01 November 2018 Daily Human Rights Report (11/001) Operations and Attacks in Southeast… It is learned from the news coverage of October 30, 2018 that, 5 militants died in a clash between security forces and HPG militants in Qandil area in Iraqi Kurdistan Regional Government on September 20, 2018. It is learned that 1 police officer got wounded in a clash between security forces and HPG militants in Beşiri district of Batman on October 31, 2018. (11/002) Torture and Ill-Treatment in Prison…

 

It is learned from the news coverage of October 30, 2018 that, Aycan Özdoğan, Saadet Akın and Selver İspir from Ankara Sincan Women’s Prison forfeited the right of probation due to solitary confinement penalties given by the prison administration. (11/003) Hunger Strike in Prison… It is learned from the news coverage of October 31, 2018 that, Şerif Mesutoğlu, who was sentenced to two times of heavy life imprisonment, on the case of Fatih Safitürk’s death, went on a hunger strike on October 23, 2018 to protest the verdict. Fatih Safitürk, sub-governor of Mardin’s Derik district, was also appointed as a trustee for Derik municipality and was killed in his office on November 10, 2016. It is claimed on the news reports that Şerif Mesutoğlu rejected to be visited by his family and lawyers. (11/004) Police Intervention Against “I Want My Job Back” Protest in Ankara… The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 722 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on October 31, 2018 at 13.30 and 18.00. It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on October 31, 2018, 3 people (Nazan Bozkurt, Derviş Lermi and Mehmet Dersulu) and at 18.00 4 people (Mahmut Konuk, Gülnaz Bozkurt, Derviş Lermi and Acun Karadağ) were detained. Thus in total 7 people were detained due to press declaration intended to be held in Yüksel Street on October 31, 2018. It is learned that detainees were released the same day. (11/005) Police Intervention Against a Protest in Istanbul… Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on October 31, 2018 and attempted for a sit-in protest in front of Health Department. The police intervened the sit-in and detained Türkan Albayrak. It is learned that Türkan Albayrak was released the same day. It is the 36th time of detention of Türkan Albayrak. (11/006) Co-Mayor is Detained in Batman… It is learned that at least 10 people including Sabri Özdemir, co-mayor of Batman, who was discharged and replaced with a trustee, are detained in house raids in Batman on October 31, 2018. The names of detainees and the reason for detention is unknown. (11/007) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”… The separate cases against 11 academicians (Assoc. Professor Esra Arsan, PhD Begüm Başdaş, PhD Z.Ç.Ç., Research Assistant Canan Erten from Bilgi University; Research Assistant Yasin Barış Göğüş and Kumru Çılgın, Professor Ayşe Aslı Berkman from Mimar Sinan Fine Arts University; Assoc. Professor Bülent Tanju from Yıldız Technical University; PhD student Dilek Çankaya from Ankara University; lecturer Saadet Sorgunlu and 1 more academician) for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 36 for ‘making propaganda for an illegal organisation’
are held on October 31, 2018. The court adjourned the trial of the case against Z.Ç.Ç. to December 27, 2018; the trial of the case against Esra Arsan to January 9, 2019; the trial of the case against Canan Erten to November 5, 2018; the trial of the case against Bülent Tanju to November 8, 2018; the trial of the case against Begüm Başdaş to March 6, 2019; the trials of the cases against Yasin Barış Göğüş, Saadet Sorgunlu, Ayşe Aslı Berkman, Kumru Çılgın and Dilek Çankaya to January 10, 2019; and the trial of the case against 1 academician to December 6, 2018. The separate cases against 2 academicians (Lecturer Akın Tek from Şehir University and PhD student Özgecan Korkmaz from Michigan University) on Istanbul Heavy Penal Court No 26, for the same reason, is held on October 31, 2018. The court adjourned both of the trials to November 20, 2018. (11/008) Journalist and Executives of ESP and SGDF on Trial… The case against 9 people 5 of which are arrested including Ali Sönmez Kayar, Etkin News Agency reporter; Sıtkı Güngör, central executive board member of Socialist Party of the Oppressed (ESP); Narin Duru, member of The Confederation of Public Employees’ Trade Unions (KESK); and Ali Deniz Esen, central executive board member of The Confederation of Socialist Youth Associations (SGDF), on Istanbul Heavy Penal Court No 32, on the charge of ‘being an illegal organisation member’ is held on October 31, 2018. After defence hearings the court released all 5 arrestees on juridical control conditions and adjourned the trial to February 15, 2019. Sıtkı Güngör, Ali Deniz Esen, Narin Duru, Eren Bulut and Ali Sönmez Kayar were detained on February 1, 2018 in Istanbul and were arrested on February 6, 2018. (11/009) People on Trial in Ankara… The case against 11 women who were detained before the march of Ankara Women’s Platform for International Day for the Elimination of Violence against Women in 2016, on Ankara Penal Court of First Instance No 7 is held on October 31, 2018. The court acquitted 11 people. (11/010) Lawyer on Trial on the Charge of ‘Insulting the President’… Ankara Heavy Penal Court No 30 has accepted the indictment of Ankara Public Prosecutor’s Office against lawyer Özgür Urfa, on the charge of ‘insulting the President’ in several expressions in the appeal request of his clients. The first hearing of the case against lawyer Özgür Urfa will be held on February 13, 2019. (11/011) Detentions and Arrests in Alleged Link to Coup Attempt… On October 31, 2018, 17 people including military members on active duty are detained in operations covering 10 cities through a Samsun based investigation; 14 people are detained on the charge of using ByLock, in operations covering 12 cities through an Istanbul based investigation; and chief physician of Alanya Research and Education Hospital Professor B.A.T. and his spouse A.T. are detained in Antalya. On October 31, 2018, a warrant is issued for 30 military members including 4 colonels, 3 lieutenant colonels, 2 majors and 7 lieutenants through an investigation on Naval Forces Command. Fecri Yıldız, former director of Technical Surveillance Operation Unit in Intelligence Department of Istanbul Police, who was detained through an Erzincan based investigation is arrested by the court on October 31, 2018. (11/012) Trials in Alleged Link to Coup Attempt… The final trial of the case against former police officer Nurullah Altınsoy, who was dismissed by a state of emergency decree, on Kırklareli Heavy Penal Court No 2 is held on October 31, 2018. The court sentenced Nurullah Altınsoy to 51 years and 3 months for ‘violation of confidentiality of communication’, to 6 years and 3 months for ‘forgery’ and to 6 years and 3 months for ‘being an illegal organisation member’. The final trial of the case against former teacher Ömer Göktaş who was dismissed by a state of emergency decree on Ankara Heavy Penal Court No 23 is held on October 31, 2018. The court sentenced the defendant to 8 years and 9 months for ‘being an illegal organisation member’. The final trial of the case against former public prosecutor Onur Arslantepe and his wife, former judge Zehra Haktanır Arslantepe, on Antep Heavy Penal Court No 8 is held on October 31, 2018. The court sentenced the defendants to 6 years and 3 months each for ‘being an illegal organisation member’.
