A Turkish and a Syrian citizen were wounded with the fire of the soldiers on the grounds that they did not obey the stop warning as they were trying to cross the border for smuggling from Rojava Region (Syria) to Gülbaba Village of Kilis Province on 1 December 2013.
(12/002) Coercion in prison…
Kenan Kırkkaya, Tolga Bülbül, Utku Aykan and Haydar Yeşilbingöl were beaten by gendarmerie soldiers on the grounds that they covered the camera inside the prison shuttle with a paper handkerchief as they were transferred to Yuvacık Tooth Hospital from Kandıra (Kocaeli) F Type of Closed Prison No. 1 for their medical treatment on 20 November 2013, reported on 2 December 2013.

Diyarbakır Heavy Penal Court No. 8 sentenced Aydın Atar, the former editor-in-chief of Kurdish Daily Azadiya Welat Newspaper, to 11 years 3 months of imprisonment in connection with 9 articles on charges of “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law reported on 1 December 2013.
(12/004) Banned demonstrations, detained people, raided institutions in Muğla Province…
Muğla Governorate stated that all the meeting, demonstrations and public statements were banned for the visit of PM Recep Tayyip Erdoğan to Muğla Province and its districts of Province between 29 November and 2 December 2013.
On 1 December 2013 Youth League of Turkey/Türkiye Gençlik Birliği (TGB) Milas Branch was raided after a “bomb warning”.

Thirteen houses and 1 vehicle were marked in the Yeni Quarter in which Aleviis have been living in Adıyaman Province on 1 December 2013.

(12/006) Extra-judicial killing in Kilis Province…
Ela Şık Nayıf (7) was killed with the soldiers’ fire on the grounds that she and her family did not obey the stop warning as they trying to return back to Syria from Kilis Province on 2 December 2013.
(12/007) The case on the murder of Ethem Sarısülük…
On 2 December 2013 Ankara Heavy Penal Court No. 6 went on hearing the case against police officer Ahmet Şahbaz on the murder of Ethem Sarısülük. The court heard the legal argument of the defendant via Voice and Image Communication System/Ses ve Görüntü Bilişim Sistemi (SEGBİS).
Judges in the ongoing trial unexpectedly withdrew from the case and referred it to another court after lawyers for the Sarısülük family voiced their doubts over the impartiality of the court board. Ankara Heavy Penal Court No. 7 will evaluate this decision.
(12/008) The case on the murder of Musa Anter…
A suspect accused of murdering Musa Anter, a prominent Kurdish author, was arrested yesterday by a court in the south-eastern province of Diyarbakır.
Hamit Yıldırım, who was detained in the south-eastern province of Şırnak on June 29, some 20 years after the murder took place, denied all accusations in his interrogation in court. The court cited strong suspicion of offense in its arrest ruling. Anter was killed in an armed attack in 1992. The prime suspect, Yıldırım, was photographed recently for the first time in Şırnak by daily Sabah. The murder case, which would have been dropped in three months due to the statute of limitations, has been extended for 10 more years due to the new development.
Hamit Yıldırım, a member of Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM), was arrested by Diyarbakır Heavy Penal Court No. 7 on 2 July 2012.
Diyarbakır Chief Public Prosecution Office launched an indictment against 4 people -including Hamit Yıldırım- reported on 27 June 2013. The indictment was sent to Diyarbakır Heavy Penal Court No. 7 in order to be evaluated and the prosecutor asked for life sentence in solitary confinement and with no possibility of parole to 20 years of imprisonment for the defendants Hamit Yıldırım, Mahmut Yıldırım, Abdülkadir Aygan and retired colonel Savaş Gevrekçi. The court had accepted the indictment on 5 July 2013.
Diyarbakır Heavy Penal Court No. 7 went on hearing the case against on 2 December 2013. Pre-trial detainee Hamit Yıldırım who allegedly pulled the trigger in the murder participated for the first time in the hearing and interrogated.
The court adjourned the hearing to 24 January 2014.

Abdülkadir Bozkurt (20) who had been transferred from Mardin E Type of Closed Prison to Tekirdağ F Type of Closed Prison No. 2 against his will on the grounds that he objected to the cavity search by 7 guardians reported on 2 December 2013.

