(10/001) Explosion in Mardin Province…

A Syrian was killed and 4 others were killed in the explosion of the landmine as they were trying to crossed the border from the mined field between Qamişlo Province of Syria and Yeni Village of Nusaybin District of Mardin Province on 30 September 2013.

(10/002) Impunity in the torture and harassment case…

Ü.S. had argued with the police officer on trhe grounds that he said “one minute” to the police officer as he asked him his identity card as he was talking with his mobile phone. He was detained, insulted and forced to cavity search in Beyoğlu District of İstanbul Province on 11 February 2011. A case was launched against the police officers Mahmut Atıf Öker, Sefa Çınar, Tuba Çadırcı and Turan Demir which was finalised on 30 September 2013.

 

İstanbul Heavy Penal Court No. 20 acquitted police officers Mahmut Atıf Öker and Tuba Çadırcı. The court sentenced Turan Demir to 3 months of imprisonment on charges of “misconduct in office” and then postponed the sentence. The defendant Sefa Çınar was sentenced to 20 months of imprisonment on charges of “depriving a person from her liberty” and the court postponed the announcement of the sentence due to the good conduct of the defendant in the hearings. Sefa Çınar was acquitted from “insulting” charge and he was sentenced to 6 months of imprisonment on charges of “unauthorised search” the court postponed the announcement of the sentence due to the good conduct of the defendant in the hearings.

(10/003) Ongoing KCK case in Van Province…

On 24 September 2013 Van Heavy Penal Court No. 6 began to hear the case against 16 defendants -15 pre-trial detainees- who had been subjected to KCK investigation in Van Province and its Districts on 26 November 2012 and in the fifth successive session on 30 September 2013 the court prolonged the pre-trial detention period of the defendants to the next hearing on 3 October 2013.

(10/004) The death of the child worker in İstanbul Province…

Nazar Buluş (9) who was trying to earn money by cleaning the windows of the cars that stop in the red light, died after the hit of a car that passed during the red light in Ümraniye District of İstanbul Province on 30 September 2013.

 

02 October 2013 Daily Human Rights Report

(10/005) The investigation on the murder of Ali İsmail Korkmaz by unknown assailants…

Ali İsmail Korkmaz (19) who had been battered by the unidentified people after the protest Eskişehir Province on 3 June 2013 for the Gezi Park, died in the hospital on 10 July 2013.

The indictment against 8 people -5 pre-trial detainees (one of them police officers) and three other police officers- on charges of homicide was presented to be evaluated to Eskişehir Heavy Penal Court No. 2. The prosecutor asked life sentence in solitary confinement and with no possibility of parole against police officer Mevlüt Saldoğan (41).

Eskişehir Heavy Penal Court No. 2 asked Eskişehir Governor Güngör Azim Tuna his opinion whether the province is suitable for the proceedings for security reasons. The Governor ckaimed that Ali İsmail Korkmaz was “wounded in the protest and died in the hospital and marginal and illegal organisations have been using it a propaganda material” and the proceedings should take place in another province on the grounds that the judges and prosecutors could be effected, reported on 1 October 2013.

(10/006) Armed attacks in İstanbul Province…

Hasan Ferit Gedik was wounded in the armed attack on the protest against the drug sellers in Gülsuyu Quarter of Maltepe District of İstanbul Province on 30 September 2013. He died in the hospital and it is claimed that two poliçe officers in plain clothes that introduced themselves as technicians entered the room of Gedik. It is reported on 1 October 2013 that Hasan Ferit Gedik’s clothes were lost.

(10/007) The investigation on Çayan Birben…

Asthma patient Çayan Birben (31)’s health had been deteriorated after the police officers inflicted teargas on him as they had interfered to a fight in Abdullah Baştürk Park in Yalova Province on 27 May 2012. He had a panic attack and hypertension and died in the Yalova State Hospital on 30 May 2012.

Yalova Penal Court of First Instance No. 3 accepted the indictment against 4 police officers after the report of the Forensic Medicine Institute dated 13 February 2013 that teargas could cause the death of Çayan Birben. The court adjudicated that the police officers should be tried on charges of “causing death with intentionally wounding with an arm” and send the case file to Yalova Heavy Penal Court No. 1 on 26 July 2013.

