.

The officers did not participate the hearing. The hearing revealed that the canister of the gas bomb that killed Mahsun Mızrak and that removed from his corpse during the autopsy was changed with a shotgun shell. The court adjudicated to make official complaints and to wait for the result of them.

(07/161) Extra-judicial killing attempt in Diyarbakır Province…

Nurhak Çartay (18) was seriously wounded with the police fire from his neck on the grounds that the car that he was inside did not obey the stop warning in Sur District of Diyarbakır Province on 17 July 2012. Nurhak Çartay’s family applied to the Human Rights Association’s (IHD) Diyarbakır Branch for judicial help on 19 July 2012 and made official complaints against the police officers.

Police officer Cengiz Acay who came to the gas station asked to be served first but the worker of the station Derviş Mehmet Alparslan (39) told him to wait in Antalya Province on 2 August 2011. CCTV recording showed that police officer cried out loud that he was a police officer with his every hit.

Antalya Penal Court of First Instance No. 12 sentenced police officer Cengiz Acay to 7 months and 15 days of imprisonment and a judicial fine that corresponds to 29 days of imprisonment. The court also sentenced Derviş Mehmet Alparslan to a judicial fine that corresponds to 75 days of imprisonment.

(07/163) Ongoing case on torture and ill-treatment in detention…

On 9 July 2011 it had been learned that on 16 July 2011 F.C. (37) who had come to a music hall in Izmir to enjoy himself with his family had been detained since he had no ID on him. He had been taken to Karabağlar police station, where the police officers Hakan Yörük and Beyit Sezgin had beaten him for several minutes. A camera also recorded that the police officers sexually assaulted him and that the other police officers did not intervene. The deputy commissioner Mustafa Dinçer and the police officers Murat Kavlak and Ümit Sadioğlu were asked to prepare an expertise concerning the recording. There were indicted under Article 281 of the Turkish Penal Code for hiding criminal evidence since they had only reported felonies of F.C. Information on this case emerged on 30 May 2012.

On 19 July 2012 İzmir Penal Court of First Instance No. 9 went on hearing the case. The court adjudicated to merge the case with the case that has been pending in İzmir Heavy Penal Court No. 6 against police officers T.D., N.A., H.Y. and B.S. who had been tortured F.C. and sent the case to İzmir Heavy Penal Court No. 6.

Niyazi Buldan (28) (from Malazgirt District of Muş Province) was beaten in Mehmet Akif Police Station on the grounds that he waited in front of the building to long in İkitelli Quarter of Küçükçekmece District of İstanbul Province on 17 July 2012. His lung was ruptured to the fractured ribs.

On 19 July 2012 Malatya Heavy Penal Court No. 3 went on hearing the case against Özlem Gerçek and Ercan Duman from the “Group Munzur” and the singer Pınar Aydınlar. As part of the 10th Munzur Culture and Nature festival in Tunceli in 2010 they had staged a concert in Hozat District and because of their songs are being charged with having praised a crime and a criminal and having made propaganda for an illegal organization.

Malatya Heavy Penal Court No. 3 adjudicated to evaluate the amendment that enable to postpone the prosecution against the defendants basing the verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the Third Judiciary Reform Package on 5 July 2012.

The court adjourned the hearing to 18 October 2012.

(07/167) Ongoing KCK Case in Cizre District…

On 19 July 2012 Diyarbakır Heavy Penal Court No. 7 went on hearing the case against 90 defendants – 36 of them pre-trial detainees- who had been arrested in the Koma Ciwaken Kurdistan-Kurdistan Communities League /Assembly of Turkey (KCK/TM) operation in Cizre District of Şırnak Province on charges of “being a member of an illegal organisation” under Article 314 of TPC.

The court declined the demand of the defendants to make their legal argument in Kurdish and released five pre-trial detainees -Mehmet Halil İnan, Muhittin Duymak, Şerifa Acar, Müdür Gök and Mehmet Şeftali- were on bail and prolonged the pre-trial detention period of the other 31 pre-trial detainees.