The indictment against 170 people in connection with the solidarity action in Antalya Province on 1 June 2013 on charges of “opposing to the Law No. 2911 on Meetings and Demonstrations”, “harming public goods”, “resisting public officers due to his duty” reported on 2 December 2013.
The first hearing will be in Penal Court of First Instance between 17 and 21 March 2014.
(12/011) Tried juveniles…
A case was launched against 6 juveniles -A.Y. (14), A.D. (15), S.E. (14), B.Y. (17) İ.Ş. (14) and M.S.F. (17)- who had been detained in a protest on the grounds that they threw stones to the law-enforcement in Mersin Province in July 2013 reported on 3 December 2013. The indictment evaluated the Molotov Cocktails as “nuclear, biologic and chemical weapon”.
On 20 November 2013 Mersin Heavy Penal Court No. 2 began to hear the case and heard the legal arguments of the juveniles before adjourning the hearing.
(12/012) Closure case against an association…
The indictment which was prepared against the Kurdish Language Research and Improvement Association-Komela Lêkolîn û Pêşvebirina Ziman Kurdî (KURDÎ-DER) Batman Branch on the grounds that “it is related with the illegal organisation” was accepted by Batman Law Court of First Instance No. 2 reported on 2 December 2013. The first hearing will be on 18 December 2013.
(12/013) Ongoing KCK case in Siirt Province…
On 2 December 2013 Diyarbakır Heavy Penal Court No. 9 went on hearing the case against 18 defendants including Siirt Mayor Selim Sadak -7 pre-trial detainees- who had been subjected to the KCK investigation in Siirt Province in 2012.
The court heard the legal arguments and released Dilber Sevim, Abdullah Aşkara, Siracettin Kayran and Mehmet Halit Kaçar and adjourned the hearing to 10 February 2014.
(12/014) Suspicious death of a soldier in Manisa Province…
Ünal Gündüz (20), who had been serving his compulsory military service in Kırkağaç District of Manisa Province, was found wounded under the window of his dormitory in the fifth floor on 1 December 2013. Ünal Gündüz died in the hopital.
(12/015) Hate crime in Ankara Province…
Trans woman İdil, was stabbed from her abdomen by a person who came to her house in Çankaya District of Ankara Province on 16 November 2013 reported on 3 December 2013. İdil had to spend ten days in hospital for her medical treatment.

(12/016) Impunity in Mehmet Uytun investigation…
The Cizre district governorate has refused to give permission for an investigation into a gendarmerie officer’s killing of an 18-month-old baby with a gas grenade, saying a probe was unnecessary due to insufficient evidence, daily Taraf has reported.
Mehmet Uytun was hit in the head by a gas grenade in 2009 while he was on his mother’s lap at their home, during a police intervention into a demonstration in the Cizre district of the southeastern province of Şırnak. Uytun died in the hospital after being kept in intensive care for 10 days.
According to the prosecutors’ report, Hakan Alkan, the specialist gendarmerie in question, fired his gun in line with his job definition. The incident took place as a result of Alkan performing within the defined line of duty.
The forensic medicine institution said the baby was killed due to a head trauma in its report.
Prosecutors applied to the Cizre district government to open an official investigation into Hakan Alkan’s role in the death. However, the application has been declined, as there was not deemed to be enough concrete evidence about the specialist gendarmerie.
The Public Prosecutors’ Office of Cizre has ended the process, saying a criminal investigation into the suspect could not be launched according to the law, pointing to the Cizre district government’s refusal to open an inquiry.
However, lawyer Rehşan Bataray Saman, a member of the Human Rights Association’s (İHD) Diyarbakır branch, has vowed to take the case to the European Court of Human Rights (ECHR).
(12/017) The case on the murder of Hrant Dink…
The Supreme Court of Appeal’s Penal Chamber No. 9 had crashed the acquittal verdict of the local court against 18 defendants on the grounds that the structure that defendants had been established should be evaluated as “organisation established to commit crimes” under Article 220 of the TPC on 15 May 2013.
On 3 December 2013 İstanbul Heavy Penal Court No. 14 went on hearing the case and defendant Erhan Tuncel who had been arrested recently, stated that the structure that involves police directors Ramazan Akyürek, Sabri Uzun and Ali Fuat Yılmazer, had functioned in the murder. The court adjudicated to hear the other defendants on the decision of the Supreme Court and issued a caught warrant for Ahmet Iskender. The hearing was adjourned to 7 January 2014.