The final trial of the case against former teacher Emel K. who was dismissed by a state of emergency decree, on Adana Heavy Penal Court No 2 is held on October 31, 2018. The court sentenced the defendant to 7 years and 6 months for ‘being an illegal organisation member’. The final trial of the case against a person named G.T. on the charge of using ByLock is held on Ankara Heavy Penal Court No 20 on October 31, 2018. The court sentenced the defendant who benefited from effective remorse laws, to 1 year 6 months and 22 days for ‘being an illegal organisation member’. (11/013) Curfew in Lice… Diyarbakır Governorate made a declaration on October 31, 2018 and lifted the curfew in 28 villages and 25 hamlets of Lice district, which was announced on October 29, 2018 until further notice. The curfew is lifted in following villages and hamlets: Zümrüt, Gürbeyli, Kıpçak, Damar, Sığınak, Kıyıköy, Çıralı, Dibekköy, Budak, Dallıca, Arıklı, Çağdaş, Yolçatı, Tepe, Kutlu, Kayacık, Serince, Kabakaya, Uçarı, Yalaza, Ortaç, Ziyaret, Bağlan, Oyuklu, Çavundur, Esenler, Dolunay and Türeli villages; Ahmetbey, Guçik, Kola, Hasana, Navaladiriş, Dingil, Ayşe, Hacıhüseyin, Kuruca, Dablo, Alataş, Sınır, Pınar, Kolbağı, Bakanlar, Kalkanlı, Beğendik, Hacıcemil, Esenli, Çaylarbaşı, Göçer, Kerpiçören Çanak, Sağlam, Hevselbey hamlets. The curfew is lifted in following villages and hamlets: Arkbaşı, Tepecik, Boyunlu villages; Akdiken, Hacıreşit, Varlık, Işıklar, Gökçe hamlets. (11/015) Curfew in Hazro… Diyarbakır Governorate made a declaration on October 31, 2018 and lifted the curfew in 9 villages and 7 hamlets of Hazro district, which was announced on October 29, 2018 until further notice. The curfew is lifted in following villages and hamlets: Çitlibahçe, Sarıerik, Ormankaya, Meşebağları, Kavaklıboğaz, Dadaş, Kırmataş, Terdöken, Gözebaşı villages; Şahgeldi, Bayram, Nebiya, Yılgeçti, Teknebaşı, Ajikan and Eldeğemez hamlets.

02 November 2018 Daily Human Rights Report (11/016) Person Died Due to Gunshot Fired by Village Guards in Bingöl… It is learned from the news coverage of November 1, 2018 that, 1 person died due to gunshot fired by village guards against a car in Büyükçağ village of Bingöl’s Genç district. Bingöl Governorate declared that a clash occurred between the people in the car and village guards; and 1 person died while 1 person ran away with the car. Bingöl Governorate did not announce the identification details about the person died. On the other hand, it is stated in the news reports that the person died was Sedat Uzan, a civilian and a father of 6, and that the unaccounted for person in the car is Edip Uzan, who is also a father of 3 children. The news reports claim that the car left the village around 4 p.m. and the village guards, following the car, stopped the car at one point and fired their guns on people in the car. It is also stated in the news reports that Sedat Uzan was on judicial control conditions according to which he has to go to the police station regularly for signing documents. It is also learned from the news that Veysel Uzan and Ahmet Uzan, who were alleged to be in the car as well, were detained and taken to Bingöl Police Headquarters. (11/017) Civilian Got Wounded in Military Operation Area in Şırnak… Kokel Babat (38), who got wounded during the military operation in rural areas of Şenoba town of Şırnak’s Uludere district, is arrested by the court on November 1, 2018, after being discharged from the hospital. The gunfire which caused Kokel Babat’s wound at the back was alleged to be fired by security forces. (11/018) Rejection to Meeting Request with Abdullah Öcalan… It is learned that the appeal made on November 1, 2018 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s lawyers in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences
and security measures (law no 5275). With the last rejection, it was the 760th time that appeals for visiting Öcalan have been rejected so far. Abdullah Öcalan has met his lawyers on July 27, 2011 for the last time. (11/021) HDP Executives Detained in Antalya… People’s Democratic Party (HDP) Alanya district co-chair Kadri Bulut and Manavgat district co-chair Cafer Şengül are detained in house raids in Antalya on November 1, 2018, on the grounds of ‘being an illegal organisation member’. (11/022) HDP Members Detained in Diyarbakır… HDP’s Young Women’s Assembly member Şevin Sarı Bulak, Eylem Cengiz, Hazal Karabay and Hülya Özden are detained on November 1, 2018, in front of HDP’s provincial office in Diyarbakır, on the grounds of a report against them. It is learned that 4 people are released after statement procedures at the police. (11/023) Police Raid to Yürüyüş Magazine and Ozan Publishing House… The offices of Yürüyüş Magazine and Ozan Publishing House, where the magazine is published, in Gazi neighbourhood in Istanbul, are raided by the police on November 1, 2018. It is learned that 1 person (Fırat Kaya) is detained in the raid. (11/024) Police Raid to the House of Revolutionary Party Chair… It is learned that 3 houses in Fatih, Kadıköy and Üsküdar districts of Istanbul, in which Revolutionary Party members including party chair Adnan Akın lives are raided by the police on November 1, 2018. It is reported that nobody was detained in raids. (11/025) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”… The separate cases against 4 academicians (Professor Ali Saysel, Assist. Professor Noemi Levy-Aksu, Professor Neşe Bilgin and Assist. Professor Ali Tuna Kuyucu from Boğaziçi University) for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 27 for ‘making propaganda for an illegal organisation’ are held on November 1, 2018. The court adjourned all of four trials to January 30, 2018. The separate cases against 2 academicians (H.K.A. and Assist. Professor Gülsün Güvenli from Galatasaray University) on Istanbul Heavy Penal Court No 37, for the same reason, is held on October 31, 2018. The court adjourned both of the trials to February 12, 2019. (11/026) Journalist on Trial in Istanbul… The case against journalist Ece Sevim Öztürk, for the news reports she made on July 15 – coup attempt, on Istanbul Heavy Penal Court No 37 is held on November 1, 2018. After defence hearings the court decided to continue detention for Ece Sevim Öztürk and adjourned the trial to December 11, 2018. Ece Sevim Öztürk was detained on June 8, 2018, after she shared her documentary “The Darkest Day of Naval Forces: July 15”; and she was arrested on July 20, 2018 on the charge of ‘making propaganda for an illegal organisation member’.