Sultan Işıklı and Hasan Selim Gören, two members of the Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C) who had been searched as the perpetrators of the several armed attacks were wounded in the clash in Gazi Quarter of Sultangazi District of İstanbul Province on 20 July 2012. Hasan Selim Gören died in Okmeydanı Training and Survey Hospital on 21 July 2012.

Sultan Işıklı who had been wounded from her shoulder was arrested and sent to prison without proper medical treatment on 23 July 2012. Two members of the Solidarity Association of the Prisoners’ Families (Tutuklu Hükümlü Aileleri Yardımlaşma Derneği (TAYAD)) were detained as they were waiting in front of the hospital to get information on the well-being of Sultan Işıklı on 22 July 2012.

Okan Deniz (12) and Mehmet Direkçi (11) were wounded with the explosion of the land mine as they were pastoring their herd in the rural part of Böğrüpek Village of Başkale District of Van Province on 23 July 2012.

(07/183) The Şerzan Kurt case…

On 11 May 2010 a verbal quarrel between Kurdish students at Muğla University and a racist group turned into a fight. When the police intervened the student Şerzan Kurt (21) was heavily wounded and died in hospital on 19 May 2010. Later police officer Gültekin Şahin was detained on charges of having fired the shots on order of the temporary chief of the department to fight terrorism. On 24 July 2012 Eskişehir Heavy Penal Court continued to hear his case.

The court adjudicated to give time to the prosecutor to prepare the legal argument on the essence of the case and further remand of the police officers on trial and adjourned the hearing to 24 July 2012.

During the hearing Nezahat Paşabayraktar the lawyer of the family of Şerzan Kurt presented the report of the Forensic Medicine Experts Association to the court which reveals a different radius of the bullet hole from the report of the autopsy report of the Forensic Medicine Institute.

The court adjudicated the prosecutor to evaluate the report and prolonged the pre-trial detention period of the defendant police officer, and adjourned the hearing to 17 August 2012.

Police teams attempted to detain Adem Bıyıklı who had broken up a fight in Trabzon Province on 20 July 2012 after an official complaint against him in his shop. Teams beat and sprayed pepper gas on his face although he was holding his 1.5 year-old offspring. Trabzon Security Directorate launched an investigation against two police officers who had been temporarily lashed off.

Seventy prisoners including İbrahim Ayhan, a deputy of the Peace and Democracy Party (BDP), from Şanlıurfa E Type Closed Prison were transferred to Kürkçüler (Adana) F Type Closed Prison with excessive use of force against their will and İbrahim Ayhan had heart spasm and put into solitary confinement without medical treatment reported on 20 July 2012.

Former Commander of the First Army general Ergin Saygun has been a pre-trial detainee in Silivri (İstanbul) Prison in the Sledgehammer (Balyoz) Case. He has been deteriorated in the dormitory and carried to prison infirmary and then transferred to Silivri State Hospital with a prison shuttle instead of an ambulance. Ministry of Justice launched an investigation against those who took the shuttle decision.

On 20 July 2012 Mersin Penal Court of Peace No. 3 began to hear the case against Ş.U. (17) who had been arrested on the grounds that he had participated in the protest in Mersin Province in 2011 and had been transferred to Sincan (Ankara) Prison after the rape incidents in Pozantı Juvenile Prison were revealed.

As the legal argument of Ş.U. was taken via teleconference the connection was lost. The court prolonged the pre-trial detention period of the defendant till the next hearing on 27 August 2012.

On 25 July 2012 Erzurum Heavy Penal Court No. 2 went on hearing the case against pre-trial detainees -Reyhan Çomak, Sudan Güven and Yaşar Karakuş- who had been detained and arrested on charges of “being a member of an illegal organisation -KCK/TM” under Article 314 of TPC in Ağrı Province in 2011.

The court declined the demand of the defendants to make their legal argument in Kurdish. It was also revealed in the hearing that the Security Directorate had declined the existence of the confidential witness with the code name “Ağrı Mountain” in its reply to the court’s demand to hear the witness. The court prolonged the pre-trial detention period of the defendants till the next hearing.

Marmara University’s student Emine Akman had been beaten and detained in İstanbul Province on 14 August 2011 and eventually arrested in connection with throwing Molotov Cocktails to a closed shop.