Thirty prisoners were transferred from Tekirdağ F Type of Closed Prison to Silivri (Istanbul) L Type of Closed Prison No. 6 against their will and they were placed in solitary confinement. Six of them started hunger strike to protest the coercion in the prison reported on 3 December 2013.

On 3 December 2013 Izmir Heavy Penal Court No. 12 began to hear the case against 15 defendants -14 pre-trial detainees- in connection with the solidarity action in Izmir Province on charges of “opposing to the Law No. 2911 on Meetings and Demonstrations”, “harming public goods”, “resisting public officers due to his duty”. After hearing their legal arguments the court released, pre-trial detainees Akgün Irgat, Cem Ekici, Emrah Akdağ, Cem Barış Çakıl, Sait Özdemir, Özgür Demirci, Çağlar Korkuz, Hakan Polat, Ali Hüseyin Ayırcı and adjourned the hearing to 10 February 2014.

On 3 December 2013 Izmir Heavy Penal Court No. 12 began to hear the case against 8 pre-trial detainees in connection with the solidarity action in Izmir Province on charges of “opposing to the Law No. 2911 on Meetings and Demonstrations”, “harming public goods”, “resisting public officers due to his duty”. After hearing the legal arguments the court released Kubilay Iyit, Erhan Inal, Orhan Öztürker, Vedat Yeler, Elif Kaya, Ozan Adıyaman, Ibrahim Kaya and Izzet Uysal.

Ankara Penal Court of First Instance No. 24 will be hearing the case against 13 students who protested the bombing in Reyhanlı District of Hatay Province by marching to the Ministry of Foreign Affairs in Ankara 15 March 2013, on charges of “opposing to the Law No. 2911 on Meetings and Demonstrations”, “harming public goods”, “resisting public officers due to his duty” on 21 April 2014.
(12/024) Ongoing KCK case in Siirt Province…
On 3 December 2013 Diyarbakır Heavy Penal Court No. 5 went on hearing the case against 27 defendants -8 pre-trial detainees- who had been subjected to KCK investigation in Kurtalan District of Siirt Province on 2011.
After hearing their legal arguments the court prolonged the pre-trial detention period of the defendants and adjourned the hearing to 4 February 2014.
(12/025) Ongoing KCK case in Batman Province…
On 3 December 2013 Diyarbakır Heavy Penal Court No. 8 went on hearing the case against 23 defendants -7 pre-trial detainees- who had been subjected to KCK investigation in Kurtalan District of Batman Province on 15 February 2012.
After hearing their legal argument of the prosecutor on the essence of the case the court released Ali Toptik and adjourned the hearing to 18 February 2014.

(12/034) Ongoing murder by unknown assailants’ investigation in Muş Province…
Nine people from the same family -Nasır Öğüt (43), Eşref Öğüt (43), Sevim Öğüt (13), Sevda Öğüt (12), Şakir Öğüt (11), Mehmet Şirin Öğüt (8), Cihat Öğüt, Aycan Öğüt (1), Cihan Öğüt (4)- had been killed by burning their house on the grounds that they had been helping and harbouring illegal organisation in Korkut District of Muş Province on Altınova Municipality of 17 May 1993.
Muş Heavy Penal Court had accepted the indictment against Hasköy Gendarmerie Headquarters Commander Captain B.K., Infantry First-lieutenant H.A., Gökyazı Gendarmerie Headquarters Commander Master Sergeant T.N. and Special Task Force Department vice director Ş.U.
On 4 September 2013 the court began to hear the case and impose probations and ban of leaving Turkey on the defendants. The hearing was adjourned to 20 November 2013.
The case was transferred for security reasons by the Ministry of Justice to Kırıkkale Heavy Penal Court and the first hearing in Kırıkkale will be held on 4 December 2013.
Kırıkkale Heavy Penal Court began to hear the case on 4 December 2013 and the defendants claimed that they did not remember anything on the incident and the PKK could be the perpetrator.
Isa Öğüt who was heard as a witness stated that the soldiers came to the village before the fire and gathered everyone in the village square.
The court declined the demands to send back the case to Muş and arrest the defendants before adjourning the hearing to 19 February 2014.

K.A. (21) who had been a pre-trial detainee on charges of homicide in Sincan (Ankara) L Type of Closed Prison No. 1, was stabbed and then suffocated with a string reported on 3 December 2013.