(11/027) General Secretary of Revolutionary Youth Associations is on Trial… The case against Berkay Ustabaş, general secretary of Revolutionary Youth Associations (DGD) and a sociology student in Istanbul University, and against Helin Bölek, on Istanbul Heavy Penal Court No 26, is held on November 1, 2018. Berkay Ustabaş attended the trial via sound and vision system from Kırıkkale F Type Prison. It is learned that the chief judge interrupted by saying Helin Bölek, who is also arrested, during her defence statements, and that lawyer Yaprak Türkmen was taken out of the court room by judge’s decision. After defence hearings the court decided to continue detention for Berkay Ustabaş and Helin Bölek, and adjourned the trial to January 15, 2019. The indictment demands sentence for Berkay Ustabaş and Helin Bölek on the charges of ‘organising and leading illegal meetings and demonstrations’, and ‘being an illegal organisation member’. Berkay Ustabaş was arrested on January 5, 2018 at Çağlayan Courthouse where he has been to give statement. Helin Bölek was detained in a raid to İdil Cultural Center on November 21, 2016 and was arrested by the court on November 23, 2016. (11/028) Person on Trial for ‘Insulting the President’… The case against actor Mehmet Aslan, on the grounds of ‘insulting the President’ in social media posts, on Istanbul Penal Court of First Instance is held on November 1, 2018. After defence hearings the court adjourned the trial. (11/029) Detentions and Arrests in Alleged Link to Coup Attempt… On November 1, 2018, 59 former police officers who were dismissed by state of emergency decrees are detained in operations covering 12 cities through an Ankara based investigation; 11 people are detained on the grounds of using ByLock are detained in Ankara and 8 military members including those on active duty are detained in operations covering 6 cities through a Sakarya based investigation. (11/030) Trials in Alleged Link to Coup Attempt… The final trial of the case against Savaş Kırbaş, former prosecutor of the case on “Operation Sledgehammer” on Istanbul Heavy Penal Court No 26, is held on November 1, 2018. The court sentenced the defendant to 10 years for ‘being an illegal organisation member’.

03-05 November 2018 Daily Human Rights Report (11/031) Journalists Got Wounded in Girê Spî… It is learned from the news coverage of November 2, 2018 that 2 journalists (Gülistan Mihemed and İbrahim Ehmed from Hawar News Agency ANHA) got wounded due to howitzer shots fired by Turkish Armed Forces to Girê Spî (Tal Abyad) in Northern Syria. (11/032) Operations and Attacks in Southeast… It is learned that 1 village guard died due to gunfire of security forces during a military operation in rural areas of Beytüşşebap district of Şırnak on November 4, 2018. (11/033) Torture and Ill-Treatment in Prison… It is learned from the news coverage of November 4, 2018 that Musa Kurt, a prisoner from Silivri Prison No 9, has written a letter about physical violence they have been subjected in prison; and the letter was censored by Letter Control Committee. It is reported that the letter which was sent after being censored, has only greeting and signature lines. (11/034) Coercion to Uniforms and Reactions Against This… The press declaration of TAYAD (Prisoner’s Families’ Solidarity Association) members attempted to be held in Sakarya Street in Ankara on November 3, 2018 against uniform coercion in prisons is prevented by the police. It is reported that 2 people (Halil İbrahim Şener and İlker Işık) were detained in police intervention. (11/035) Rejection to Meeting Request with Abdullah Öcalan… It is learned that the appeal made on November 2, 2018 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s tutelary and lawyer in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences and security measures (law no 5275).

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on November 3, 2018, 2 people (Nazan Bozkurt and Mehmet Dersulu) and at 18.00 4 people (Derviş Lermi, Mehmet Cafer Keleş, Alev Şahin and Nazan Bozkurt) were detained. It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on November 4, 2018, 5 people (Nazan Bozkurt, Derviş Lermi, Cemal Öksüz, Gülnaz Bozkurt and Mehmet Dersulu) and at 18.00 5 people (Acun Karadağ, Nazan Bozkurt, Gülnaz Bozkurt, Mehmet Dersulu and Derviş Lermi) were detained. Thus in total 22 people were detained due to press declaration intended to be held in Yüksel Street on November 2, 3, and 4, 2018. It is learned that detainees were released the same day. (11/037) Police Intervention Against Saturday Mothers’ Protest in Istanbul… Police obstructed all the streets around Galatasaray Square in Istanbul to prevent Saturday Mothers who rally every Saturday for 23 years in the same place to gather for the 710th time on November 3, 2018. Upon police prevention, the group including parliament members, representatives of political parties, human rights defenders and artists along with families of disappeared people gather in front of Human Rights Association (IHD) Istanbul office and started to march. The police prevented the march too, thus, the group had a sit-in protest and made a press declaration there. It is reported that journalists were also prevented by the police from following the press declaration. (11/038) Prevention of Human Rights Defenders’ Event in Istanbul… “F sit-in”, which is organized for the 345th time by Human Rights Association (IHD) Istanbul Branch Prisons Committee, to demand release of ill prisoners, on November 3, 2018 is prevented by the police. Human rights defenders who attempt to march to Galatasaray Square from IHD office are prevented by the police and made a press declaration in front of IHD office. (11/039) Police Intervention Against a Protest in Istanbul… Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on November 2, 2018 and attempted for a sit-in protest in front of Health Department. The police intervened the sit-in and detained Türkan Albayrak. It is learned that Türkan Albayrak was released the same day. It is the 38th time of detention of Türkan Albayrak. (11/040) Police Intervention Against a Protest in Ankara… Mahir Kılıç, who is on hunger strike for 52 days in front of Republican People’s Party (CHP) Headquarters in Ankara to regain his job at Izmir Metropolitan Municipality from which he was dismissed, is detained two times by the police on November 2, 2018 and is released on the same day. (11/041) Prevention of Event in Edirne… The press declaration of People’s Democratic Party (HDP) MP’s, on November 4, 2018, in front of Edirne F Type Prison where Selahattin Demirtaş, former co-chair of HDP is kept, is prevented by the police on the grounds of interdict of Edirne Governorate. The press declaration was going to be held to mark the second year after arrestment of HDP MP’s including former co-chairs. It is reported that HDP MP’s were subjected to verbal and physical violence by the police. It is learned that after some negotiation the police let the press declaration to be held however prevented the journalists to follow it. (11/042) Prevention of Event in Edirne… The press declaration of People’s Democratic Party (HDP) MP’s, on November 4, 2018, in front of Kandıra F Type Prison where Figen Yüksekdağ, former co-chair of HDP is kept, is prevented by the gendarmerie on the grounds of interdict of Kocaeli Governorate. The press declaration was going to be held to mark the second year after arrestment of HDP MP’s including former co-chairs. MP’s held the press declaration 5 km away from the prison.