On 25 July 2012 İstanbul Heavy Penal Court No. 15 went on hearing the case against Emine Akman on charges of “committing offence on behalf of an organisation although he is not a member” under Article 220/6 of TPC. The court declined all the demands of her lawyer and prolonged the pre-trial detention period of the defendant till 3 December 2012.

(07/213) Tried persons in connection with Hopa incidents… Police teams interfered with excessive use of force the group protesting the energy policy of the government and Hydroelectric Power Plants before the meeting of the meeting of the Justice and Development Party (AKP) in Hopa District of Artvin Province on 31 May 2011. Due to the excessive use of gas bombs retired teacher Metin Lokumcu (54) had a heart attack and passed away. The police officer who fell from the top of the speeding up election bus and eight others were wounded. The fourth indictment against the protestors of the murder of Lokumcu, reportedly was launched on 29 June 2012. Fifty defendants – three of the lawyers- were charged with “opposing to the Law No. 2911 on Meetings and Demonstrations”, resisting officers on duty”, “wounding officers” and “harming public goods” in the indictment and the prosecutor asked for their imprisonment from 4 years to up to 22 years and 3 months. The indictment was sent to Ankara Penal Court of First Instance No. 24 to be merged with the case with 48 defendants.

(07/214) Operations, Attacks in the Southeast…

Within a military operation continuing in Hakkâri-Şemdinli district for about one week without informing the public three soldiers died in a clash on 29 July and 13 soldiers and civilians were injured.

Within a military operation continuing in Hakkâri-Şemdinli district for about one week without informing the public 17 soldiers that had been dropped by helicopter into the area of clashes and had not been heard of since died on 25 July 2012. On 26 July 2012 they were taken to the 3rd Mountain Battalion in Şemdinli. It was claimed that their corpses had been taken to Diyarbakır on 29 July 2012.

On 27 July 2012 it was announced that one militant died during clashes that followed an attack in Hakkâri-Yüksekova district in the Dağlıca area on the Yeşiltaş Border Station on 19 June 2012.

On 27 July 2012 fire was opened on a helicopter near Tunceli Geyiksuyu village with long barreled rifles resulted in the injury of one soldier.

On 29 July 2012 it was learned that a village headman called Mehmet Çakır had been abducted by HPG militants in Hakkari.

On 28 July 2012 Ali Cem Gündoğan (24), a convcit in Sivas E-type Prison died in the hospital of the medical faculty of Cumhuriyet University where he had been taken after his health deteriorated.

Because of bruises and traces of wounds on his body it was alleged that he had been beaten and on complaint of the relatives of Ali Cem Gündoğan the prosecutor started an investigation.

On 28 July 2012 Baran Tunç (11) and Ercan Çiçekli (17) inspected a bag they had found on the ground in Diyarbakır-Bağlar district and were wounded in the ensuing explosion.

On 27 July 2012 the shepherd Şerif Çakmaz (29) had come from Iğdır, Karakuyu village to the Korhan plateau close to Ararat Mountain in order to graze his sheep and was heavily wounded when he stepped on a mine. Zeki Çakmaz who had gone there to understand the reason for the explosion was wounded in a second explosion.

(07/218) Military officials on trial for mine explosion…

On 27 May 2009 the explosion of a mine that had been planted by soldiers in Hakkâri-Çukurca district resulted in the death of six and injury of eight soldiers. Major General Gürbüz Kaya, Brigadier Zeki Es, Fatih Taylan Çeker, Hakan Alaçam, Nurettin Altay and Rıza Atilla Erdoğan had been put on trial. On 27 July 2012 a hearing was held at the Military Court of the General Staff.

During the hearing the defendants Zeki es said on the report of a newly appointed team of experts that it was not right that someone not serving in the area should prepare such a report and demanded that an opinion was to be taken from the General Staff and that the report was not used.

The court gave the lawyers of the defense time to prepare their written statement on the expertise and adjourned the hearing to fill the gaps in the file.