(12/044) The case on the extra-judicial killing of Cem Aygün…
Cem Aygün (22) was shot death from the back of his neck on the grounds that he did not obey the stop warning as he was driving car in Keçiören District of Ankara Province on 30 August 2012. He had been sentenced to 13 months of imprisonment and he had to give signature to the Police Station every day. Police officer claimed that he had collapsed and his firearm had fired.
Ankara Chief Public Prosecution Office had decided nolle prosequi for police officer O.H. and for police officer Fatih Yılmaz had asked 2 years and 6 months of imprisonment on charges of “homicide with excessive use of force without intention and with reasons that annul penal responsibility”.
On 20 June 2013 Ankara Heavy Penal Court No. 4 went on hearing the case against police officer Fatih Yılmaz. The defendant claimed that “I fired my firearm aiming Cem Aygün’s leg in order to stop him”. Mustafa Sarı, the witness of the incident, claimed that the officer fired not aiming to his leg but his back.
The court had declined the demand of the Türkiye Insan Hakları Vakfı (TIHV) to be the intervening party in the previous hearing. The hearing was adjourned to 26 September 2013.
The court went on hearing the case on 5 December 2013 and the defendant Fatih Yılmaz did not participate the hearing. The court heard the statements of the lawyers on the examination of the crime scene and adjourning the case to 30 January 2014 for the preparation of the expert report.
(12/045) Ongoing hate crime case in Diyarbakır Province…
On 5 December 2013 Diyarbakır Heavy Penal Court No. 3 went on hearing the case on the murder of R.Ç. (17) who had been killed by his father M.Ç., and his two uncles Ş.Ç. and A.Ç. with a firearm in Diyarbakır Province in June 2012.
The court took back the right to be the intervening party from the Social Policies Gender Identity and Sexual Orientation Studies Association/Sosyal Politikalar Cinsiyet Kimliği ve Cinsel Yönelim Çalışmaları Derneği (SPOD) with the demand of the mother of R.Ç. and adjourned the hearing to 10 February 2014.
(12/046) Excavations for the people lost in detention in Mardin Province…
Mehmet Emin Atuğ, Abdulkadir Demir, Hizni Bilmen and Şakir Demir had been detained by the officers from Midyat Gendarmerie Command in Budaklı Village of Midyat District of Mardin Province on 14 May 1995 and no one knows their whereabouts since then.
Midyat Chief Public Prosecution Office launched an excavation without informing the families in the vicinity of Giremîra (Girmeli) Village and gave found the remnants to the families reported on 23 June 2013.
Midyat Penal Court of Peace examined the crime scene in Budaklı Village on 5 December 2013. The bullets marks were found from that period.

Selim Şen (27) made an official complaint against three police officers whom he had argued on the grounds that he did not give way and the officers sprayed tear gas on his face in Ordu Province on 3 December 2013.

On 5 December 2013 Diyarbakır Heavy Penal Court No. 8 went on hearing the case against 41 people -5 pre-trial detainees- who had been subjected to the KCK operation after the murder of Hacı Alan, the leader of the temporary village guards in Taşlıçay Village of Karlıova District of Bingöl Province on 28 July 2011.
The court heard the legal argument of the defendants in Kurdish and prolonged the pre-trial detention period of the defendants and adjourned the hearing to 18 February 2014.

On 5 December 2013 Diyarbakır Heavy Penal Court No. 8 went on hearing the case against 40 people -14 pre-trial detainees- who had been subjected to the KCK operation in Batman Province on 5 February 2012.
The court heard the legal argument of the prosecutor on the essence of the case and prolonged the pre-trial detention period of the defendants and adjourned the hearing to 18 February 2014.

(12/057) Intervention to the protest Hakkâri Province and Extra-judicial killing…
Police teams interfered to the protest against the destruction of the cemetery of the PKK militants with real and plastic bullets and water cannons in Yüksekova District of Hakkâri Province on 6 December 2013.
Mehmet Reşit İşbilir (35) and Veysel İşbilir (34) were killed with real bullets. Police teams attacked on the people who went to Yüksekova State Hospital to be informed about the wounded people and fired gas bombs inside the hospital.
Van Forensic Medicine Institute stated that Mehmet Reşit İşbilir and Veysel İşbilir were shot with 8 bullets in total.