(11/043) HDP Executive Detained in Antalya… HDP Manavgat district co-chair Cafer Şengül, who was detained on November 1, 2018 in Antalya, is arrested by the court on November 2, 2018 on the charge of ‘being an illegal organisation member’. HDP Alanya district co-chair Kadri Bulut who was detained through the same investigation is released on judicial control conditions. (11/044) HDP Executive Detained in Diyarbakır… HDP Hani district executive Mehmet Askeri Duman is detained in house raids in Diyarbakır on November 2, 2018. It is learned that Mehmet Askeri Duman is taken to Tunceli for investigation. (11/045) People Detained in Urfa… 5 of 10 people who were detained on October 28, 2018 through an Urfa based investigation are arrested by the court on November 2, 2018 on the charges of ‘being an illegal organisation member’ and ‘aiding and abetting an illegal organisation’. 5 people are released. The names of arrested people known so far are: Selim Çınar and Emin Toprak. It is learned from the news reports that Selim Çınar and Emin Toprak were subjected to torture and ill-treatment under custody which resulted in bruises on Selim Çınar’s face along with ear damage. (11/046) People Detained in Diyarbakır… On November 2, 2018, Agit Tekin and Mücahit Tekin are detained in a house raid in Bahçe village of Diyarbakır’s Dicle district. The reason for detention is unknown. (11/047) HDP Executive’s House in Diyarbakır is Raided… HDP’s Silvan district co-chair Mehmet Taş’s house in Diyarbakır is raided by the police on November 2, 2018. It is learned that the police searched the house and said “You will give statement tomorrow” however did not detain Mehmet Taş. (11/048) The Case on Death of Barış Kerem and Oğuzhan Erkul… On April 15, 2017, in Gazi neighbourhood of Sultangazi district of Istanbul, the police opened fired at a car alleged to disobey stop warning and caused death of Oğuzhan Erkul (17) and Barış Kerem (17) along with 2 wounded children. The indictment against 4 police officers about death of Oğuzhan Erkul and Barış Kerem is accepted by Istanbul Heavy Penal Court No 1. The indictment demands jail penalty for 4 police officers up to 15 years for “causing death and injury of more than one person on conscious negligence”, and demands the sentence to be reduced in case of verdict. The indictment includes police radio transcripts of the incident. It could be understood that the police knew 10 minutes before opening fire that the report about the car is groundless. The medical report given o July 20, 2018, by Istanbul Forensic Medicine Institution Specialization Board No 2, for Ramazan Altürk who got wounded in the incident is also included in the case file. On the contrary to the report given by Gaziosmanpaşa Forensic Medicine Department on November 1, 2017, this report states that, Ramazan Altürk’s injury is life-critical. (11/049) HDP MP on Trial… The case against HDP Batman MP Necdet İpekyüz on Diyarbakır Heavy Penal Court No 10 is held on November 2, 2018. The court rejected the appeal of the lawyers demanding that the legal proceedings should end since Necdet İpekyüz is an MP; on the grounds that Necdet İpekyüz’s deeds are in within the scope of Article 14 of the Constitution, which invalidates impunity of MP’s. (11/050) Former CHP MP on Trial… The case against 12 people including Eren Erdem, former CHP MP and former executive editor of Karşı newspaper; Turan Ababey, grant holder of the newspaper; and journalist Kutlu Esendemir, on Istanbul Heavy Penal Court No 23 is held between October 31 and November 2, 2018. After defence hearings the court decided to continue detention for Eren Erdem, to lift judicial control conditions on Kutlu Esendemir, and to wait for execution of the detention warrant for Ufuk Emin Köroğlu, Emrah Direk, Değer Özergün, Mehmet Aydoğmuş and Murat Kazancı; and adjourned the trial to January 710, 2019. Eren Erdem was detained on June 29, 2018 on a warrant issued by the court and then was arrested. The case against Eren Erdem on Istanbul Heavy Penal Court No 35 was consolidated with the case of Karşı newspaper on Istanbul Heavy Penal Court No 23.

(11/052) Journalist and Executives of HDP and DBP are on Trial in Istanbul… The case against 21 people 8 of which are arrested including Democratic Regions Party (DBP) and HDP members, on Istanbul Heavy Penal Court No 22 is held on November 2, 2018. After defence hearings the court decided to continue detention for 8 people (journalist Haydar Ergül, Eşref Yaşar, Ahmet Sağnıç, Ercan Doğru, Aygül Turhan, Mustafa Elma, Abdullah Geldi, Münevver İlingi and Aysel Diler) and adjourned the trial to January 18, 2018. 21 people were detained in house raids in Istanbul on June 28, 2017 and were arrested on August 11, 2017. (11/053) Executive of EMEP on Trial in Antalya… The final trial of the case against Mahir Doğan, Labour Party (EMEP) Muratpaşa district executive, on Antalya Heavy Penal Court No 8, for social media posts, is held on November 2, 2018. The court sentenced Mahir Doğan to 1 year 10 months and 15 days for ‘making propaganda for an illegal organisation’ and deterred the announcement of the verdict. (11/054) Journalist on Trial in Istanbul… The case against journalist and photographer Çağdaş Erdoğan on Istanbul Heavy Penal Court No 33 is held on November 2, 2018. The indictment demands sentence for Çağdaş Erdoğan for ‘being an illegal organisation member’ and ‘making propaganda for an illegal organisation’. After defence hearings the court adjourned the trial to March 26, 2019. Çağdaş Erdoğan was detained in Kadıköy district of Istanbul on September 2, 2017, on the grounds of taking photographs of National Security Organisation’s facilities, and was arrested on September 13, 2017. He was released on February 13, 2018, when the first hearing of the case was held. (11/055) Detentions and Arrests in Alleged Link to Coup Attempt… On November 2, 2018, 27 people are detained in operations covering 9 cities through an Istanbul based investigation for using ByLock; 13 people are detained in Izmir for using ByLock; 19 people including military members on active duty are detained in operations covering 10 cities through a Bursa based investigation. 8 of 12 people including military members on active duty who were detained through a Kocaeli based investigation are arrested by the court. 11 people are released on judicial control conditions. (11/059) Suspicious Death at Gendarmerie Station… It is claimed on the news coverage of November 5, 2018 that, Hüseyin T. (34) who was detained by gendarmerie in Çorum, hung himself in the custody room of Cemilbey Gendarmerie Station with pyjama strings. Hüseyin T. was detained for not going back to the prison from where he has been out on temporary permission. It is learned that Çorum Public Prosecutor’s Office initiated a judicial investigation while Çorum Gendarmerie Command is conducting an administrative inquiry. (11/060) Hunger Strike in Prison… It is learned from the news coverage of November 5, 2018 that, Şerif Mesutoğlu, who is on a hunger strike since October 23, 2018 in Urfa Siverek T Type Prison was taken to Siverek Public Hospital, and that he was taken back to the prison upon rejecting forcible treatment. Şerif Mesutoğlu was sentenced to two times of heavy life imprisonment on the case of Fatih Safitürk’s murder on November 10, 2016, who was sub-governor of Mardin’s Derik district, and was also appointed as a trustee for Derik municipality. (11/061) Police Intervention Against “I Want My Job Back” Protest in Ankara… The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 727 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on November 5, 2018 at 13.30 and 18.00. (11/090) Allegation of Kidnapping in Diyarbakır… It is claimed on the news coverage of November 7, 2018 that, People’s Democratic Party (HDP) Youth Assembly member Hüsamettin Tanrıkulu was taken into a civilian car by a person claiming to be a