One of the defendants in the court case at Diyarbakır Heavy Penal Court No. 6 on charges of 52 killings that had been committed between 1993 and 1995 when Cemil Temizöz had been the commander of Cizre Gendarmerie Station in Şırnak province, and hwo so far had only been known by his code “Yavuz” as interrogator of JİTEM, Sergeant Burhanettin Kıyak was captured in Ankara. (07/220) Racist attack in Malatya…

On 28 July 2012 people living on Sürgün town of Malatya-Doğanşehir district stoned the house of the Kurdish and Alevi Evli family that did not want a drummer to play before the first prayer in the morning in front of their house. A barn of the family had been set on fire.

The gendarmerie teams that had come to the place of the incident called additional forces from from Doğanşehir district when they were not able to control the crowd.

On 28 July 2012 the vehicle driven by Mustafa İnce coming from the new bus station in Antalya and going to Kepez township crashed with the vehicle of Cengiz Tülüben. The police intervened in the ensuing discussion with pepper gas and made the sides leave the place of the incident.

On 29 July 2012 the police intervened when a group of people protested in Adana-Yüreğir district the fact that Abdullah Öcalan was prevented from seeing his lawyers. A capsule of one of the gas bombs that the police used hit M.A. (11), who suffered heavy injuries.

A letter of co-prisoners sent from Diyarbakır D-type Prison revealed on 28 July 2012 that Galip Kandemir, imprisoned since 2009 as part of the KCK investigation was suffering from the “nephrotic syndrome”. His health had deteriorated due to prison conditions, for some time his nutrition had been yorgut, he had been to hospital, but his treatment continued in the hospital.

On 28 July 2012 it was learned that Vahap İlhan who had been detained after a demonstration in Şanlıurfa-Halfeti district, Amara (Ömerli) village on behalf of the birthday of the PKK leader Abdullah Öcalan, during which Mahsum Karaoğlan and Mustafa Dağ had lost their lives and who had been convicted as a member of an illegal organization was beaten when he protested against a strip search on entry to Tekirdağ T-type Prison. Against his will he had earlier been transferred from Şanlıurfa E-type Prison to Mardin E-type Prison, from here to Gümüşhane E-type Prison and finally to Tekirdağ T-type Prison.

(07/225) Pressure in the Prisons…

On 28 July 2012 it was learned that a facsimile that Arif Çelebi wanted to sent from Tekirdağ F-type Prison 1 to the newspaper Taraf concerning the appointment of Sedat Selim Ay to deputy director of Istanbul Police HQ and the torture he had suffered from him had not been sent by the prison administration on the grounds that it contained lies and wrong information that could cause panic for persons and institutions.

(07/226) Pressure in the Prisons…

On 14 July 2012 29 prisoners in Batman M-type Prison including the Batman reporter for DİHA news agency, Gülsen Aslan protested against the ban of a meeting on “democratic Resistance for Freedom” that was to be held in Diyarbakır by setting their wards on fire. Therefore, they were transferred to Sincan (Ankara) Women’s Prison on 18 July 2012. It was alleged that during the transfer in a minibus that lasted for 19 hours their handcuffs had not been taken off and there had only been one break for five minutes.

(07/227) Child on trial…

On 27 July 2012 the trial of H.K. (16) who had been detained after a demonstration in Mersin on 9 October 2011 and who is in pre-trial detention since 26 January 2012 continued.

During the hearing at Mersin Heavy Penal Court 3 the lawyer of H.K., Eyüp Sabri Öncel rejected the accusation and stated that his client was a minor who had to be tried at a court for juveniles. The court adjourned the hearing to 10 October 2012 in order to decide on the demand.

(07/228) People on trial…

Following house raids in Çorum on 27 April 2012 the police had detained seven people. On 1 May 2012 five of them, Halil Top, Dursun Turna, Gözde Erdal, Hüseyin Teke and Ender Özçiftçi had been arrested on charges of membership of the illegal DHKP/C organization.

Following the police operation Ankara Prosecutor’s Office had started an investigation against 16 people. The indictment that was prepared as a result of it showed a necklace with hammer and sickle and posters of Deniz Gezmiş as evidence that the defendants were members of an illegal organization.

On 28 July 2012 it was learned that the prosecutor had sent an indictment of 157 pages to Ankara Heavy Penal Court 11. He claimed that the defendants had taken part in the meeting of 1 May on Unity, Struggle and Solidarity in the cortege of the Çorum representation of the Pir Sultan Abdal Culture Association, had made propaganda for an illegal organization and should be sentenced to terms of imprisonment up to 80 years.