Police teams opened fire to the protest against the murder of Mehmet Reşit İşbilir (35) and Veysel İşbilir (34) and shot B.T. (25) in Yüksekova District of Hakkâri Province on 7 December 2013.

An armed group made ID check on the road in the vicinity of Lice District of Province Diyarbakır on 8 December 2013 and abducted four soldiers Non-Commissioned Officers Melik Dikyol and Hakan Özer Specialised Servicemen Uğur Sert and Ali Akdemir.
The four soldiers were released in the vicinity of Sîsê Village.

Police teams had interfered to the march of the TMMOB (the Union of the Chambers of the Architects and Engineers of Turkey) with gas bombs, plastic bullets and water cannons in İstanbul Province on 13 July 2013. Two journalists were wounded and six people were detained in the intervention. Osman Erden (39), a lecturer from Mimar Sinan University, was tortured as he was apprehended.
A case was launched against the six people who had been detained -Osman Erden, Gökhan İrez, Okan Ersoy, Onur Karataş, Gökhan Tanrıverdi and Şevket Tokdabayev- on charges of “resisting public officers due to his duty” and “opposing to the Law No. 2911 on Meetings and Demonstrations” reported on 20 September 2013. Sami Hoştan had been a defendant in the Ergenekon case and sentenced to ten years. He had been arrested from another operation and reportedly had liver metastasis and he has medically treated in Edirne Medicine Faculty Oncology Department on 23 October 2013.
Four gendarmerie soldiers have been accompanying him in the hospital in last 28 days and his family applied for his release to Istanbul Heavy Penal Court No. 23. The court declined the application on 1 November 2013.
The court revaluated the situation of Hoştan and adjudicated to give a break to the execution of his sentence for six months in line with the report of the Forensic Medicine Institute. Sami Hoştan was released after the verdict.

On 12 December 2013 İstanbul Heavy Penal Court No. 16 went on hearing the Oda TV case resumed with its 20th hearing this morning in Istanbul Courthouse where defendants Yalçın Küçük and Hanefi Avcı made their statements.
After that, the court ordered the release of defendants despite prosecutor’s request for the continuation of arrest terms. With the release of Küçük and Avcı, no defendants are being arrested within the case.
However, Küçük and Avcı will remain in prison as the former was convicted to 15 year 2 months and 15 days of prison for Devrimci Karargah case and the latter was convicted to 22 years and 6 months of prison. Both convictions were sent to the Supreme Court of Appeals. The hearing was adjourned to 1 April 2014.

Mehmet Eliveren (19) and Yılmaz Eliveren (17) had been killed by special task force police officers on the grounds that they had been “PKK militants attempted to invade the district” in Genç District of Bingöl Province on 17 April 1999. Also there were documents “on being terrorists” in their files Diyarbakır Chief Public Prosecution Office heard 60 witnesses and consider that they were civilians and sent the file to Genç Chief Public Prosecution Office reported on 22 October 2013.

Five people were killed and 25 others were wounded in the bomb attack on police shuttle in Diyarbakır Province on 8 October 2008.
On 12 November 2013 Diyarbakır Heavy Penal Court No. 5 went on hearing the case against 13 defendants in connection with the attack. The court declined the demand of the lawyers of the defendants to have more time to prepare their defences and adjudicated to separate the case of the pre-trial detainees who were not in the hearing -Neytullah Bayram, Murat Yıldeniz and Ramazan Benice.
The court sentenced Ali Nergiz and Halis Yıldeniz to six times life sentence in solitary confinement and with no possibility of parole and 375 years of imprisonment each. Halis Yıldeniz was also sentenced to 6 years and 8 months of imprisonment.
Defendant Mevlüt Özbey was sentenced to 8 years and 9 months of imprisonment. İhsan Bayram, Bayram Engin, Kamile Bayram, Refika Nergiz, Maşallah Yıldeniz, Şevki Yıldeniz, Emiş Bayram and Arap Yıldeniz were acquitted in the hearing.
The court went on hearing the case against Murat Yildeniz, Baytullah Bayram and Ramazan Benice on 12 December 2012.
The defendants claimed that the translator, who would translate thier argument from Kurdish to Turkish, is a police offocer. Due to this the court adjourned the hearing to 16 January 2014.