police officer saying “you have to give official statement”, on October 29, 2018 in Diyarbakır. It is reported that Hüsamettin Tanrıkulu was kept in the car for 2 hours and was asked about HDP; the police saying “If you side by us nothing will happen to you” and “We could be friends with you; we could be brothers” forced him to be a police informant before letting him go. (11/091) Torture and Ill-Treatment in Prison… It is learned from the news coverage of November 7, 2018 that 5 children in Diyarbakır Juvenile Prison were subjected to physical violence by a warden on November 1, 2018. It is claimed in the news reports that the warden attempted to stroke F.T. (16, m). It is reported that children’s lawyer made an official complaint to the prosecutor’s office. It is learned from the news coverage of November 7, 2018 that female prisoners in Urfa T Type Prison No 2 were threatened by the soldier in charge who told them “You need to be killed. You need to be shot at the head. You are terrorist”, and that the prisoners were subjected to strip search at the entrance of prison. It is learned from the news coverage of November 7, 2018 that prisoners kept in Ağrı Patnos L Type Prison are not using their visit rights to protest the violations they are subjected to such as dirty tap water, unhygienic food, not being transferred to hospitals. People’s Law Office made a declaration on November 7, 2018 and announced that their client Güven Usta was transferred under coercion from İzmir Şakran Prison to Kırıklar F Type Prison No 1. (11/098) Teacher is Detained for ‘Insulting Atatürk’… Teacher Harun K., who is alleged to say “Take this down, he’s looking at me like a traitor”, referring to the picture of Atatürk in a classroom that he lectures in Şehit Çetin Çakmak Religious Vocational High School in Kepez district of Antalya, is detained on November 7, 2018. Harun K. is released by the court on judicial control conditions on the same day. (11/099) HDP MP on Trial… The case against HDP Hakkari MP Leyla Güven, who was elected on June 24, 2018, is held on November 7, 2018 on Diyarbakır Heavy Penal Court No 9. Leyla Güven rejected to be in handcuffs in the court room, thus she joined to the trial via sound and vision system. It is learned from the news reports that Lars Arslan Rasmussen, The Social Democratic Party MP from Denmark, who was there to follow the trial was not allowed in the court house. Leyla Güven stated in her defence that she is going on an indefinite hunger strike to demand an end to isolation of PKK leader Abdullah Öcalan. The court decided to continue detention of Leyla Güven and adjourned the trial to December 26, 2018. Leyla Güven was detained in a house raid on January 22, 2018, on the grounds of her declaration about Turkish Armed Forces’ military operation to Afrin and her activities in Democratic Society Congress (DTK), and was arrested on January 21, 2018. Leyla Güven was released on June 29, 2018, however the decision of release was reversed by a higher court upon objection of the prosecutor’s office. (11/100) The Case Against Co-Mayor… Gaziantep Regional Court reversed the 10 years’ sentence given to Siirt co-mayor Tuncer Bakırhan by Siirt Heavy Penal Court No 2, on the charge of ‘being an illegal organisation member’ and ‘making propaganda for an illegal organisation’. (11/101) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”… The case against 2 academicians (Lecturer Deniz Parlak from Kemerburgaz University and Assist. Professor Dilşa Deniz from Nişantaşı University) for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 36 for ‘making propaganda for an illegal organisation’ are held on November 7, 2018. The court adjourned the trial of the case against Deniz Parlak to February 13, 2019 and the trial of the case against Dilşa Deniz to January 30, 2019. The separate cases against 2 academicians (Lecturer Ayşegün Soysal and PhD Melike Acar from Boğaziçi University) for the same reason, on Istanbul Heavy Penal Court No 27 is held on November 7, 2018. (11/102) Human Rights Defenders on Trial… The case on Istanbul Heavy Penal Court No 35 against 11 human rights defenders is held on November 7, 2018. The indictment demands 15 years of jail sentence for 11 human rights defenders on the charges of ‘being an illegal organisation member’ and ‘not being a member of but committing crime on behalf of the illegal organisation’. Lawyer Taner Kılıç, Amnesty International Turkey Chair, who has been arrested for another case on June 2017 was also put in the defendants of this case. After defence hearings the court adjourned the trial to March 21, 2019. 10 human rights defenders were detained during a meeting in Istanbul Büyükada on July 5, 2017. Dalkıran from Citizens Assembly, Günal Kurlun and Veli Acu from Human Rights Agenda Association, Ali Garawi (citizen of Switzerland) and Peter Steudtner (citizen of Germany) and released İlknur Üstün from Women’s Coalition, Nalan Ekrem from Citizens Assembly, Nejat Taştan from Association for Monitoring Equal Rights and Şeyhmus Özbekli from Rights Initiative on juridical control conditions. On July 21, upon the prosecutor’s office’s objection to the release, a detention warrant was issued for four of the human rights defenders. İlknur Üstün and Nalan Ekrem were arrested on July 23, 2017, and Nejat Taştan and Şeyhmus Özbekli were released on juridical control conditions. On the first trial of the case which was held on October 25, 2017 eight human rights defenders were released on control conditions. Taner Kılıç was released on August 15, 2018, by an interim decision of the court in regular case review. (11/103) The Case of Sözcü Newspaper… The case against Burak Akbay, grant holder of Sözcü newspaper; Mediha Olgun, news director of www.sozcu.com.tr portal; Yonca Yücekaleli, finance director and reporter Gökmen Ulu, on Istanbul Heavy Penal Court No 37 is held on November, 2018. After defence hearings the court rejected the demand for lifting the ban on leaving the country for Mediha Olgun and Gökmen Ulu, and adjourned the trial to March 12, 2019. On May 19, 2017, a detention warrant has been issued through “Fethullahist Terrorist Organisation/Parallel State Structure Investigations”, for Burak Akbay, Mediha Olgun, Gökmen Ulu and Yonca Yücekaleli. Gökmen Ulu and Mediha Olgun have been arrested by the court on May 26, 2017. Mediha Olgun was released on September 22, Gökmen Ulu was released on November 9, 2017 on juridical control conditions. The indictment of the case is based on a news report “Sözcü Found Erdoğan” by Gökmen Ulu, published on July 15, 2016, and stated that the news report “leads the way, calls on to the planned assassination against President and paves the way for it”. (11/104) SGDF Co-chair on Trial… The final trial of the case against Socialist Youth Associations Federation (SGDF) co-chair Ceren Çoban, on Istanbul Heavy Penal Court, for her declaration about Turkish Armed Forces’ military operation to Afrin, is held on November 7, 2018. The court sentenced Ceren Çoban 1 year 8 months. (11/105) US Consulate Translator on Trial… The case against Hamza Uluçay, who works as a translator for the US Consulate in Adana, on Mardin Heavy Penal Court No 3 is held on November 7, 2018. After defence hearings the court decided to continue detention and adjourned the trial to January 9, 2019. Hamza Uluçay was detained on February 23, 2017 and was released by the court on juridical control conditions. Upon the objection made by the prosecutor’s office Hamza Uluçay was arrested. 