 01-02 July 2013 Daily Human Rights Report – (07/001) Murder by unknown assailants’ case launched in Mardin Province…

Mardin Chief Public Prosecution office had finalised the indictment against Ankara Gendarmerie Regional Commander Musa Çitil in connection with 13 murders by unknown assailants as he had been Derik (Mardin) District Gendarmerie Commander reported on 9 September 2012. The case against Musa Çitil was sent to Çorum Province due to security reasons.

On 1 July 2013 Çorum Heavy Penal Court No. 2 began to hear the case and Musa Çitil participated in the hearing. He did not accept the allegations in the case file and argued that he had sent his legal argument on the incident. The court declined the demands of the lawyers of the intervening party for the detention of Çitil and adjourned the hearing to 7 October 2013.

(07/002) Abducted soldier in Diyarbakır Province…

An armed group had abducted specialised sergeant Yetkin Beğen working for the Gendarmerie Special Task force in Lice District of Diyarbakır Province on 28 June 2013.Yetkin Beğen was released in the rural part of Hazro District of Province on 1 July 2013.

(07/003) Investigation on the murder of Ethem Sarısülük…

Fighting with Terrorism Department teams had raided on houses and associations in İstanbul, İzmir, Ankara, Antalya, Hatay, Bursa and Kocaeli Provinces in the framework of the Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C) investigation in the morning of 18 January 2013. The Contemporary Lawyers Association’s (ÇHD) General Centre in Ankara Province and İstanbul Branch office, People’s Law Bureau and the houses of the members of the ÇHD were searched. Lawyers Taylan Tanay, Güray Dağ, Ebru Timtik, Barkın Timtik, Naciye Demir, Efkan Bolaç, Betül Vangölü, Şükriye Erden, Serhan Arıkanoğlu, Gülvin Aydın, Zeki Rüzgar and Güçlü Sevimli had been detained. ÇHD’s General Chairperson Selçuk Kozağaçlı and ÇHD’s executive, Lawyer Oya Aslan.

İdil Culture Centre and the office of the Yürüyüş Magazine were raided in İstanbul Province and 68 people were detained in 7 provinces.

Taylan Tanay, who had been detained after the search in his office was beaten by police officers as he was taken İstanbul Security Directorate.

 

The doors of the İdil Culture Centre and the office of Taylan Tanay were broken and searched without the prosecutor.

Selçuk Kozağaçlı was detained inside the airplane that carried him from Bayreuth to Turkey on 20 January 2013.

Police teams interfered the group that protests the operation in Okmeydanı Quarter of İstanbul Province on 18 January 2013 and detained 7 people.

Hüsnü Yıldız was wounded with the hit of the gas bomb canister in the protest in front of the İstanbul Security Directorate on 19 January 2013.

Six lawyers were wounded in the intervention of the police teams to the lawyers who attempted to meet with their clients in the Istanbul Courthouse on 20 January 2013.

 

Nineteen out of the 29 detainees were arrested by the court on 20 January 2013. Seven others were released on bail. On 21 January 2013 ÇHD’s General Chairperson Selçuk Kozağaçlı, ÇHD’s executive Oya Aslan, İstanbul Branch Chairperson Taylan Tanay, İstanbul Branch Executive Güçlü Sevimli, İstanbul Branch former Chairperson Serhan Arıkanoğlu, ÇHD members Ebru Timtik, Barkın Timtik, Naciye Demir and Şükriye Erden were arrested.

On 1 July 2013 the indictment prepared against 22 lawyers -9 pre-trial detainees- who had been detained by Fighting with Terror Department police teams in the operation on the Contemporary Lawyers Association in the context of the Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C) on 18 January 2013 was presented to İstanbul Chief Public Deputy Prosecutor Oktay Erdoğan who is responsible from the terror crimes. Some of the defendants were charged with “being a executive of illegal organisation” and others with being a member.

(07/005) Convicted people…

On 1 July 2013 Çağlayan (İstanbul) Heavy Penal Court No. 16 sentenced Yasemin Karadağ to 7 years 6 ay months of imprisonment and Gazi Nefes to 6 years 3 months of imprisonment on charges of “being a member of an illegal organisation – Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C)” under Article 314 of TPC. Other defendants Emel Keleş and Çiğem Yakşi were acquitted.

(07/006) Home raids in Şırnak Province…

Thirteen people -3 juveniles- were detained in the synchronised home raids of the Fighting with Terror Department teams on the grounds that they had established KCK Security Division in Cizre District of Şırnak Province on 1 July 2013.

(07/007) Actions against the interventions of the government to the fundamental rights and freedoms and the right to the city…

On 2 July 2013 İstanbul Administrative Court No. 6 declined the objection of the Ministry of Culture and Tourism against the decision that halts the execution of the Gezi Park Plan.

Seven people who had participated in the protest by battering their pan with a spoon in their balcony in Finike District of Antalya Province during the Gezi Park actions were sentenced to a fine of 88 TL each on the grounds that she had opposed the Law of Misdemeanours reported on 2 July 2013.

An investigation was launched against three people -O.G., M.A. and A.Y.K.- who hanged a placard that shows Recep Tayyip Erdoğan as Adolf Hitler from an apartment during the Gezi Park actions in Tekirdağ Province on charges of “insulting public officer due to his duty” on 1 July 2013.

(07/008) Investigation on the murder of Medeni Yıldırım…

Medeni Yıldırım (18) was killed and nine people were wounded with the fire of soldiers to the protestors against the construction of a new headquarters in Kayacık Village of Lice District of Diyarbakır Province on 28 June 2013.

Diyarbakır Chief Public Prosecution Office took confidentiality decision on the investigation on 2 July 2013.

(07/009) Police violence in the protest in Ankara Province…

Police officers tried to halt a woman protestor with verbal and physical violence to record the protest in front of the Takvim Newspaper against the sexist title used in news on male violence on women in Ankara Province on 2 July 2013. The violence was also recorded.

 

(07/010) The condition of ill pre-trial detainees and Convicts…

Abdullah Kalay a prisoner in Kandıra (Kocaeli) F Type of Closed Prison No. 2 whose 35% of his heart is functioning after the cardiac attack he had could not ve medically treated due to the risk of the second attack reported on 2 July 2013.

Lawyers Rezan Sarıca, Cengiz Yürekli and Mazlum Dinç were not allowed to visit their client Abdullah Öcalan on 2 July 2013 on grounds that the ship that would carry them to İmralı Island was out of order.