Yalova Heavy Penal Court No. 1 also adjudicated the lack of subject matter and The Supreme Court of Appeal’s Chief Public Prosecution Office will decide which court will hear the case reported on 1 October 2013.

(10/008) The case on the excessive use of force by law enforcement officers…

Ferhat Özcan (24) was beaten by police officer Hakan Özdemir due to the quarrel on the parking lot in Şirinevler Quarter of Bahçelievler District of İstanbul Province on 11 August 2013 and Özcan had a cerebral operation, reported on 5 September 2012.

Hakan Özdemir had claimed in his testimony in the prosecutor’s office that “Ferhat Özcan had pushed me and made me fell down and then punched me. He also attempted to take my firearm that I dropped and threatened me with death and I could only hit him once and he hit his head to somewhere that I do not remember. Maybe to the pavement… I did not hit him with my firearm”.

Bakırköy Heavy Penal Court No. 14 began to hear the case against Hakan Özdemir, his father and someone from his hometown on 1 October 2013. The court heard both sides and adjourned the hearing to 20 January 2013.

(10/009) Person proposed to be an agent…

Socialist Party of the Oppresseds’ (ESP) Malatya Province Branch made a public statement and claimed that police teams proposed ESP member Yasin Taşkın to be an agent in Malatya Province on 1 October 2013.

(10/010) Coercion in prison…

Twelve out of the 18 prisoners who had been run away from Bingöl M Type of Closed Prison and caught the day after their escape were transferred to Sincan (Ankara) F Type of Closed Prison and subjected to cavity search against their will. They were beaten on the grounds that they objected on 1 October 2013.

(10/011) Coercion in prison…

Lawyers Rezan Sarıca, Cengiz Yürekli and Mazlum Dinç were not allowed to visit their client Abdullah Öcalan on 1 October 2013 on grounds that the ship that would carry them to İmralı Island was out of order.

(10/012) Hindered funeral in İstanbul Province…

Police teams interfered to the group that would like to take the casket of Hasan Ferit Gedik to Gülsuyu Quarter after the ceremony in Küçük Armutlu Quarter on 1 October 2013.

(10/013) Tried people…

On 1 October 2013 İzmir Penal Court of First Instance No. 7 began to hear the case against 50 students who had been detained in the protest against the Higher Education Council/Yükseköğretim Kurumu (YÖK) in the anniversary of its foundation in Ege University on 6 November 2012. After checking of the IDs of the defendants the court adjourned the hearing to 28 November 2013 to finalise the checking of IDs.

(10/013) Arrested people in Diyarbakır …

Five people who had been detained in synchronised home raids of the Fighting with Terrorism Department teams in Diyarbakır 30 September 2013 were arrested on charges of “being a member of an illegal organisation” under Article 314 of TPC and “having explosives” on 1 October 2013.

(10/015) Ongoing KCK case in Van Province…

On 1 October 2013 Van Heavy Penal Court No. 5 went on hearing the case against 13 defendants –7 pre-trial detainees- in connection with the KCK investigation in Erciş District of Van Province on 15 May 2012. The court heard the legal arguments of the defendants in Kurdish and released all the pre-trial detainees.

(10/017) Explosion in Mardin Province…

A citizen of Syria died in the explosion of a landmine as three people attempted to cross the border from the vicinity of Gürsel Border Headquarters in Kızıltepe District of Mardin Province on 1 October 2013..

(10/018) The investigation on the murder by unknown assailants/Mecit Baskın…

First investigation on the murders by unknown assailants in Ankara Province in 1990s –including the murder of Altındağ Population Director Mecit Baskın on 30 September 1999- was finalised on 20 September 2013.

The indictment, which was finalised just ten days before the time limitation of the murder of Mecit Baskın by the Ankara Chief Public Prosecution Office (Authorised by the Article 10 of the ATL), is againt 12 suspects -including Mehmet Ağar, Korkut Eken as first and second suspects. Other suspects are former special task force police officers, İbrahim Şahin, Ercan Ersoy, Ayhan Çarkın, Ziya Bandırmalıoğlu, Ayhan Akça, Seyfettin Lap, Alper Tekdemir, Uğur Şahin, Ayhan Özkan and Ahmet Demirel. The prosecutor demanded life sentence in solitary confinement and with no possibility of parole against all suspects.