09 November 2018 Daily Human Rights Report (11/109) Worker Was Subjected to Physical Violence by Mayor… It is learned from the news coverage of November 8, 2018 that, Yunus Narin, a worker of Aliağa Municipality in Izmir, expressed the difficulties he had been faced at a meeting and then was subjected to physical violence of Mayor Serkan Acar from Nationalist Movement Party (MHP) and his private driver Mete Vural. It is reported that Yunus Narin made an official complaint against mayor and his driver. (11/110) Hunger Strike in Prison… It is learned from the news coverage of November 8, 2018 that, Şerif Mesutoğlu, who is on a hunger strike since October 23, 2018 in Urfa Siverek T Type Prison, ended the strike after meeting with lawyers from Urfa Bar association. Şerif Mesutoğlu was sentenced to two times of heavy life imprisonment on the case of Fatih Safitürk’s murder on November 10, 2016, who was sub-governor of Mardin’s Derik district, and was also appointed as a trustee for Derik municipality. (11/111) Police Intervention Against “I Want My Job Back” Protest in Ankara… The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 730 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on November 8, 2018 at 13.30 and 18.00. It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on November 8, 2018, 2 people (Nazan Bozkurt and Derviş Lermi) and at 18.00 2 people (Derviş Lermi and Gülnaz Bozkurt) were detained. (11/112) Police Intervention Against a Protest in Istanbul… Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on November 8, 2018 and attempted for a sit-in protest in front of Health Department. The police intervened into the sit-in and detained Türkan Albayrak. It is learned that Türkan Albayrak was released the same day. It is the 41st time of detention of Türkan Albayrak. (11/113) People Who Were Arrested in the Police Intervention Against a Protest in Istanbul… Nursel Tanrıverdi and Selvi Polat, who were detained on October 29, 2018 in the police intervention against sit-in protest they hold in Bakırköy district of Istanbul, to regain their jobs from which they have been dismissed by state of emergency decrees; and who were arrested on October 31, 2018 by the court, are released upon objection on November 7, 2018. (11/114) Veli Saçılık’s Car is Confiscated… On November 8, 2018, Veli Saçılık’s car is confiscated for the penalty fine of 22.000 Turkish Liras imposed to him on the grounds of protests he held in order to regain his job from which he was dismissed by a state of emergency decree. Veli Saçılık has been dismissed from his job at Ankara provincial directorate of Ministry of Family and Social Policies by a state of emergency issued on November 22, 2016 and participated in “I Want My Job Back” protests in Yüksel Street in Ankara. (11/115) Co-Mayor on Trial… The case against 22 people 5 of which are arrested including Abdülkerim Erdem, Democratic Regions Party (DBP) member co-mayor of Derik district of Mardin, is held on November 8, 2018 on Mardin Heavy Penal Court No 4. It is learned that the address of Hacı Ataklı, the witness called by the prosecutor’s office, who was supposed to be heard at this trial, was asked to his lawyer who rejected to give his client’s address for security reasons, and who also offered to give testimonial as a substitute for Hacı Ataklı.
After defence hearings the court decided to continue detention for 5 people and adjourned the trial to December 28, 2018. Abdülkerim Erdem was arrested on February 22, 2016. Professor B.T. from University of California) for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 27 for ‘making propaganda for an illegal organisation’ are held on November 8, 2018. At the final trial of October 10 – Ankara Massacre which was held on August 3, 2018, the court has sentenced 19 defendants to jail penalties and separated the cases of 16 fugitive defendants. (11/119) The Case on Death of Barış Kerem and Oğuzhan Erkul… On April 15, 2017, in Gazi neighbourhood of Sultangazi district of Istanbul, the police opened fired at a car alleged to disobey stop warning and caused death of Oğuzhan Erkul (17) and Barış Kerem (17) along with 2 wounded children. The case against 4 police officers about death of 2 people and injury of 2 people started to be held on November 8, 2018 on Istanbul Heavy Penal Court No 1. The indictment demands jail penalty for 4 police officers up to 15 years for “causing death and injury of more than one person on conscious negligence”, and demands the sentence to be reduced in case of verdict. The indictment includes police radio transcripts of the incident. It could be understood that the police knew 10 minutes before opening fire that the report about the car is groundless. The medical report given o July 20, 2018, by Istanbul Forensic Medicine Institution Specialization Board No 2, for Ramazan Altürk who got wounded in the incident is also included in the case file. On the contrary to the report given by Gaziosmanpaşa Forensic Medicine Department on November 1, 2017, this report states that, Ramazan Altürk’s injury is life-critical. Advisors of MP’s and journalists who want to attend the trial were not allowed in. After hearing witness police officers and defence declarations the court adjourned the trial. (11/120) Journalist on Trial in Istanbul… The final trial of the case against journalist Hüsnü Mahalli, on the grounds of ‘insulting the President’ in social media posts, is held on Istanbul Penal Court of First Instance on November 8, 2018. The court sentenced Hüsnü Mahalli to 2 years 5 months and 5 days for ‘insulting the President’ and to 1 year 8 months and 15 days for ‘insulting public officials’. The court deterred the announcement of the verdict on ‘insulting public officials’. Hüsnü Mahalli was arrested on December 2016 through this investigation and was released on January 20, 2017. (11/121) Journalist on Trial in Istanbul… The final trial of the case against cartoonist Sefer Selvi and Çağrı Sarı, former executive editor of Evrensel newspaper, on Istanbul Anadolu Civil Court of First Instance No 29, for the cartoon on “Paradise Papers” published on the newspaper is held on November 8, 2018. The case was opened upon complaints of former Prime Minister Binali Yıldırım and his son Erkam Yıldırım who claim for damages. The final trial of the case against a person named Mustafa Ertem, on the grounds of ‘insulting the President’ is held on Antalya Penal Court of First Instance is held on November 8, 2018. The court sentenced Mustafa Ertem to 11 months and 20 days and deterred the announcement of the verdict. (11/123) Detentions and Arrests in Alleged Link to Coup Attempt… On November 8, 2018, 14 teachers from schools which were closed down by state of emergency decrees are detained in Ankara and 2 colonels are detained in Trabzon. Former prosecutor Ferhat Sarıkaya who were dismissed on October 31, 2018 by The Council of Judges and Prosecutors is detained on November 2, 2018 in Ankara and arrested by the court on November 8, 2018. 3 of 9 people who were detained through a Sakarya based investigation are arrested by the court on November 8, 2018. 3 people are released on judicial control conditions. 3 of 5 people who were detained through a Malatya based investigation are arrested by the court on November 8, 2018. It is learned that 2 people are sent to Diyarbakır for investigation. (11/124) Trials in Alleged Link to Coup Attempt… The final trials of the separate cases against 6 people for leaking the questions of Public Personnel Selection Exam in 2010, on Ankara Heavy Penal Court No 2 are held on November 8, 2018. The court sentenced 4 defendants to 6 years and 3 months and 1 defendant to 7 years and 6 months for ‘being an illegal organisation member’. The court also sentenced 1 defendant to 3 years 1 month and 15 days and fine penalty for ‘chain fraud towards public institutions’. The court acquitted 1 defendant. The final trial of the case against 12 people including Cahit Nakıboğlu, former CEO of Nakban Holding, is held on November 8, 2018 on Antep Heavy Penal Court No 9. The court sentenced 1 defendant to 15 years for ‘establishing and leading an illegal organisation’; 6 defendants including Cahit Nakıboğlu to jail penalties differing from 8 years 9 months to 11 years 3 months for ‘being an illegal organisation member’; and 2 defendants to jail penalties differing from 2 years and 1 month to 3 years and 9 months for ‘aiding an illegal organisation knowingly and wilfully’. The court separated the cases of 3 defendants. The court decided to confiscate the shares of convicted defendants in 42 companies of the holding.