(07/012) Ongoing KCK Case in Van Province…

Ten out of the 14 detainees who had been subjected to the “KCK Investigation” in Van Province on 7 June 2012 -Van Belediye Chairperson Bekir Kaya, BDP former Province Chairperson Cüneyt Caniş, Başkale Mayor İhsan Güler, BDP Muradiye District Branch Chairperson Mehmet Şirin Yıldız, Özalp Mayor Murat Durmaz, BDP Başkale former District Branch Chairperson and Democratic Society Congress (DTK) member Derviş Polat, Edremit Mayor Abdulkerim Sayan, BDP Çaldıran District Branch Chairperson Metin Adugit, BDP Erciş District Branch former Chairperson Veli Avcı and BDP Özalp District Branch Chairperson Yakup Almaç- were arrested on charges of “being a member of an illegal organisation” under Article 314 of TPC on 10 and 11 June 2012.

On 2 July 2013 Van Heavy Penal Court No. 4 went on hearing the case against 13 defendants and heard the demands of the lawyers and lifted the ban of going abroad for all of the defendants and adjourned the hearing to 10 October 2013.

Sabri Salman (26) who was wounded in the gun powder factory of the State in Elmadağ District of Ankara Province on 20 March 2013 died in the hospital on 2 July 2013.

(07/014) Nolle prosequi decision murder by unknown assailants in Bitlis Province…

Bitlis Chief Public Prosecution Office decided nolle prosequi in the investigation on the murder of 3 PKK militants and a civilian in the vicinity of Esenburun Village of Bitlis Province on 30 May 1993 and Kemertepe Region on 21 May 1997 on the grounds that the complainant letters are not original reported on 3 July 2013.

(07/015) Abducted taxi driver…

Cemal Beyazgül’s (45) car was found abandoned in the vicinity of Çakmaklı Village of Ovacık District of Tunceli Province on 23 June 2013. Cemal Beyazgül’s family claimed that he may be abducted by the TKP/ML-TİKKO, a Maoist party, on the grounds that he has been cooperating with the State reported on 4 July 2013.

(07/016) Investigation on the murder of Ethem Sarısülük…

On 3 July 2013 Ankara Penal Court of First Instance No. 8 declined the demand of the family of Ethem Sarısülük for the detention of the murderer police officer Ahmet Şahbaz on the grounds that they do not have the right to object the the court verdict.

(07/017) Tried people…

On 3 July 2013 İstanbul 23 Heavy Penal Court No. 23 went on hearing the case against 14 defendants -8 pre-trial detainees- in connection with the bomb attack in the İstanbul University’s Faculty of Law on 8 May 2012 which wounded 2 students and a janitor on charges of “being a member of an illegal organisation” under Article 314 of TPC

The court heard the legal arguments of the defendants in Kurdish and released 2 pre-trial detainees Uğur Tekdal (cancer patient) and Ferhat Kavak and adjourned the hearing to 24 September 2013.

Pre-trial detainees Emel Çetin, Raziye Ay and Uğur Tekdal were tried in connection with the bomb attack and the others in connection with the fight with right wingers on 4 June 2012.

(07/018) Ongoing DHKP/C Case in Adana Province…

On 3 July 2013 Adana Heavy Penal Court No. 10 began to hear the case against 17 KESK members -2 pre-trial detainees- who had been subjected to Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C) in Hatay and Mersin Provinces on 19 February 2013. The court released Eğitim-Sen Hatay Branch Chairperson Ayhan Erkal, SES Hatay Branch former Chairperson Ahmet Aras and SES Hatay Branch secretary Merih Şanlı after hearing their legal argument.

(07/019) Ongoing DHKP/C Investigation…

 

On 3 July 2013 İstanbul Chief Public Deputy Prosecutor Oktay Erdoğan who is responsible from the terror crimes, approved the indictment against 22 lawyers -9 pre-trial detainees- who had been detained by Fighting with Terror Department police teams in the operation on the Contemporary Lawyers Association in the context of the Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C) on 18 January 2013. The indictment was presented to İstanbul Heavy Penal Court No. 23 to be evaluated.

On 3 July 2013 Adana Heavy Penal Court No. 8 sentenced M.B. (18) to 66 years and 8 months of imprisonment in connection with the protests in Mersin Province on 9 February 2012 on charges of “committing offence on behalf of an organisation although he is not a member” under Article 220/6 of TPC, “harming public goods”, and “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law. M.B.’s family applied to Human Rights Association (IHD) for judicial support.

(07/021) Confiscated journal…

The first issue of İstanbul Province based the Devrimci Yol’da Devrimci Gençlik Journal (Revolutionary Youth on the Revolutionary Path) was confiscated by Adana Judicature No. 1 on charges of “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law reported on 3 July 2013.

 

(07/022) Actions against the interventions of the government to the fundamental rights and freedoms and the right to the city…

On 2 July 2013 İstanbul Administrative Court No. 6 had declined the objection of the Ministry of Culture and Tourism against the decision that halts the execution of the Gezi Park Plan. On 6 July 2013 İstanbul Administrative Court No. 1 cancelled the project on the Taksim Square.

Bolu Municipality sentenced 9 people who had hanged posters during the Gezi Park actions in İzzet Baysal Street to a fine 1000 TL each on charges of opposing to the law of Misdemeanours reported on 3 July 2013.

Emin Teker (53) died after he fell from the 3rd floor of the building he was working in Karşıyaka District of İzmir Province on 4 July 2013.

(07/026) Operations and clashes in South-east…

The Kurdistan Workers’ Party’s (PKK) armed wing People’s Defence Forces (HPG) claimed that Topçular Gendarmerie Headquarters Command in Hani District of Diyarbakır Province and Kralkızı Gendarmerie Protection Commandership in Dicle District were attacked and a soldier was killed on 3 July 2013. Diyarbakır Governorate declined the attacks.

(07/027) Investigation on the murder of Ahmet Cömert…

Ahmet Cömert (22) had been killed during the protest against the police violence in Gezi Park actions in Hatay Porvince on 3 June 2013. The pro-autopsy report of Abdullah Cömert revealed that he may be killed with a fire arm on 5 July 2013.

(07/028) The case on the explosion in Güngören in Province…

Seventeen people were killed, 154 people were wounded in the bomb attack in Güngören District of İstanbul Province on 29 July 2008.

On 4 July 2013 İstanbul Heavy Penal Court No. 12 went on hearing the case against 9 defendants -6 pre-trial detainees- as the perpetrators of the attack. The prosecutor, in the previous hearings, had asked life sentence in solitary confinement and with no possibility of parole for 17 times and an imprisonment up to 1800 years for the two defendants Hüseyin Türeli and Nusret Teriş each.

The prosecutor had asked for the imprisonment of 6 defendants on charges of “being a member of an illegal organisation” under Article 314 of TPC and “having unlicensed firearms” and acquittal for a defendant.