Ankara Heavy Penal Court No. 13 accepted the indictment against 12 defendants on 2 October 2013.

(10/019) Violence in rehabilitation centre…

İ.E. (29) a down syndrome patient, was beaten and dragged on the floor by teacher Fatih K., the husband of the owner of the rehabilitation centre in Beyşehir District of Konya Province reported on 2 October 2013.

(10/020) Ongoing KCK Case in Diyarbakır Province…

On 2 October 2013 Diyarbakır Heavy Penal Court No. 5 went on hearing the case against 95 defendants -31 pre-trial detainees including BDP Bağlar District Chairperson Ali Yüce and Diyarbakır Metropolitan Municipality assembly member Abdulkadir Göktumur- who had been subjected to Koma Ciwaken Kurdistan-Kurdistan Communities League /Assembly of Turkey (KCK/TM), the KCK is allegedly intended to organize the Kurdish people as an umbrella organization that includes Kurdistan Workers Party (PKK) investigation in Diyarbakır Province on 22 November 2011.

The court released DTK Permanent Assembly member Çimen Altürk and adjourned the hearing to 25 December 2013.

(10/021) Ongoing KCK Case in Şırnak Province…

On 2 October 2013 Diyarbakır Heavy Penal Court No. 7 went on hearing the case against 85 defendants -32 pre-trial detainees who had been subjected to KCK investigation in Cizre District of Şırnak Province.

The court prolonged the pre-trial detention period of the defendants and adjourned the hearing to 23 December 2013.

(10/022) Home raids in Antalya Province…

The Revolutionary Workers Party/Devrimci İşçi Partisi member Mustafa Cihan Yılmaz and the Socialist Youth Association/Sosyalist Gençlik Derneği member Ali Karakuş, were detained on the grounds that they had participated in the solidarity actions for the Gezi Park action in Antalya Province on 2 October 2013.

 

04 October 2013 Daily Human Rights Report

(10/023) The case on the murder of Hrant Dink …

Col. Ali Öz — who was sentenced to six months of imprisonment on charges of neglect by omission in the 2007 murder of Hrant Dink, editor-in-chief of the Turkish-Armenian weekly Agos — is being retried as a local court in İstanbul has asked for a merger of Öz’s case with Dink’s murder case.

A case was filed against seven soldiers and Öz, who was the commander of the Trabzon Gendarmerie Battalion at the time when Dink’s killers were conspiring to murder him, on charges of “neglecting duty and forging documents,” at the Trabzon Penal Court of Peace No. 2.

Another case was also filed against Öz at the Trabzon Heavy Penal Court No. 1 with the same accusations, but the Heavy Penal Court didn’t accept the case on the grounds that two cases could not charge a suspect with the same crime.

At the request of the Dink family, the Supreme Court of Appeal’s Penal Chamber No. 5 decided to have the colonel’s retrial at the Trabzon Heavy Penal Court No. 1. The court demanded the merging of the case with Dink’s murder case in İstanbul and postponed the court proceedings.

(10/024) Intervention to the workers’ protest in İstanbul Province…

Police teams interfered to the tent of the Beltaş workers who have abeen struggling for their trade union rights in front of Beşiktaş Municipality and detained 4 workers in İstanbul Province on 3 October 2013.

(10/025) Home raids in Mersin Province…

Three people were detained in synchronised home raids of the Fighting with Terrorism Department teams on the grounds that they had participated in the solidarity action for Gezi Park protests in Mersin Province on 3 October 2013.

(10/026) Home raids in Antalya Province…

Ayşe Deniz Karacagil, was detained as she was waiting for her bus in front of Karatay High School in Antalya Province on 3 October 2013 on the grounds that she had participated in the solidarity action for Gezi Park protests.

(10/027) Ongoing KCK Case in Van Province…

On 3 October 2013 Van Heavy Penal Court No. 6 went on hearing the case against 16 defendants -15 pre-trial detainees- and had been detained in synchronised home raids of the Fighting with Terrorism Department teams in the framework of the KCK investigation in Van Province and its districts on 26 November 2012.