Two soldiers had been killed and 12 others were wounded in the explosion of two bombs and in the clash after the bomb attack during an army shuttle had been passing by in Foça District of İzmir Province on 9 August 2012. Kürdistan Özgürlük Şahinleri/Kurdistan Freedom Hawks (TAK) undertook the attack and 8 people had been detained in connection with the attack and 7 of them were arrested.
On 17 December 2013 İzmir Heavy Penal Court No. 12 went on hearing the case on the incident. After hearing the arguments of the defendants the court prolonged the pre-trial detention period of the pre-trial detainees. The hearing was adjourned to 4 February 2014.

Prime Minister Recep Tayyip Erdoğan, who came to Ortadoğu Teknik Universitesi (ODTÜ)/Middle East Technical University (METU) with 105 guards, 3600 police officers, 20 armoured vehicles and 8 vehicles to interfere social incidents (TOMA) to watch the Göktürk-2 satellite’s launch from China, was protested by the students on 18 December 2012. Police teams interfered to the students with pressured water and gas bombs. Two students -Barış Barışık was seriously wounded with the hit of the gas bomb canister- were wounded and 45 students were detained.

(12/169) Ferhat Gerçek case…
Bakırköy Heavy Penal Court No. 9 concluded the case of Ferhat Gerçek, a young man who became paralyzed in 2007 due to police fire at the age of 17. It also turned out that he received longer prison sentence than his shooters concerning the incident that led to his paralysis. He was convicted of “damaging a police vehicle and insulting policemen”. “Ferhat Gerçek is the victim of the incident. Therefore we requested his acquittal and the conviction of policemen. The investigation did not continue according to procedures. There was not even an investigation at the crime scene. No witnesses were heard,” advocate Aycan Çiçek told bianet. The court, however, decided to abandon the announcement of verdict. Policemen Cengiz Çalış, Yavuz Özer, Aydın Özdere, Hasan Bayraktar, Emre Taşkın, Can Koçbülbül and Muzaffer Ünal each received 2.5 years of imprisonment. “The defendants put the victim into a life-threatening situation and caused him to suffer from a life-long condition,” the verdict said. It also underlined that policemen acted with a “possible” purpose. However, they still benefited sentence reductions due to the “possible effect of sentence on the defendants”. On 7 October 2007, distributors of the Yürüyüş magazine were beaten by the police in Yenibosna (Istanbul). Ferhat (17) was shot at this back when he was trying to run away.
A Bakırköy district court opened a trial against police officers Cengiz Çalış, Yavuz Özer, Aydın Özdere, Hasan Bayraktar, Emre Taşkın, Can Koçbülbül and Muzaffer Ünal. The police officers are facing imprisonment of up 10.5 years on charges of “misconduct of office”. Ferhat, on the other hand, faced 15 years of prison under allegations of “opposing the law on meetings and demonstrations”, “resistance to obstruct duty”, “insult of a public official” and “intentional property damage”. The bullet shell and Gerçek’s t-shirt were sent to the Forensic Medicine Institute in order to determine the weapon the bullet was shot from and to be able to proof that Gerçek was shot from a short distance.
However, both the bullet and the t-shirt got lost at the Forensic Medicine Institute and were not included in the case file. The court had applied to the police to appoint an “expert” for the investigation of the footage. The court rejected the policemen to be tried under “attempted homicide”, ruling that Gerçek was shot as they fired in the air. “We took his legs. We will also take his arms,” suspect policemen said when faced with Ferhat Gerçek during a hearing in 2011. An additional trial was opened against Gerçek regarding a compensation claim for the “cost of repair” of the police cars that were damaged on the day of the incident. The General Police Directorate affiliated with the Ministry of the Interior claimed TL 2,242 (€ 900) in compensation from Gerçek and four other people to cover the cost of damage that occurred at two police cars when they allegedly threw stones at the cars.

On 20 December 2013 Diyarbakır Heavy Penal Court No. 6 finalised the case against 16 defendants -5 of them pre-trial detainees- who had been subjected to Koma Ciwaken Kurdistan-Kurdistan Communities League /Assembly of Turkey (KCK/TM), the KCK is allegedly intended to organize the Kurdish people as an umbrella organization that includes Kurdistan Workers Party (PKK) operation in Batman Province on 28 December 2009.
M. Şirin Bağlı and Aydın Kılıç were sentenced to 9 years of imprisonment on charges of “being a member of an illegal organisation” under Article 314 of TPC; Rıdvan Aslan, Selamet Akyüz and İlyas Sağlam were sentenced to 7 years 3 months of imprisonment with the same charges; Ahmet Solmaz, Şeyhmus Yaşar and Nesrin Kılıç sentenced to 6 years 3 months of imprisonment; Gülizar Kalmış, Cahit Kanbay and Veysi Gülseren 7 years 6 months of imprisonment with the same charges. Five defendants were acquitted in the case.