The court released pre-trial detainees Cihan Aydın, Abdurrahman Oral and Ziya Kıraç. The hearing was adjourned to 31 October 2013.

The relatives of the victims attacked on the lawyers of the defendants and Lawyer Bahri Belen’s nasal bone was fractured.

(07/029) The condition of ill pre-trial detainees and convicts…

Taylan Çintay who had 5 operations due to his bladder cancer in last 5 years, was released from Metris (İstanbul) T Type of Closed Prison on 4 July 2013. He had been transferred from Diyarbakır D Type of Closed Prison to Ankara Numune Training and Survey Hospital and had an operation on 20 May 2013 and he was transferred to İstanbul for his medical treatment and report.

Deniz Kabak was beaten and put into sponged room for 2 hours with his hands cuffed on the grounds that he had objected for the confiscation of his goods in Tekirdağ F Type of Closed Prison No. 1 reported on 4 July 2013.

Fifteen people were detained in the raids of Fighting with Terror Department teams on grounds that they had participated in the Gazi Park actions in İzmir, İstanbul, Manisa, Ankara and Batman Provinces on 5 July 2013.

In Ankara Province Hakan Keskin who had been arrested on grounds that they had participated in the Gazi Park actions was released 3 July 2013, pre-trial detainee Yusufcan Yıldırım also released on 4 July 2013.

On 4 July 2013 Diyarbakır Heavy Penal Court No. 7 sentenced Barış Önen and Yusuf Dost to 18 years of imprisonment each, in connection with the protest in Derik District of Mardin Province on 15 February 2012 on charges of “committing offence on behalf of an organisation although he is not a member” under Article 220/6 of TPC, “opposing to the Law No. 2911 on Meetings and Demonstrations”, “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law, “having explosives”.

(07/034) Ongoing KCK Case in Hakkâri Province…

On 4 July 2013 Van Heavy Penal Court No. 5 went on hearing the case against 6 defendants – 5 pre-trial detainees- who had been subjected to KCK operation in Şemdinli District of Hakkâri Province on 16 September 2011. The court heard the legal arguments of the defendants and prolonged the pre-trial detention process for the pre-trial detainees and adjourned the hearing to 24 September 2013.

On 4 July 2013 Adana Heavy Penal Court No. 10 went on hearing the case against 17 KESK members -2 pre-trial detainees- who had been subjected to Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C) in Hatay and Mersin Provinces on 19 February 2013. On 5 July 2013 Diyarbakır Heavy Penal Court No. 6 went on hearing the case against Mardin Deputy Ahmet Türk in connection with his ten speeches on charges of “committing offence on behalf of an organisation although he is not a member” under Article 220/6 of TPC and “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law.

The court adjudicated to postpone the prosecution against the defendant basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the Third Judiciary Reform Package on 5 July 2012 and to the Law No. 6459 which came into force as a part of the Fourth Judiciary Reform Package on 30 April 2012.

(07/039) Investigation on the murder of Musa Anter…

A suspect accused of murdering Musa Anter, a prominent Kurdish author, was arrested yesterday by a court in the south-eastern province of Diyarbakır.

Hamit Yıldırım, who was detained in the south-eastern province of Şırnak on June 29, some 20 years after the murder took place, denied all accusations in his interrogation in court. The court cited strong suspicion of offense in its arrest ruling. Anter was killed in an armed attack in 1992. The prime suspect, Yıldırım, was photographed recently for the first time in Şırnak by daily Sabah. The murder case, which would have been dropped in three months due to the statute of limitations, has been extended for 10 more years due to the new development.

Hamit Yıldırım, a member of Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM), was arrested by Diyarbakır Heavy Penal Court No. 7 on 2 July 2012.

Diyarbakır Chief Public Prosecution Office launched an indictment against 4 people -including Hamit Yıldırım- reported on 27 June 2013. The indictment was sent to Diyarbakır Heavy Penal Court No. 7 in order to be evaluated and the prosecutor asked for life sentence in solitary confinement and with no possibility of parole to 20 years of imprisonment for the defendants Hamit Yıldırım, Mahmut Yıldırım, Abdülkadir Aygan and retired colonel Savaş Gevrekçi.

On 5 July 2013 Diyarbakır Heavy Penal Court No. 7 accepted the indictment.

(07/040) JITEM case on the murder by unknown assailants in Cizre District…

On 5 July 2013 Diyarbakır Heavy Penal Court No. 6 went on hearing the Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM) case against 7 defendants in connection with the 20 murder by unknown assailants during the period of Cizre Gendarmerie District Commarder Cemal Temizöz between 1993 and 1995. The court heard defendants Burhanettin Kıyak, Adem Yakın and Cemal Temizöz and witnesses Salih Candoruk, the brother of the victim Ömer Candoruk. According to the report presented to the court the person who had been using the code “Yavuz Güneş” in the interrogation and detention records is determined as Burhanettin Kıyak.

The hearing was adjourned to 6 September 2013.

(07/041) Actions against the interventions of the government to the fundamental rights and freedoms and the right to the city…

Six out of the 8 people who had been detained on the grounds that they had been “giving money to the protestors” in Antakya Province on 3 July 2013 were extradited reported on 5 July 2013. The last two were released.

Mücadele Birliği Dergisi reporter Ulaş Yıldız who had been arrested on the grounds that he had participated in the actions for Gezi Park in Adana Province on 24 June 2013, was released after the objection of his lawyer on 5 June 2013.

Two people were who had participated in the protest by battering her pan with a spoon in her balcony in Finike District of Antalya Province, was sentenced to a fine of 88 TL on the grounds that she had opposed the Law of Misdemeanours reported on 5 July 2013.

Eight out of the 16 people (members of the Fundamental Rights Association/Temel Haklar Derneği) who had been detained in home raids on the grounds that they had participated in the actions for Gezi Park in Bursa Province on 4 July 2013 were arrested on charges of “being a member of an illegal organisation- Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C)” under Article 314 of TPC on 6 July 2013.

Four allegedly shopkeepers attacked on the protestors with choppers in İstiklal Street in İstanbul Province on 6 July 2013. The shopkeepers were detained and released by the court on 7 July 2013. During the protests 59 people were detained and several people were wounded. The riot police teams had hid the ID numbers on their helmets and attacked on the journalists. Thirteen journalists were beaten and 2 of them were detained.

On 5 July 2013 Diyarbakır Heavy Penal Court No. 6 went on hearing the case against ten defendants -Sur Mayor Abdullah Demirbaş, Kayapınar Mayor Zülküf Karatekin, Bağlar Mayor Yüksel Baran, Yenişehir Mayor Selim Kurbanoğlu and Lice Mayor Fikriye Aytin- who had planted trees to the Fis Village after the Lice Municipality could not get the authorisation for the festival in the village Diyarbakır Province in 2009 on charges of “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law.

