Jonathan Spyer : there is an interesting caveat to Kagan’s statement re the Declaration of Independence. In the first draft of the Declaration, written by Jefferson and approved by the drafting committee of Adams, Franklin, Roger Sherman and Robert Livingston, there is a specific assertion of common English ethnicity, which is used to strengthen the colonist’s claims against the Crown: specifically, the document appeals to ‘our British brethren’ who are ‘permitting their chief magistrate to send over not only soldiers of our common blood, but Scotch and foreign mercenaries to invade and deluge us in blood.’
When the document was brought before the full Continental Congress, delegates of Scots extraction were offended by this part and it was removed from the final version.