10-12 November 2018 Daily Human Rights Report (11/125) Fire Outbreak in a Raided House in Van… It is learned from the news coverage of November 11, 2018 that police and gendarmerie raided the house of Mehmet Polat, in Erciş district of Van. It is stated in the news reports that a fire started at the house due to a gas bomb which was dropped to the house after residents were taken out, and that the fire damaged the house. Mehmet Polat, in his statements covered by the news reports, remarks the following: “Our house was raided at midnight; they took us from our beds out of the house without proper clothes and socks. They dropped gas bombs into our house from the door and the windows. They searched the house. My daughter is getting married next week, and all her belongings she prepared for wedding is burned down and useless now”. (11/126) Person was Subjected to Police Violence in Diyarbakır… It is learned from the news coverage of November 9, 2018 that, Rıdvan Toktaş, a member of People’s Democratic Party (HDP) Youth Assembly, was attempted to be detained by a person claiming to be a police officer in Yenişehir district of Diyarbakır on October 29, 2018. It is also learned that Rıdvan Toktaş was handcuffed behind his back and forced to lie down by a group of people with long barrelled weapons who came around by a “Ranger” car, and was forcefully put in a car and detained. It is stated in the news reports that Rıdvan Toktaş was subjected to physical violence in the car where they hold a gun against his head. It is learned that Rıdvan Toktaş was subjected to physical violence under custody too, along with being forced to be a police informant; and that he was not allowed to talk to the doctor at the hospital where he was taken for compulsory medical examination. It is learned that the doctor gave him a report that does not evidence the physical violence.
It is claimed in the news reports that Rıdvan Toktaş applied to the hospital once again after being released to inform the doctor about the police violence he was subjected to, and that the doctor called the police upon Toktaş’s request of medical report evidencing the physical violence. (11/127) Operations and Attacks in Southeast… The Ministry of Defence declared that, 7 soldiers died and 25 soldiers got wounded due to explosion of ammunition during cannon shots at Süngü Tepe military base in rural areas of Şemdinli district of Hakkari on November 9, 2018. Şemdinli Criminal Court of Peace imposed a publication ban on the incident on November 9, 2018. The court argued that misinformation and fake images have been broadcasted in the news coverage and stated the following: “In order not to prevent proper investigation, not to influence the public in a negative way, and considering the severity of the incident along with public order and safety, the request of Şemdinli Public Prosecutor’s Office for a publication ban including any kind of news reports, interviews, commentaries and footage in printed, visual and social media in accordance with the article 3/2 of the law number 5187 is considered to be lawful and formal and thus admissible”. It is learned from the news coverage of November 9, 2018 that 7 militants died in a clash in rural areas of Şırnak between October 31, 2018 and November 3, 2018. It is learned that 2 soldiers died and 5 soldiers got wounded in a bombing attack during a military operation in Gabar Mountain in Şırnak on November 11, 2018. (11/128) Torture and Ill-Treatment in Prison… It is learned from the news coverage of November 10, 2018 that 4 prisoners including 2 ill prisoners who were transferred to Manisa T Type Prison, were subjected to physical violence when they reject strip search to which they were forced to at the entrance of the prison. It is reported that Şemsettin Erdem, one of the prisoners, have fainted due to violence. It is also stated in the news reports that prisoners were kept in solitary cells although they demand to be put in political prisoners’ wards; that they were not given food regularly, their chairs in the cells were taken, they were forced to stand up during roll-calls and the medication they need were not given to them. It is learned from the news coverage of November 10, 2018 that Diyarbakır E Type Prison administration initiated a disciplinary proceeding against Leyla Güven, Democratic Society Congress (DTK) co-chair and People’s Democratic Party (HDP) Hakkari MP, who went on an indefinite hunger strike on November 7, 2018, in order to protest isolation of PKK leader Abdullah Öcalan. (11/129) Prevention of Right to Health of a Prisoner… It is claimed in the news coverage of November 9, 2018 that Mahmut Aktaş, a prisoner with cardiac disease in Kırıklar F Type Prison No 1, was prevented from having the operation, which is necessary to be done within 6 months according to doctors, on the grounds of “inefficient budget”. The case known as “JITEM Main Case” on Diyarbakır Penal Court No 1 and the case of Musa Anter’s killing has been consolidated by the Supreme Court’s decision on January 29, 2016. “I know that Mahmut Yıldırım, code-named Yeşil is alive, I received information that he has health problems”, said İsmail Hakkı Pekin, former chair of Department of Intelligence of Turkish General Staff, who was heard as witness. 16 November 2018 Daily Human Rights Report (11/202) Lawyers were Subjected to Physical Violence of the Police and Court Officers in Ankara… It is learned from the news coverage of November 15, 2018 that Fadime Eymir, a lawyer from Ankara Bar Association Department of Code of Criminal Procedure, was subjected to physical and verbal violence of a police officer from Ankara Security Directorate Department of Anti-smuggling and Organised Crime during a trial held on Ankara Penal Court of Peace No 1. It is reported that lawyer Fadime Eymir demanded that the physical violence she was subjected to should be recorded in investigation minutes however the investigating judge rejected her demand. Another lawyer, Büşra Pamukçu from Ankara Bar Association Lawyers’ Rights Department demanded to communicate the issue with the judge and she was also subjected to physical violence of the court officers who took her out of the courtroom and was injured due to hitting the doorknob at the arm. (11/203) Torture and Ill-Treatment in Prison… It is learned from the news coverage of November 15, 2018 that prisoners in Patnos L Type Prison and are not using their visit rights to protest the meals given to them in which allegedly razor pieces are found. It is learned from the news coverage of November 15, 2018 that Taner Korkmaz, a prisoner from Van M Type Prison, is “prohibited from some activities for 1 month” because of giving a painkiller to another prisoner. It is learned that Taner Korkmaz sent a letter to the newspapers and stated that Mecit Şahinkaya, Yusuf Kenan Dinçer, Murat Kaymaz, Akil Nergiz, Talat Şanlı and himself have been kept in solitary cells for 2 years; their letters to the newspapers are either censored or not sent at all and they are not given magazines and newspapers. Hülya Yılmaz was detained on September 8, 2018 at Izmir Adnan Menderes Airport and was released by the court on September 9, 2018. However, Hülya Yılmaz was detained again on September 10, 2018 “administrative detention” decision for 6 months given by the court on the grounds of “posing a threat to public safety and holding the possibility of escape”, and was taken to Harmandalı Repatriation Center. It is stated in the news reports that Hülya Yılmaz has a disability at the rate of 62 per cent and she cannot reach to the regular checks and treatment she needs to. (11/209) Newspaper Employee Detained in Istanbul… Ertan Çıta, an employee of Yeni Demokrasi newspaper is detained in Istanbul on November 14, 2018. The reason for detention is unknown. It is learned that Ertan Çıta is taken to Istanbul Police Headquarters. (11/210) HDP Executive is Arrested in Istanbul… Tuna Aydın, People’s Democratic Party’s (HDP) central executive board member and spokesperson of Youth Assembly, who was detained on November 9, 2018 is arrested by Istanbul Penal Court of Peace No 7 on November 10, 2018. It is learned that the court states the following as the reason for detention: “the possibility that he could have been a part of armed and ideological training of the organisation in rural areas, that he could be connected to several members of the organisation, and that he could be responsible for redirecting the instructions from rural part of the organisation to youth structures”. (11/211) Police Raid to Revolutionary Party’s Headquarters… Revolutionary Party’s headquarters in Ankara is raided by the police on November 15, 2018. It is learned that the police searched the office and seized several documents. (11/212) HDP and HDK Members on Trial in Istanbul… The case against 29 people 6 of whom are arrested including HDP’s Party Assembly member Can Memiş and several members of People’s Democratic Congress (HDK), is held on November 15, 2018 on Istanbul Heavy Penal Court No 28. The court released Can Memiş, Hasan Hüseyin Gencer and Suphi Yıldız, and decided to continue detention for Taylan Urun, Atilla Sayir and Metin İlan, and adjourned the trial to February 14, 2019. 