The court adjudicated to postpone the prosecution against the defendant basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the Third Judiciary Reform Package on 5 July 2012 and to the Law No. 6459 which came into force as a part of the Fourth Judiciary Reform Package on 30 April 2012.

(07/043) Intervention to the protest in İstanbul Province…

Police teams interfered to the members of the People’s Front/Halk Cephesi who had attempted to protest the prosecution of their friends in front of the Çağlayan Courthouse (İstanbul) on 5 July 2013 with gas bombs and water cannons on the grounds that it was forbidden to demonstrate in front of the courthouse.

 

(07/044) Tried people…

A police officer and the perpetrator İbrahim Çuhadar were killed and four officers and two civilians were wounded in the suicide bombers attack on the 75th Anniversary Police Centre in Sultangazi District of İstanbul Province on 11 September 2012. İbrahim Çuhadar Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C).

On 14 September 2012, 27 people who had been waiting for the funeral of Çuhadar in front of the Forensic Medicine Institute were beaten and arrested in Yenibosna District of Istanbul Province. Eight detainees were detained on charges of “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law on 18 September 2012.

On 5 July 2013 İstanbul Heavy Penal Court No.23 began to hear the case against 21 defendants -8 pre-trial detainees on charges of “being a member of an illegal organisation –DHKP-C” under Article 314 of TPC, “resisting and threatening public officer”, “harming public goods” and “opposing to the Law No. 2911 on Meetings and Demonstrations”.

The court adjourned the hearing after determining the identities of the defendants and hearing their legal arguments.

Seven people were detained in synchronised home raids on the grounds that they had participated in the actions for Gezi Park in Kocaeli Province on 9 July 2013.

 

Gezi Park which had been closed to public after the police attack on 15 June 2013 opened on 9 July 2013 at 1:30 pm and reclosed at 5:00 pm the same day with the order of the İstanbul Governorate.

 

Taksim Dayanışması/Solidarity protested the closure of the park to the public and the attitude of the police. Police teams resorted to gas bombs water cannons and plastic bullets. Thirty-seven people including 7 members of the Taksim Dayanışması were detained and at least 9 people were wounded. Gezi Park was opened again in the night.

A person who had fired six rounds during the protest was detained.

Eight out of the 59 people -Ahmet Erol, Ahmet Kaycı, Ali Sarıçiçek, Alican Sünnetçioğlu, Mehmet Yalçın, Oğuz Tekin, Özgür Yıldırım, Umut Akgül- who had been detained after the attack in İstanbul Province on 6 July 2013 were arrested on charges of “opposing to the Law No. 2911 on Meetings and Demonstrations” and “resisting officers” on 8 July 2013.

(07/061) Ongoing KCK Case in Ankara Province…

On June 28-29, 2012, the Ankara Heavy Penal Court No. 12 decided to arrest Osman İşçi, member of the Human Rights Association (İHD), EMHRN Executive Committee member and a member of Eğitim Sen, the Education and Science Workers Trade Union affiliated to the Confederation of Public Workers’ Trade Unions (KESK), and 27 other trade union members while 25 others were released pending the outcome of the investigation. They had been detained in home raids on 25 June 2012.

Hanım Koçyiğit, IHD’s Sakarya Province Branch executive, was also detained and later arrested in the same operation. She has been in Sincan Closed Prison for Women since then.

On 13 February 2013 Ankara Heavy Penal Court No. 13 had accepted the indictment against 72 defendants -28 pre-trial detainees- who had been detained and then arrested in the KCK operation against KESK in 17 provinces in June 2012. The court determined the date of the first hearing as 10 April 2013 and released 6 pre-trial detainees: SES General Secretary Sıddık Akın, Eğitim-Sen Tunceli Branch Chairperson Hasan Ölgün, Eğitim-Sen Adıyaman Branch executive Erdal Yılmaz, Eğitim-Sen member Hanım Koçyiğit, BTS Diyarbakır Branch Secretary Veysel Özhekti and Haber-Sen member Sibel Anıl on 15 February 2013.

On 10 April 2013 Ankara Heavy Penal Court No. 13 had released all the pre-trial detainees after having their ID check and legal argument.

On 8 July 2013 Ankara Heavy Penal Court No. 13 went on hearing the case against 72 defendants and the court suspended judicial control decision for all the defendants and adjourned the hearing to 25 November 2013.

On 9 July 2013 Diyarbakır Heavy Penal Court No. 9 went on hearing the case against 14 defendants -2 pre-trial detainees- who had been subjected to KCK operation in Viranşehir District of Şanlıurfa Province on charges of “being a member of an illegal organisation” under Article 314 of TPC.

The court, after hearing the legal argument of the defendants on the essence of the case, 12 defendants to 6 years and 3 months of imprisonment each and acquitted 2 others.

On 9 July 2013 Van Heavy Penal Court No. 5 went on hearing the case against Hamdiye Çiftçi who made a news on the torture of police officers in the street during the Newroz Celebrations in Hakkâri Province in 2008. Ali İsmail Korkmaz (19) who had been battered by the unidentified people after the protest Eskişehir Province on 3 June 2013 for the Gezi Park, died in the hospital on 9 July 2013.

Volkan Kesanbilici had been wounded with the plastic bullet that had been fired by a police officer in Tarlabaşı Boulevard in İstanbul Province on 31 May 2013. He had an operation on 5 July 2013 which revealed out that he had lost his eye due to the metal balls hidden in the plastic bullet.

Thirteen out of the fifteen people who had been detained in home raids in 2013 İzmir, İstanbul, Manisa, Ankara and Batman Provinces on 5 July 2013 were arrested on charges of “being a member of an illegal organisation” on 9 July 2013.

The flats of the seven members of the Taksim Dayanışması who had been detained in that attack of the police officers in İstanbul Province on 9 July 2013 were searched after their doors were broken down. Three lawyers who had gone to defend the 8 people in Çağlayan Courthouse who had been arrested İstanbul Province on 6 July 2013 were beaten by the police teams. The physicians decided to make Mustafa Ali Tombul (16) to sleep for two weeks who had been wounded from his head with a gas bomb canister reported on 9 July 2013.

A.S. who had fired 6 rounds on the demonstrators during the attacks on Taksim Dayanışması on 9 July 2013 was arrested but the objection of the prosecutor against the release verdict of the court for 4 people, who had attacked on the demonstrators with choppers, was rejected.