The court heard the legal arguments in Kurdish and released Semira Varlı, Fevziye Şiran, Adil Adıyaman, Yakup Ataş, Senar Erter, Meral Güngör and Selahattin Bozkurt. The hearing was adjourned to 22 November 2013.

(10/028) Ongoing MLKP Case…

On 3 October 2013 İstanbul Heavy Penal Court No. 22 went on hearing the case against 12 defendants -7 pre-trial detainees, Ersin Sedefoğlu, Görgü Demirpençe, Gökben Keskin, Özlem Cihan, Fırat Şeran, Ali Haydar Keleş ve Ali Gülmez- who had been detained in the raid on the Atılım Newspaper and the Socialist Party of the Oppressed (ESP) in the context of the Marxist Leninist Communist Party (MLKP) operation that was conducted from Province on 21 June 2012 on charges of “being a member and executive of an illegal organisation” under Article 314 of TPC

The court heard the confidential witness and prolonged the pre-trial detention period of the defendants till the next hearing on 4 March 2013.

(10/029) Ongoing KCK Case in İstanbul Province…

On 3 October 2013 İstanbul Heavy Penal Court No. 16 went on hearing the case against 30 defendants -17 pre-trial detainees- Who had been members of the Demokratik Yurtsever Gençlik (DYG) and had been detained in synchronised home raids of the Fighting with Terrorism Department teams in the framework of the KCK investigation in İstanbul Province in May 2011 on charges of “being a member of an illegal organisation” under Article 314 of TPC.

The court heard the legal arguments in Kurdish and acquitted all the defendants.

(10/030) Work accident in Manisa Province…

Ali Çetinkaya (29) died in the accident in a private coal mine in Soma District of Manisa Province on 3 October 2013.

(10/031) Extra-judicial killing in İstanbul Province…

Veysel Albayrak was killed and Tatiana Dinçer wounded from her leg on the grounds that the driver, Veysel Albayrak did not obey the stop warning with his car and attempted to run away from the opposite direction in Kartal District of İstanbul Province on 5 October 2013.

(10/032) Investigation on the murder of Abdullah Cömert…

Abdullah Cömert’s (22) final autopsy report showed that gas bomb canister caused his death, revealed on 5 October 2013. Abdullah Cömert was killed in the solidarity demonstration for Gezi Park in Hatay Province on 3 June 2013.

The report of the Forensic Medicine Institute, referring to the report of the Gendarmerie, stated that “the demise of Abdullah Cömert took place due to the skull fractures, cerebral haemorrhage and brain tissue destruction after the hit of gas bomb canister”.

(10/033) Violence in middle school…

Ali Çetinkaya Middle School student, inarticulate C.S. (13), was beaten by vice director and two teachers on the grounds that he caused the ping-pong table collapse in Ayvalık District of Balıkesir Province reported on 4 October 2013.

(10/034) Person proposed to be an agent…

Hüseyin Yamaç was threatened to tell the things he know by police officers after the public statement of the Peace and Democracy Party (BDP) in Nazımiye District of Tunceli Province on 4 October 2013

(10/035) Person proposed to be an agent…

BDP youth Assembly member Murat Şahin stated in his public statement that two people took him to the bank of Euphrates river and threatened to be an agent by saying otherwise “a bullet would bounce and find him” in Birecik District of Şanlıurfa Province on 4 October 2013.

(10/036) Ongoing case on torture and ill-treatment in detention…

The police officers who assaulted Fevziye Cengiz at İzmir Karabağlar Police Station were on trial and İzmir Penal Court of First Instance No. 12 decreed “the police officers have to be on trial by the crime of torture” and sent the court file to High Criminal Court. Lawyer Hanife Yıldırım talked to bianet: “It was so clear that there was the crime of torture. Our demand was going to High Criminal Court since the beginning of the trial process. We’re happy as the court also accepted this.”

At the hearing on February 15th, police officers were on trial by “simple assault” in İzmir Penal Court of Peace No. 17 and the court decreed “lack of jurisdiction” as there’s also the crime of threat and sent the court file to Penal Court of First Instance No. 12. “Decision of lack of jurisdiction is right, however its excuse is wrong. This file has to be sent to High Criminal Court” said Lawyer Yıldırım to bianet.