29 people were detained in house raids on February 7, 2018 in Istanbul and 18 of them were arrested on February 21, 2018. 9 people (Celalettin Can, Abdulsalam Yulcu, Erhan Sarıkaya, Vahit Dalğıç, Filiz Yılmaz, Gonca Yangöz, Mehmet Şamil Altan, Nevzat Yılmaz and Taylan Talaş) were released on judicial control conditions and with a travel ban on June 27, 2018. (11/213) HDP Executives and Journalists on Trial in Istanbul… The case against 39 people including HDP Istanbul co-chair Cengiz Çiçek and journalists Servet Karaduman and Melike Ceyhan, is held on November 15, 2018 on Istanbul Heavy Penal Court No 22. After defence hearings the court lifted judicial control conditions on 1 person (HDP’s Güngören district co-chair Ömer Özkan) and adjourned the trial to February 1, 2019. On April 28, 2018, the police raided Güngören district office of HDP and detained 39 people, and 10 of them were arrested on May 3, 2018. 9 people were released on June 25, 2018 and Ömer Özkan was released on August 2, 2018. (11/214) The Case Against People Evacuated from Nusaybin… The case against 17 children who were detained and then arrested on May 26, 2016, after being evacuated from the buildings they were stuck in during the curfew on Nusaybin district, is held November 15, 2018 on Mardin Heavy Penal Court No 4. It is learned that the children were not brought to the courtroom for trial. The court did not allow any press members in, and it is learned that the court decided to continue detention for 17 children and adjourned the trial to January 3, 2019. (11/215) Detentions and Arrests in Alleged Link to Coup Attempt… Fatih Timur, a person who was detained in Ankara is arrested by the court on November 15, 2018. (11/216) Operations Against People with Alleged Link to Coup Attempt… The Minister of Interior Süleyman Soylu made a speech on 2019 budget of the ministry and of related institutions during the meeting of Grand National Assembly Planning and Budget Committee on November 15, 2019, and stated that 62.730 operations were conducted within the context of defeating the coup attempt and 217.971 people were detained through these operations, while 16.684 of them were convicted and 14.750 of them were arrested pending trial, since July 15, 2016. Soylu also stated that 101 mayors (of 10 provinces, 69 districts, and 22 towns) were suspended in total, and 94 of them were suspended for alleged link to an illegal organisation while 7 of them were suspended for alleged link to the coup attempt.

Anadolu Kültür Executive Board Chair Osman Kavala was detained in Istanbul Atatürk Airport on October 18, 2017 and was November 1, 2017. It is learned from the news coverage of November 17, 2018 that 2 militants died in a clash between security forces and HPG militants in rural areas of Kömür town of Adıyaman on October 17, 2018. (11/219) Torture and Ill-Treatment in Prison… It is learned from the news coverage of November 16, 2018 that Mustafa Mulla, a prisoner from Silivri L Type Prison No 6 is prohibited from visit and communication rights for 3 years as a penalisation for reacting against right violations in prison during his 3 months of arrestment. It is also stated in the news reports that Mustafa Mulla rejected to be handcuffed behind his back during transfers to the court and to carry the ID card with “terrorist” writing on it, during transfers to the hospital and infirmary and thus was subjected to physical violence of the wardens and gendarmerie. It is learned from the news coverage of November 16, 2018 that 3 of 13 prisoners (Mehmet Aydemir, Hebat Aydemir and Siracettin Hassas) from C-16 ward of Manisa T Type Prison who have been subjected to physical violence of the wardens since November 6, 2018, because of rejecting to stand in military order during roll-calls are transferred to İzmir Şakran Prison under coercion. It is claimed in the news coverage of November 16, 2018 that Fevziye Arukan, a prisoner who was arrested and sent to Alanya L Type Prison on November 12, 2018, has bruises and wounds in her body, due to torture she was subjected to under custody. It is stated in the news reports that, another prisoner from the same prison made a phone conversation with his family and told the following: “(…) We believe that she was detained 10 days ago and was subjected to torture under custody. There are beating marks and deep wounds in her fingers. She could have been subjected to electric shock torture. There are marks of strangulation in his neck. The officers that brought her to the solitary cell tells that she had committed suicide but we believe that Fevziye has been subjected to torture at the entrance of prison too. She does not have a clear memory and consciousness thus she is in severe trauma. She does not eat or drink. She tells that she would go on an indefinite hunger strike despite of our objections. She is not open to dialogue and thus we could not learn anything about her family. Fevziye told us that she was detained in Gazipaşa district of Antalya 2 days ago”.

Nursel Tanrıverdi and Selvi Polat are released on judicial control conditions after statement procedures at the prosecutor’s office on November 20, 2018. Nursel Tanrıverdi and Selvi Polat, who has been detained several times for these protests, were released by the court on August 8, 2018 with a ban from getting closer to Bakırköy Square less than 200 meters. Nursel Tanrıverdi and Selvi Polat keep having their protests later on and were arrested 2 times, once on August 21, 2018 and lastly on October 31, 2018. (11/242) Abdullah Cömert Case… The final trial of the case against police officer Ahmet Kuş, for Abdullah Cömert’s (22) death, is held on November 19, 2018 on Balıkesir Heavy Penal Court No 2. Abdullah Cömert died due to being hit by a gas bomb shell at the head, during a protest in Hatay on June 3, 2018 while Gezi Park protests were continuing over the country. The court sentenced police officer Ahmet Kuş to 6 years 10 months and 15 days for ‘killing on conscious negligence’. The court did not ruled detention of the defendant according to the verdict. The sentence of 13 years and 4 months given to Ahmet Kuş by Balıkesir Heavy Penal Court No 2 for ‘intentional injury resulting in death’ was reversed by Penal Department No 1 of the Supreme Court. It is learned that the reason for detention is an anonymous notice to the police reporting that “someone with a bag has entered the house”. It is reported that İmran Akın was subjected to physical violence of the police during the raid and was threatened to death by a police holding a gun against his head. (11/352) Curfew in Lice… Diyarbakır Governorate made a declaration on November 27, 2018 and lifted the curfew in 4 villages and 7 hamlets of Lice district, which was announced on November 26, 2018. The curfew is lifted in following villages and hamlets: Bayırlı, Baharlar, Yaprakköy and Yünlüce villages; Konuklu, Yeşilburç, Mehmedil, Sağlık, Gönen, Hamzabey and Kumumirza hamlets.