The surveillance cameras of the security directorate (known as MOBESE) were recording leaves of a tree during murder of Ethem Sarısülük by police officer Ahmet Şahbaz in Gezi Park Protest in Ankara Province on 1 June 2013 reported on 9 July 2013.

Pre-trial detainees and convicts from PKK and PJAK cases had commenced a hunger strike in order to obtain health, security and freedom conditions of Abdullah Öcalan and for the democratic rights of Kurdish people on 12 September 2012.

On 9 July 2013 İstanbul Heavy Penal Court No. 22 began to hear the case against 19 people -12 pre-trial detainees- who had supported the hunger strikes in prison by erecting tents in Okmeydanı Quarter of Şişli District of İstanbul Province on 30 October 2012. The court determined the identities of the defendants and heard their legal arguments and released all pre-trial detainees. The hearing was adjourned to 3 October 2013.

On 9 July 2013 Van Heavy Penal Court No. 5 went on hearing the case against 13people -10 pre-trial detainees- who had been subjected to “KCK Investigation” in Erciş District of Van Province on 15 May 2012.

The court heard the legal arguments of the defendants in Kurdish and released pre-trial detainees DTK delegate Cevdet Avcı, BDP’s former District Executive Şevket Ulugana and MEYA-DER Erciş Representative Mehmet Zeki İşcan before adjourning the hearing to 1 October 2013.

Ali İsmail Korkmaz (19) who had been battered by the unidentified people after the protest Eskişehir Province on 3 June 2013 for the Gezi Park, died in the hospital on 9 July 2013. On 10 July 2013 the records of the surveillance cameras were damaged. The prosecution office launched an investigation against the officers who had taken the damaged records from the sources.

 

Both the prosecution office and the Eskişehir Medical Chamber launched investigations against the physcians who did not treated Ali İsmail Korkmaz before his interrogation.

Seventeen pre-trial detainees and convicts had been transferred to Metris (İstanbul) T Type Closed Prison to get a report from the Forensic Medicine Institute reported on 28 August 2013: Mehmet Emin Akdağ, Hakan Gölünç, Hasan Kaçar, Ümit Aydın, Taylan Çintay, Hasan Alkış, Suphi İsmail, Filit Tiltay, İsmail Elmas, Salih Tuğrul, Avni Uçar, Ali Ekber Oruç, Hüseyin Dinç, Hüseyin Yıldız, Engin Aktaş, Sebgetullah Güler, Fikret Güzel Aydın and Kamil Turanlıoğlu.

The Forensic Medicine Institute determined that 13 prisoners could be medically treated in their prisons. The proceedings of Hakan Gölünç, Engin Aktaş, Ümit Aydın, Fikret Gürsel Aydın are still going on reported on 11 July 2013.

 

(07/085) Actions against the interventions of the government to the fundamental rights and freedoms and the right to the city…

 

Four allegedly shopkeepers attacked on the protestors with choppers in İstiklal Street in İstanbul Province on 6 July 2013. The shopkeepers were detained and released by the court on 7 July 2013. The prosecutor objected their release and caught warranties were issued for them. The shopkeepers in the vicinity of the Taksim Square who claimed that they had “material loss due to the actions” will be allegedly counted as “terror victims” and their loss will be covered. One of the perpetrators S.Ç. allegedly fled to Morocco on 12 July 2013.

 

A.A. who had been detained with 58 people in the action on 9 July 2013 stated in her prosecutor’s testimony that she had been subjected to cavity search. Burcu Sarak who had been detained with her mother stated that she were tortured.

 

Twelve detainees -Akif Burak Atlar, Mücella Yapıcı, Ali Çerkezoğlu, Ahmet Kamil Tekerek, Beyza Metin, Ender İmrek, Mehmet Sabri Orcan, Süleyman Solmaz, Haluk Ağabeyoğlu, Arda Mustafa Aytaç, Aral Demircan and Erdem Ateş- were released by the court on 11 July 2013. The prosecutor charged them with “creating a crime organisation”, “opposing to the Law No. 2911 on Meetings and Demonstrations” and “resitting police officer on duty”.

 

Twelve people were detained in synchronised home raids on the grounds that they had participated in the actions for Gezi Park in Mersin Province on 11 July 2013.

 

Sıla Uzunpınar, Ulaş Kaman, Sercan Ulu, Mert Arslan and Erdem Altınkaya who had been arrested in the operation in Ankara Province on 27 June 2013 were released after the objection of their lawyers 11 July 2013.

 

A soldier, 3 police officers and 5 civilians were wounded and a person was detained in the intervention of the law enforcement to the protest after the funeral of Ali İsmail Korkmaz in Hatay Province.

 

Fifteen people were detained in home raids in 2013 İzmir, Manisa, Balıkesir and Bursa Provinces on 12 July 2013.

 

(07/086) The investigation on the murder of Ali İsmail Korkmaz by unknown assailants…

 

Ali İsmail Korkmaz (19) who had been battered by the unidentified people after the protest Eskişehir Province on 3 June 2013 for the Gezi Park, died in the hospital on 9 July 2013.

 

Ali İsmail Korkmaz had been sent to his home with pain killers without any proper medical treatment in the emergency service of the hospital in the day of the incident. The Ministry of Health declined the allegations that he was not treated and they had launched a judicial and an administrative investigation on 11 July 2013.

 

It is understood that the records of the surveillance cameras were damaged and the part that would help to identify the perpetrators and that covers the 18 minutes incident was deleted.

 

Eskişehir Chief Public Prosecution Office stated that the records of the 40 cameras were sent to Ankara Gendarmerie Criminal Laboratory and the demand of a person to be a confidential witness was declined.

 

The specialised person who had evaluated the records presented his report to the Prosecution Office reported on 28 June 2013. According to the report “a group of people were seen with batons, baseball sticks together with police officers or police officers in plain clothes. They hit an activist with sticks and pursued other activists in the streets”.

Police teams had attacked on the protest of the Taksim Dayanışması/Solidarity and had detained 59 people in İstanbul Province on 6 July2013. One of the 59 detainees Chief Cook Metin Toprak stated that he had been tortured in the security directorate on 12 July 2013.

A group attack with sticks and knives on the march to commemorate Ali İsmail Korkmaz in Kocamustafapaşa Quarter of Fatih District of İstanbul Province on 12 July 2013. A person was wounded and the perpetrators allegedly said that “come here tomorrow and see how many people will be killed”.

A soldier, 3 police officers and 7 civilians were wounded and a person was detained in the intervention of the law enforcement to the protest after the funeral of Ali İsmail Korkmaz in Hatay Province in the night of 12 July 2013.