Fevziye Cengiz was enjoying at a night club on July 16, 2011 in İzmir and she was taken into custody as she didn’t have her identity card with her. She was tortured by police officers at Karabağlar Police Station.

After the incident, Cengiz went to prosecutor’s office in the morning and filed a criminal complaint. Hereupon, the police officers lodged a complaint against her by “She’d insulted us” accusation.

As the images of the incident were appeared on media, civil polices Hakan Yörük and Beyit Sezgin who tortured Cengiz and a police officer from Karabağlar Police Station who watched that moment were all suspended on December 9, 2011.

A lawsuit was filed against the police officers with a sentence of up to 5 years 9 months of imprisonment whereas a lawsuit was filed against Cengiz with a sentence of up to 6.5 years of imprisonment.

On February 2nd, the administrative inquiry of the police officers was completed. They were sentenced to demotion that was around 13 Euro (TL 30) per month. No disciplinary penalty was given to the police officers.

At the hearing on February 15th, police officers were on trial by “simple assault” in İzmir 17. Criminal Court of Peace and the court decreed “lack of jurisdiction” as there’s also the crime of threat and sent the court file to Penal Court of First Instance No. 12. The expert report was ready on April and it clarified that Cengiz was tortured.

On 4 October 2013 İzmir Heavy Penal Court No. 6 went on hearing the case against four police officers and the court declined the demand to merge the case with the case in İzmir Penal Court of First Instance No. 9 on obscuring the evidences. The court adjourned the hearing to 29 November 2013 to watch the footage together with both sides and hearing the witnesses.

(10/037) Coercion in prison…

Engin Salkım was taken from his ward and put into a solitary confinement which was wet, dark and with a broken window in Kepsut (Balıkesir) L Type of Closed Prison on 28 September 2013 and he was beaten by the guardians reported on 2 October 2013.

(10/038) Coercion in prison…

A person who had effected from the smoke was hospitalised after the riot of the prisoners by burning their beds in Manisa E Type of Closed Prison 4 October 2013.

(10/039) Coercion in prison…

Mensur Tekin a prisoner in Giresun E Type of Closed Prison, asked to be transferred to Diyarbakır Province due to the tumour in his brain and his demand was declined due to the security reasons revealed with the letter of his friend Mehmet Kaya reported on 6 October 2013.

(10/040) Fine due to posters…

Twenty-two members of the Eğitim-Sen, BDP and Kürdi-Der were sentenced to a fine of 1500 TL each due to the posters for “education in mother tongue” in accordance with the Law of Misdemeanour in Batman Province reported on 4 October 2013.

(10/041) Tried writer…

A case was launched against writer Emrah Serbes in connection with his remarks on Prime Minister, Minister of Interior Affairs and İstanbul Governor due to the interventions in 1 May on charges of “insulting a public officer due to the performance of his public duty” under Article 125 of TPC reported on 4 October 2013.

His punny phrase “Recep Tazyik [literarily “pressured” referring the water cannons used in the interventions, actually Tayyip] Erdoğan” is one of the reasons of the case. İstanbul Penal Court of Peace No. 18 will begin to hear the case.

(10/042) Convicted juveniles…

On 26 September 2013 Giresun Penal Court of Peace No. 1 sentenced 3 juveniles to 235 days of imprisonment and other 4 juveniles to 235 days of imprisonment for each of the actions in connection with the two demenostrations to demand the free education organised by High School Youth Hope/Liseli Genç Umut in Giresun Province in 2013 on charges of “insulting a public officer due to the performance of his public duty -Prime Minister” under Article 125 of TPC.

The sentences were commuted to 4700TL and 9400Tl respectively.

(10/043) Home raids in Antalya Province…

The Revolutionary Workers Party/Devrimci İşçi Partisi member Mustafa Cihan Yılmaz and the Socialist Youth Association/Sosyalist Gençlik Derneği member Murat Sezgin ile Ayşe Deniz Karacagiller, were arrested on charges of “being a member of an illegal organisation” under Article 314 of TPC and “harming public goods” on 4 October 2013.

They had been detained with three others on the grounds that they had participated in the solidarity actions for the Gezi Park action in Antalya Province on 2 October 2013.

Police teams interfered to the tent of the Beltaş workers who have been struggling for their trade union rights in front of Beşiktaş Municipality and detained 5 workers in İstanbul Province on 4 October 2013.