Writer Ragıp Zarakolu had been charged with “helping and harbouring an illegal organisation” under Article 220/7 and Prof. Dr. Büşra Ersanlı had been charged with “being an executive of illegal organisation”.
Istanbul Heavy Penal Court No. 15 had released Writer Ragıp Zarakolu, Muhsin Yenisöz, Irfan Hülakü, Lütfü Balbal, Ali Geritli, Songül Karatagna, Nahit Onat, Zeynal Çelik, Neci Elmas, Burhanettin Toprak, Ismail Zeybek, Evrim Öztürk, Yasin Yalçın, Cemalettin Görbegir, Alaattin Güneş on the grounds that the probability that the qualification of the charges could be change and the conditions of the evidences as well as taking the period of time spent in prison as pre-trial detainees.
The court released Mehmet Cevat İnce, Nizamettin Açıkça, Meyrem Yiğit, Hatice Vural, Ayşe Hacımirzaoğlu (Berktay), Seda Aktaş taking their long pre-trial detention process, after hearing the arguments of the defendants and adjourned to 31 January 2014. On 24 December 2013 Adana Heavy Penal Court No. 10 went on hearing the case against 12 people -7 pre-trial detainees- in connection with the bomb attack in Gaziantep Province on 20 August 2012 which killed 11 people and wounded 70 people.

On 3 July 2013 Istanbul Chief Public Deputy Prosecutor Oktay Erdoğan who is responsible from the terror crimes, had approved the indictment against 22 lawyers -9 pre-trial detainees- who had been detained by Fighting with Terror Department police teams in the operation on the Contemporary Lawyers Association in the context of the Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C) on 18 January 2013. On 18 July 2013 Istanbul Heavy Penal Court No. 23 accepted the indictment in which Selçuk Kozağaçlı and Taylan Tanay are charged with executives of the illegal organisation and the other lawyers were charged with being a member of the same organisation.
On 24 December 2013 Istanbul Heavy Penal Court No. 23 began to hear the case the court decided that the summary of the indictment to be read in the hearing. After that Selçuk Kozağaçlı stated that the would like to make joint defence and finalise it in three days and made the defence on behalf of 22 lawyers -9 of them pre-trial detainees.

The prosecutor who has been working on the investigation on 11 villagers who had been subjected to forced disappearance after they had been detained from their village, Alacakaya Village of Kulp District of Diyarbakır Province on 9 October 1993, finalised the indictment on 24 October 2013.
Diyarbakır Heavy Penal Court No. 7 accepted the indictment and will be hearing the case soon. The prosecutor asked 11 times life sentence in solitary confinement and with no possibility of parole and 25 years of imprisonment for Yavuz Ertürk, Bolu 2nd Commando Brigade former Commander retired Major General.
On 25 December 2013 the court began to hear the case and the defendant who was not present in the hearing ask the court to transfer the case to another province for security of him. The court heard the witnesses and adjourned the hearing to 27 December 2013.

Police teams interfered to the protests with gas bombs and water cannons and 70 people in Beyoğlu and Kadıköy District of İstanbul Province, 3 people in Ankara, 19 people in İzmir were detained. No one detained ni the protests in Hatay, Adana, Edirne, Kocaeli, Kahramanmaraş, Mersin, Zonguldak, Uşak, Eskişehir, Afyonkarahisar, Karabük.

The arrested students were released afterwards.

Yusuf Demir and Ünal Şengezer who had been detained with another person -Muhammed Demir- in home raids in Istanbul Province on 18 October 2012 were arrested on charges of “being a member of an illegal organisation -TKP ML/TİKKO” under Article 314 of TPC on 20 October 2012.
On 31 December 2013 Istanbul Heavy Penal Court No. 23 sentenced Yusuf Demir and Ünal Şengezer to 12 years and 6 months of imprisonment each on charges of “being a member of an illegal organisation” under Article 314 of TPC and “having explosives” and acquitted Demir.