(07/093) Ongoing case on enforced disappearance in detention…

On 26 April 1995 the mountain unit from Bolu had raided Yekmal (Aşağı Ölçek) village in Yüksekova district, Hakkari Province and detained a number of people including Nezir Tekçe. In September 2011 soldiers had been indicted on complaint of the family and the court case had been transferred from Hakkâri to Eskişehir. Nezir Tekçe’s father, Halit Tekçe had alleged that the transfer had been made in order to close the file. Already in 1997 had filed an official complaint but the military prosecutor in Van had closed the investigation arguing that there was nothing to be prosecuted. In the soldiers Yunus Şahin had come forward as a witness for the killing of Nezir Tekçi and the case was opened again.

Retired Colonel A.O.A. and retired lieutenant-colonel K.A. had been indicted for having given the order first to shoot Nezir Tekçe and then have him destroyed with the explosion of a mine, because he refused to show the place of PKK militants.

On 12 July 2013 Eskişehir Heavy Penal Court No. 1 went on hearing the case against and the new witnesses also approved the previous accounts on the murder of Nezir Tekçi. The court declined the demands for the arrest of the defendants and the hearing was adjourned to 4 October 2013.

(07/094) The investigation on the murder of Ethem Sarısülük…

The indictment against the police officer Ahmet Şahbaz, who killed Ethem Sarısülük in Ankara Province on 1 June 2013 was sent to Ankara Heavy Penal Court No. 6 to be evaluated on 12 July 2013. The prosecutor asked up to 5 years of imprisonment against the murderer on charges of “homicide with excessive use of self-defence” under Articles 81 and 27/1 of the TPC.

Syrian İlyas Cesim was killed with the fire of the soldiers to the group (approximately 200 people) that attempted to enter Turkey from Syria in the vicinity of Nizip District of Gaziantep’in Province on 12 July 2013.

Semih Demir (18) was detained by police officers in plain clothes in Gazi Quarter of Sultangazi District of İstanbul Province on 13 July 2013. He claimed that he was tortured in the police vehicle, in the forest that he was taken and in the police station. The officers showed him photographs and asked whether he knows the persons or not.

Süleyman Yeter had been detained in the MLKP investigation in İstanbul Province on 4 April 1999 and he had been killed with torture on 7 April 1999. The perpetrator, vice commissioner Ahmet Okuducu was arrested in Samsun Province on 12 June 2013.

On 11 July 2013 Diyarbakır Heavy Penal Court No. 8 went on hearing the case against Ali Narin (19) who had been detained in Diyarbakır Province on 7 February 2013 on charges of “being a member of an illegal organisation” under Article 314 of TPC, “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law and “having explosives”.

The court heard the legal argument of him in Zaza language and prolonged the pre-trial detention period of the defendant although the accounts of the police officers are contradictory. The hearing was adjourned to 19 September 2013.

Aydın Ay was wounded with the hit of the gas bomb canister in the protest in Dikmen Street in Ankara Province on 14 July 2013. Two people were detained at the end of the protest on 15 July 2013.

Murat Akıncı, a member of the Socialist Party of the Oppressed (ESP) who has been released after he had been detained in the protest in Adana Province, was arrested with the objection of the prosecutor on 15 July 2013.

Eleven out of the fifteen people who had been were detained in home raids in İzmir, Manisa, Balıkesir and Bursa Provinces on 12 July 2013 were arrested on 15 July 2013.

At least 38 people were detained in synchronised home raids of the Fighting with Terrorism Department teams in the framework of the actions for Gezi Park in İstanbul Province on 16 July 2013. Taxi driver Cemal Beyazgül (45) whose car was found abandoned in Çakmaklı Village of Ovacık District of Tunceli Province on 23 June 2013 and who had been allegedly abducted by the militants of the TKP/ML-TİKKO on the grounds that he had been cooperated with the State was found killed on 16 July 2013. It seems that he was tortured before he was killed.

The indictment against the police officer Ahmet Şahbaz, who killed Ethem Sarısülük in Ankara Province on 1 June 2013 had been sent to Ankara Heavy Penal Court No. 6 to be evaluated on 12 July 2013. The prosecutor had asked up to 5 years of imprisonment against the murderer on charges of “homicide with excessive use of self-defence” under Articles 81 and 27/1 of the TPC. The new witness stated that he saw the incident from the balcony of his apartment and Ali İsmail Korkmaz had been beaten by 4 civilians and 3 police officers on 16 July 2013.

Ali İsmail Korkmaz had gone to the Odunpazarı Police Station to give testimony the day after the lynch attempt.

A.Ö. Who had been detained in connection with the murder was released stated on 16 July 2013.

(07/114) Şükrü Talay Case…

Seven police officers of the special task force -Ergün Yılmaz, Murat Tahsin, Mustafa Atlı, Murat Özön, Hasan Bulut, Mehmet İniş and Uğur Doğan- had killed villager Şükrü Talay by battering in Başkale District of Van Province on 29 Ağustos 1997. The case against the officers finalised reported on 17 July 2013.

The police officers had been convicted 3 times before but the verdicts were crashed each time.

Van Heavy Penal Court No. 1 sentenced four officers Murat Özön, Mustafa Atlı, Mehmet İniş and Hasan Bulut to 11 years and 8 months of imprisonment on charges of “homicide”.

Eight defendants were acquitted in the same case.

 

The 17 defendants had been subjected to the KCK investigation in Hakkâri Province on 11 June 2012.

Five students had been detained in Ankara Province 20 January 2011and had been arrested on the grounds that they had been plotting an attack on the right wingers on 23 January 2011.

 

On 16 July 2013 Ankara Heavy Penal Court No. 11 went on hearing the case against five students on charges of “being a member of an illegal organisation –four different organisations, Kurdistan Workers’ Party (PKK), Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C), Communist Labour Party of Turkey /Leninist (TKEP/L), Maoist Communist Party (MKP)”. The court sentenced Yusufcan Yıldırım to 2 years of imprisonment on charges of “helping and harbouring an illegal organisation” under Article 220/7 and Uğurcan Soybelli, and Didem Ezgi Serap to 9 years, one month and 10 days of imprisonment and a fine of 3200 TL each on charges of “being a member of an illegal organisation” under Article 314 of TPC and “carrying cutlery”. Ali Haydar Yıldız and Rıdvan Akbaş were acquitted.

The court adjudicated to postpone the prosecution against the defendants Uğurcan Soybelli, and Didem Ezgi Serap for 3 years basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the Third Judiciary Reform Package on 5 July 2012.