(10/045) Attack on the protest in İstanbul Province …

Hasan Ferit Gedik had been killed by drug sellers in Gülsuyu Quarter of Maltepe District of İstanbul Province on 30 September 2013. Police teams interfered to the protest against the murder of Hasan Ferit Gedik on 6 October 2013 and Yürüyüş Magazine’s reporter Cengiz Karakaş was wounded with the hit of the gas bomb canister from his chest.

(10/046) Raid on profession’s chamber…

Ankara 4 October 2013

The Chamber of Architects’ Ankara Brach’s depot in İncesu Street was raided by police teams on the grounds that the publications of the chamber are “without banderols” and they confiscated 2 copies each of the 44 different publications. 18.000 books and 7500 CDs were sequestrated until the end of the investigation.

(10/047) Ongoing MLKP Case…

On 4 October 2013 İstanbul Heavy Penal Court No. 11 went on hearing the case against Özkan Gerçek and Ömer Adıgüzel in connection with the incident in Avcılar District of İstanbul Province on 8 November 2009 (They had quarrelled with police teams and did not obey stop warning and wounded with police fire and had been detained without proper medical care) on charges of being a member of -Marxist Leninist Communist Party (MLKP)”.

The court sentenced the two defendants to life sentence in solitary confinement and with no possibility of parole each on charges of “attempting to change the constitutional order” and to 40 years of imprisonment each on charges of “wounding officer with firearm”, ““being a member of an illegal organisation” under Article 314 of TPC and “having firearms without licence”

(10/048) Tried people…

Sixty-one people had been detained in the operation against Democratic Rights Federation/Demokratik Haklar Federasyonu in Tunceli, Ankara, İzmir, Sivas, İstanbul, Uşak, Mersin, Adana, Antalya, Zonguldak, Çanakkale and Isparta Provinces on 13 November 2012 and 31 out of the 61 detainees had been arrested on 17 November 2012 and the court adjudicated confidentiality on the case.

İzmir Heavy Penal Court No. 12 began to hear the case against 17 people -13 pre-trial detainees who hasd been detained in İzmir Province on charges of “being a member of an illegal organisation -Maoist Communist Party” under Article 314 of TPC on 4 October 2013.

The court checked the IDs of the defendants and evidences before adjourning the hearing.

(10/049) Armed attack in İstanbul Province…

Hasan Ferit Gedik had been killed by drug sellers in Gülsuyu Quarter of Maltepe District of İstanbul Province on 30 September 2013. M.K. who had been detained after the murder, allegedly confessed the murder. M.K. and other 13 people who had been detained with him were arrested reported on 4 October 2013.

(10/050) Attack on the magazine distributors in İstanbul Province…

İlyas Argun and Ali Ekber Durgun, the distributors of Bağımsızlık Demokrasi Sosyalizm için Yürüyüş Magazine were beaten by two persons who introduced themselves as police officers in Gülsuyu Quarter of Maltepe District of İstanbul Province on 5 October 2013.

(10/051) Detained people in Diyarbakır Province…

Police teams stopped the bus of the students who were travelling to Lice District with the organisation of Dicle University’s (Diyarbakır) Free Student Association (DÜÖ-DER) on 5 October 2013 and detained 14 students and DİHA reporter Sabriye Duman.

(10/052) Detained Mayor…

Mayor Osman Sidar Balveren Municipality in Şırnak Province on was detained in home raid by police teams on 4 October 2013.

(10/053) Diyarbakır Şüpheli Asker Ölümü…

Halil İbrahim Şahin (20) was allegedly committed suicide with his infantry rifle G-3 during his patrol in Fazıl Bige Garrison, 15 kilometres outside of Diyarbakır Province on 5 October 2013.

(10/054) Work accident in Van Province

Seyhan Aksarı (29) died and 2 other works were wounded during the landslide in the construction of the infrastructure in Van Province on 6 October 2013.

 

08 October 2013 Daily Human Rights Report

(10/055) Ongoing extra-judicial killing case in Van Province…

Soldiers had raided on Buğulukaynak (Kel) Village of Çaldıran District of Van Province on 6 October 2009 and had killed unarmed HPG militants Sunullah Keserci, Necmeddin Ahmed Hasan and İbrahim Atabay (18) who had been living in the village. Former Minister of Interior Affairs Beşir Atalay had claimed that they had been killed in the clash.