(07/229) People on trial…

After the meeting organized by the BDP in Diyarbakır on 3 December 2011 under the motto title “I am here, I take possession of my will” the police had intervened and in the brawl Murat Elibol (21) student at the 100 Years University (Van) for medical documentation had been hit by a bullet from an unidentified arm and had died in hospital where he had been taken heavily wounded.

On 26 July 2012 the trial against 9 people, 6 of them in pre-trial detention, who had taken part in the protest against the killing of Murat Elibol by an unknown assailant, continued.

During the hearing at Diyarbakır Heavy Penal Court 4 the defendants’ demand to defend themselves in Kurdish was rejected and the defendants declared that they boycotted the trial. When the presiding judged asked that the defendants be taken out of the court room the gendarmerie team took them out of the room by beating them with truncheons. The court ordered the continuation of the arrest warrants and adjourned the hearing to 2 October 2012.

Following a mine attack on a military vehicle in Diyarbakır-Lice district on 27 July 2012 that had resulted in the death of two soldiers parallel house searches were conducted and two people were detained.

B.E., who had been detained in house raids in Muş-Bulanık district, Günbatmaz village on 25 July 2012 he was arrested on 27 July 2012 on charges of providing support and shelter for an illegal organization.

(07/232) People on trial…

On 4 December 2011 the police had intervened against a tent of hunger strike erected under the slogan “we don’t want a missile shield, but a democratic university” in Kocaeli. In protest against this intervention Meral Dönmez and Gülşah Işıklı, member of Kocaeli Youth Association had put up a banner from a lawyer’s office. They had been arrested on 6 December 2011 on charges of having violated the inviolability of housing in the name of an organization.

On 30 July 2012 their trial on charges of having committed a crime in the name of the illegal Revolutionary People’s Party/Front (DHKP-C) without being members of it, having made propaganda for an illegal organization and having deprived a person from liberty and violated the inviolability of housing continued.

During the hearing at Çağlayan (İstanbul) Heavy Penal Court 15 the court heard the testimony of the defendants, decided to prolong the arrest warrants and adjourned the hearing to 15 October 2012.

(07/233) Charges against a journalist…

After the journalist Ahmet Şık had been released on 12 March 2012 by Istanbul Heavy Penal Court 15 in the trial related to Oda TV he had made a statement on leaving Silivri Prison. The investigation of the prosecution had resulted in an indictment that had been sent to Silvri Penal Court 2 on 3 July 2012.

The indictment accused him of having threatened civil serveants and having insulted them because of their duties and demanded 12 years, 8 months’ imprisonment. The indictment had listed 39 judges and prosecutors as victims. Silivri Penal Court 2 accepted the indictment and decided that the trial of Ahmet Şık will commence on 13 September 2012.

On 30 July 2012 Kurdish workers at a construction site in İstanbul-Şişli district, Ayazağa quarter were subjected to a lynch attempt. When the workers reacted against this police teams intervened with pepper gas and remove the workers.

(07/235) Intervention in a protest meeting against the Racist attack in Malatya…

On 30 July 2012 members of the People’s Democratic Congress (Halkların Demokratik Kongresi = HDK) had gather in front of the building of the AKP for Izmir province to protest the incident. Because of the police’s intervention with pepper gas Süleyman Göksel Yerdut, member of the Socialist Party of the Oppressed (ESP) fell ill because of gas into his face and had to be taken to hospital.

On 29 July 2012 police teams of the anti-terror-department in Istanbul detained S.D. and Ç.Ş. on suspicion that they wanted to launch an attack on the police headquarters in Vatan Caddesi.

(07/237) House raids in Van…

Following the armed attack on a police vehicle in Van on 26 July 2012 on the road to Erciş police operations were conducted. On allegations that the people responsible for the attack were in a building in the centre of the town fire was opened on the house resulting in the death of one person, and 19 people including one alleged militant of the HPG and two people staying in the house had been detained. Three of the 22 detainees were arrested on 30 July 2012 on charges of membership of an illegal organization.