At least 38 people were detained in synchronised home raids of the Fighting with Terrorism Department teams in the framework of the actions for Gezi Park in İstanbul Province on 16 July 2013. The detainees allegedly have relations with several political organisations such as: Student Collective/Öğrenci Kolektifleri, Liseli Genç Umut, AKA-DER, HKP, Özgür Gelecek and Devrimci Demokrasi Magazines. The prosecutor had issued 55 detention warrant and a search warrant for 72 hours.

 

Eight pre-trial detainees Ahmet Erol, Ahmet Kaycı, Ali Sarıçiçek, Alican Sünnetçioğlu, Mehmet Yalçın, Oğuz Tekin, Özgür Yıldırım, Umut Akgül who had been among the 59 people that were detained in İstanbul Province on 6 July 2013 and arrested on charges of “resisting police officers”, “opposing to the Law No. 2911 on Meetings and Demonstrations” on 8 July 2013; were released on 16 July 2013 after the objection of their lawyers.

On 18 July 2013 Kızıltepe Chief Public Prosecution Office reportedly sent the summary of proceedings against 8 people who have been suspects of the 12 murder by unknown assailants and enforced disappearance incidents during the period of retired Colonel Hasan Atilla Uğur had been the commander Kızıltepe District Gendarmerie.

 

According to the summary the 8 suspects under the leadership of Hasan Atilla Uğur, had established the “knife/bıçak” team which is affiliated to the Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM) the other suspects are Ahmet Boncuk, Ünal Alkan, Abdurrahman Kurga, Ramazan Çetin, Mehmet Salih Kılınçaslan, Mehmet Emin Kurga and İsmet Kandemir.

 

According to the summary the names of the victims are as follows: Yusuf Tunç, Abdulvahap Ateş, Necat Yalçınkaya, Nurettin Yalçınkaya, Kemal Birlik, Zübeyir Birlik, Abdulbaki Birlik, Zeki Alabalık, Mahmut Abak, Mehmet Emin Abak, Memduh Demir and Bedran Kaban.

The lawyer of the Sarısülük family demanded from the court to decline the indictment on the grounds that higher sentences should be envisaged for the suspect on 17 July 2013.

On 17 July 2013 Ankara Heavy Penal Court No. 12 pronounce its verdict against the defendants. Emre Karataş was sentenced to 8 years of imprisonment on charges of “being a member of an illegal organisation” under Article 314 of TPC, Mehmet Salih Erşari, Mehmet Akyar, Erhan Ölçen, İdris Gürmez, Zübeyir Sızıcı, Mehmet Can Temel and Hasan Ertuğrul were sentenced to 9 years of imprisonment each with the same membership charge and Okan Başat was sentenced to 15 years and 8 months of imprisonment and a fine of 2000 TL on charges of having hazardous materials together with membership.

The court adjudicated to postpone the prosecution against the 34 defendants for 3 years basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the Third Judiciary Reform Package on 5 July 2012.

Kemal Aşan who had been released from Erzurum E Type of Closed Prison recently made a public statement on 23 July 2013 and claimed that the guardiands have been beating the prisoners and some of the prisoners’ bones were fractured. Veli Ceylan, Fettah Şener, Siyahmet Şimşek and İsmet Şimşek were subjected to torture.

 

(07/170) Ongoing DHKP/C investigation…

On 3 July 2013 İstanbul Chief Public Deputy Prosecutor Oktay Erdoğan who is responsible from the terror crimes, had approved the indictment against 22 lawyers -9 pre-trial detainees- who had been detained by Fighting with Terror Department police teams in the operation on the Contemporary Lawyers Association in the context of the Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C) on 18 January 2013. On 18 July 2013 İstanbul Heavy Penal Court No. 23 accepted the indictment in which Selçuk Kozağaçlı and Taylan Tanay are charged with executives of the illegal organisation and the other lawyers were charged with being a member of the same organisation.

 

İstanbul Heavy Penal Court No. 23 decided to start hearing the case in the Silivri Prison on 24 December 2013.

On 23 July 2013 Van Heavy Penal Court No. 5 went on hearing the case against three people who had been detained in Van Province in 2012 on charges of “being a member of an illegal organisation” under Article 314 of TPC.

The court released Nesim Acar and adjourned the hearing to 12 November 2013.

On 23 July 2013 Van Heavy Penal Court No. 5 went on hearing the case against 9 students -5 pre-trial detainees- who had been detained in the operation in Bitlis Province in 2012 on charges of “being a member of an illegal organisation” under Article 314 of TPC.

 

The court released Fethi Damar and adjourned the hearing to 17 September 2013.

Ayetullah Ay, a pre-trial detainee in Hacılar (Kırıkkale) F Type of Closed Prison had not been taken to the infirmary although he had health problems in his bowel. I wrote a letter to complain about the issue and his letter was confiscated reported on 24 July 2013.

Hasan Kuluçlu (45) died in the land slide in the coal mine in Keşan District of Edirne Province on 24 July 2013.

Muhammed Cinemre (31) working for a firm that maintains escalators at İstanbul metro stations was killed on Wednesday morning after an escalator started running in İstanbul Province on 24 July 2013.

 

(07/177) Investigation on the murder of Mazlum Akay…

Mazlum Akay (11) had been wounded with the gas bomb canister that was fired in the intervention to the protest in Yüreğir District of Adana Province on 29 July 2012 and he died on 2 August 2012.

 

Adana Chief Public Prosecution Office decided nolle prosequi on the grounds that they could not determine the wounding object (i.e. a canister or not), and the distance between the police vehicles and Mazlum Akay had been 123 metres although the range of the gas bomb rifles are 120 metres, reported on 24 July 2013.

D.E. (13) was wounded with the explosion of the thing he found in an empty field in Kayapınar District of Diyarbakır Province on 24 July 2013

Elçin Avcılar, a trans person was beaten by Tuğrul Selçuk in the Meis Housing Site in which several incidents took place in Avcılar District of İstanbul Province on 23 July 2013.

(07/180) The clashes in Syria…

While the clashes between the al-Nusra Front, a group loosely aligned with al-Qaida and the PYD (the Syrian Democratic Party, which is affiliated with PKK) in Kurdish-controlled territories, three people were shot with the bullets in Ceylanpınar District of Şanlıurfa Province, fired from Serekaniye (Resulayn) Town in Syria on16 July 2013.

Mahsun Ertuğrul (17) died in the hospital and Mehmet Gündüz’s (16) condition was reported as serious.

Ahmet (Mehmet) Gündüz (16) died in the hospital in Ankara Province on 25 July 2013.

Security director A.Y. was wounded with the explosion of the hand grenade that was thrown by unidentified people to the Security Directorate in Silopi District of Şırnak Province on 25 July 2013.