With the official complaint of the soldiers who had participated in the murder, Erciş Chief Public Prosecution Office had called 18 soldiers to give their testimonies and all of them, except former Van Province Gendarmerie Regiment Commander retired Colonel Vecihi Halil İyigün, were released on 24 May 2012.

In the indictment the prosecutor had asked three times life sentence in solitary confinement and with no possibility of parole for each of the 18 defendants.

Erciş Heavy Penal Court accepted the indictment against 18 soldiers but the case was transferred to Ankara due to security reasons.

On 7 October 2013 Ankara Heavy Penal Court No. 6 adjudicated to release the only pre-trial detainee retired Colonel Vecihi Halil İyigün. The hearing was adjourned to 25 November 2013.

(10/056) Murder by unknown assailants’ case launched in Mardin Province…

Mardin Chief Public Prosecution Office had finalised the indictment against Ankara Gendarmerie Regional Commander Musa Çitil in connection with 13 murders by unknown assailants as he had been Derik (Mardin) District Gendarmerie Commander reported on 9 September 2012. The case against Musa Çitil was sent to Çorum Province due to security reasons.

On 7 October 2013 Çorum Heavy Penal Court No. 2 went on hearing the case and Musa Çitil participated in the hearing. He did not accept the allegations in the case file and argued that he does not know anything about the Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM). The court declined the demands of the lawyers of the intervening party for the detention of Çitil and adjourned the hearing.

(10/057) The case on the murder of Musa Anter…

A suspect accused of murdering Musa Anter, a prominent Kurdish author, was arrested yesterday by a court in the south-eastern province of Diyarbakır.

Hamit Yıldırım, who was detained in the south-eastern province of Şırnak on June 29, some 20 years after the murder took place, denied all accusations in his interrogation in court. The court cited strong suspicion of offense in its arrest ruling. Anter was killed in an armed attack in 1992. The prime suspect, Yıldırım, was photographed recently for the first time in Şırnak by daily Sabah. The murder case, which would have been dropped in three months due to the statute of limitations, has been extended for 10 more years due to the new development.

Hamit Yıldırım, a member of Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM), was arrested by Diyarbakır Heavy Penal Court No. 7 on 2 July 2012.

Diyarbakır Chief Public Prosecution Office launched an indictment against 4 people -including Hamit Yıldırım- reported on 27 June 2013. The indictment was sent to Diyarbakır Heavy Penal Court No. 7 in order to be evaluated and the prosecutor asked for life sentence in solitary confinement and with no possibility of parole to 20 years of imprisonment for the defendants Hamit Yıldırım, Mahmut Yıldırım, Abdülkadir Aygan and retired colonel Savaş Gevrekçi. The court had accepted the indictment on 5 July 2013

Diyarbakır Heavy Penal Court No. 7 went on hearing the case against on 7 October 2013. The Turkish General Staff had sent the list of the personnel list of the Intelligence Group Command which was established at that time under the condition of not to be revealed. The court adjudicated ban of publication for list and adjourned the hearing to 2 December 2013.

The prosecution office who has been working on the investigation on eleven villagers who had been subjected to forced disappearance in detention after they had been detained in Alacakaya Village of Kulp District of Diyarbakır Province on 9 October 1993 since 2006 called the former brigade commander Yavuz Ertürk to be interrogated just two days before the end of time limitation. By taking the legal argument of the suspect the prosecutor stopped the time limitation on 7 October 2013.

The lawyers could meet with their clients 24 hours restriction and stated that only sugar powder was given to their clients and they could not buy even water.

(10/066) The investigation on the murder of Süleyman Yeter with torture…

The deputy commissariat Ahmet Okuducu who has been the perpetrator of the murder of Süleyman Yeter with torture was detained in Samsun Province and arrested on 12 June 2013. Süleyman Yeter had been detained in the framework of the MLKP investigation in İstanbul Province on 4 Nisan 1999 and killed with torture on 7 Nisan 1999. The prosecutor had asked the court to sentence the defendant with “homicide with torture in order to make the person confess his/her crimes” under 452/1 of the former TPC (number 765).