 

(07/182) The investigation on Çayan Birben…

Asthma patient Çayan Birben (31)’s health had been deteriorated after the police officers inflicted teargas on him as they had interfered to a fight in Abdullah Baştürk Park in Yalova Province on 27 May 2012. He had a panic attack and hypertension and died in the Yalova State Hospital on 30 May 2012.

Yalova Penal Court of First Instance No. 3 accepted the indictment against 4 police officers after the report of the Forensic Medicine Institute dated 13 February 2013 that teargas could cause the death of Çayan Birben. The court adjudicated that the police officers should be tried on charges of “causing death with intentionally wounding with an arm” and send the case file to Yalova Heavy Penal Court No. 1 on 26 July 2013.

Sebahattin Taşçı who had argued with the police officers on the grounds that his car was towed away, was detained and beaten in the Cumhuriyet Police Station in Rize Province on 25 July 2013.

Thirteen out of the 32 people who had been detained in home raids on the grounds that they had participated in the Gezi Park actions in Hatay Province on 22 July 2013 were arrested on 25 July 2013.

Ankara Metropolitan Municipality’s fire truck overturned on its way to interfere a fire in Bala District of Ankara Province on 28 July 2013. Firepersons Berkan Güneş and Ömer Arslan died and Onur Baran was wounded in the accident.

Adil Fert from Diyarbakır Province was attacked by a racist group on the grounds that “Kurdistan” was written on his t-shirt in Uşak Bus Terminal as he was going to Kütahya Province to work in a construction site on 25 July 2013.Adil Fer was detained on the grounds that he has smuggled cigarettes.

Emrah Abi a pre-trial detainee in Van F Type of Closed Prison was beaten by the guardians on the grounds that he asked them to turn on the air conditioner in the shuttle as he was returning from the hospital on 25 July 2013. He has been trying to obtain a report from the hospital for his heart problems.

Mesut Çeki, a prisoner in Hacılar (Kırıkkale) F Type of Closed Prison, sent a fax Etkin News Agency but the message was confiscated on the grounds that Ali İsmail Korkmaz was praised reported on 27 July 2013. Korkmaz was killed by a mob during the Gezi Park actions in Eskişehir Province.

(07/197) Actions against the interventions of the government to the fundamental rights and freedoms and the right to the city…

Eight pre-trial detainees -Yener Çıracı, Yadigar Vuruşaner, Taner Aka, Hasan Koç, Yusuf Bahtiyar Özkan, Cihan Ağtaş, Denizcan Aydın and Murat Bozkurt- who had been arrested with 4 others on 28 June 2013 on the grounds that they had participated in the actions in Ankara Province were released with the objection of their lawyers on 26 July 2013.

Nine out of the 11 detainees who had been detained in home raids in Adana Province on 23 July 2013 were arrested on charges of being a member of an illegal organisation on 27 July 2013.

Mehmet Çelik, member of the Socialist Party of the Oppressed (ESP), was wounded during the intervention of the police teams to the arrests in front of the courthouse and he was detained from the hospital on the grounds that he “resisted to the officer on duty”.

Tayip Eber member of the Socialist Re-Establishment Party, was detained on the grounds that there is a warrant of arrest in Adana Bus Terminal on 27 July 2013.

(07/198) Hindered iftar in İstanbul Province…

Police teams hindered the iftar (dinner that breaks the fast during Ramadan) that was organised in Gezi Park by closing the park to the public with barricades in İstanbul Province on 28 July 2013. Three people were detained on the grounds that they had crossed the police barricades.

Satiye Ok, member of Socialist Women Assembly, was detained on the grounds that her conviction became absolute after she had visited her friend in Karataş Prison and then arrested and sent to the same prison in Adana Province on 26 July 2013.

Menduh Kılınç, a cirrhosis patient in Şakran (İzmir) L Type of Closed Prison No. 3 was transferred to Edirne F Type of Closed Prison although he could be only medically treated in İstanbul, Ankara and İzmir Provinces according to his reports, reported on 29 July 2013.

Ten members of the Socialist Party of the Oppressed (ESP) or the Socialist Youth Association (SGD) were detained in the synchronised home raids on the grounds that they had participated in the actions to support the Gezi Park actions in four provinces on 30 July 2013.

(07/202) Arrested juveniles in Şırnak Province…

Democratic Patriotic Youth Movement (YDGM) member A.Ö. (17) was arrested on charges of “being a member of an illegal organisation” under Article 314 of TPC on 29 July 2013. He had been detained on the grounds that he had participated in the protest against the prison conditions of Abdullah Öcalan in Cizre District of Şırnak Province.

(07/203) Arrested juveniles in Şırnak Province…

Four out of the 7 juveniles -R.A. (15), S.E. (17), Y.T. (16) and H.B. (15)- who had been detained in home raids in Silopi District of Şırnak Province on 27 July 2013 were arrested on charges of “opposing to the Law No. 2911 on Meetings and Demonstrations” and resisting police officers on duty on 29 July 2013.

30 July 2013 Van Heavy Penal Court No. 5 went on hearing the case against 12 defendants -117 pre-trial detainees- who had been subjected to the KCK investigation in Yüksekova District of Hakkâri Province on 20 October 2012. The court heard the legal argument of the defendants in Kurdish and prolonged the pre-trial detention period of the defendants till the next hearing on 14 November 2013.

(07/207) Finalised KCK case in Malatya Province…

 

On 30 July 2013 Malatya Heavy Penal Court No. 4 went on hearing the case against 11 defendants -7 pre-trial detainees- who had been subjected to the KCK investigation in Malatya Province on 19 June 2012 and 10 defendants –including the Peace and Democracy Party (BDP) Province Branch Chairperson Gaffar Bayram and Human Rights Association’s (IHD) Malatya Branch executive Hikmet Kapancı had been detained on 22 June 2012.

Eight defendants –including Gaffar Bayram and Hikmet Kapancı- were sentenced to 5 years and 2 months of imprisonment each on charges of “being a member of an illegal organisation” under Article 314 of TPC. Other two defendants Mehmet Toktay and Gökhan İmer were acquitted.

Police teams detained 16 people and the German journalist who was photographing the incident in Gezi Park in İstanbul Province on 30 July 2013. The municipal police confiscated the symbolic grave stones of the 5 people who had been killed in the Gezi Process.

(07/209) Detained people in Şanlıurfa Province…

Mehmet Yılmaz, Fazilet Kaya, Nebi Dağtekin and Murat Dağtekin were detained in Ceylanpınar District of Şanlıurfa Province on 29 July 2013. The detainees were not allowed to meet with their lawyers for 24 hours on the grounds that the investigation is confidential.