İstanbul Heavy Penal Court No. 6 went on hearing the case against Ahmet Okuducu; his lawyer declined the report of the Forensic Medicine Institute and asked for a private report. The hearing was adjourned to 22 October 2013 to evaluate the demand despite the objection of the prosecutor.

Melek Serin had been detained on charges of “helping and harbouring an illegal organisation Revolutionary People’s Liberation Party/Front -Devrimci Halk Kurtuluş Parti/Cephesi (DHKP/C)” under Article 220/7 in Çorum Province in November 2004 and she was tortured during her detention. The 12 gendarmerie intelligence staff and the forensic medicine doctor who had been tried on charges of torture, acquitted in 2006. The Supreme Court of Appeal crashed the verdict. On 10 October 2013 Çorum Heavy Penal Court No. 1 began to hear the case again and sentences the staff -S.K., B.İ., A.T., B.D., M.Y., O.B., Ö.Y., M.Ç., K.G., N.K. and N.T.- to 20 months of imprisonment on charges of “ill-treatment” and the postponed the pronouncement of the sentences. Prime Minister Recep Tayyip Erdoğan, who came to Ortadoğu Teknik Universitesi (ODTÜ)/Middle East Technical University (METU) with 105 guards, 3600 police officers, 20 armoured vehicles and 8 vehicles to interfere social incidents (TOMA) to watch the Göktürk-2 satellite’s launch from China, was protested by the students on 18 December 2012. Police teams interfered to the students with pressured water and gas bombs. Two students -Barış Barışık was seriously wounded with the hit of the gas bomb canister- were wounded and 45 students were detained.

Sait Gündoğdu (50, from Karlıova District of Bingöl Province) worked in a jean grinding factory in Güngören District of İstanbul Province on between 1999 and 2004 and became Silicosis patient [(previously miner’s phthisis, grinder’s asthma, potter’s rot and other occupation-related names) is a form of occupational lung disease caused by inhalation of crystalline silica dust, and is marked by inflammation and scarring in the form of nodular lesions in the upper lobes of the lungs]. He had been medically treated in Elazığ Training and Survey Hospital and he died on 7 October 2013. With the death of Sait Gündoğdu, the death toll in Karlıova District became 9 and all over Turkey 54 due to Silicosis.

Istanbul Heavy Penal Court No. 15 had released Writer Ragıp Zarakolu, Muhsin Yenisöz, Irfan Hülakü, Lütfü Balbal, Ali Geritli, Songül Karatagna, Nahit Onat, Zeynal Çelik, Neci Elmas, Burhanettin Toprak, Ismail Zeybek, Evrim Öztürk, Yasin Yalçın, Cemalettin Görbegir, Alaattin Güneş on the grounds that the probability that the qualification of the charges could be change and the conditions of the evidences as well as taking the period of time spent in prison as pre-trial detainees.

The court released Ahmet Ece, Ahmet Yılmaz, Kerim Taştan and Mustafa Polat after hearing the arguments of the defendants and adjourned to 7 November 2013. The hearings will be successive till 22 November 2013.

On 10 October 2013 Istanbul Heavy Penal Court No. 23 began to hear the case against 30 defendants – 18 of them pre-trial detainees- who had been subjected to the DHKP/C operation in the morning of 18 January 2013 on charges of “being a member of an illegal organisation” under Article 314 of TPC, “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law.

Yurt Newspaper’s reporter Sami Menteş and Tavır Magazine’s editor-in-chief Gamze Keşkek were among the defendants the court adjourned the hearing to 11 October 2013 to finalise the legal arguments.

On 11 October 2013 the court released Sami Menteş, Cemil Onur Çelikdağ, DuyguYücel, Ulaş Doğan and Tahsin Sağtıcı and adjourned the hearing.

Diyarbakır Heavy Penal Court No. 6 has been going on hearing the case against 175 defendants -96 of them are pre-trial detainees, 19 fugitives- who had been detained in the Koma Ciwaken Kurdistan-Kurdistan Communities League /Assembly of Turkey (KCK/TM), the KCK is the intend to organize the Kurdish people as an umbrella organization that includes Kurdistan Workers Party (PKK), operations on 14 April, 11 and 17 June and 25 December 2009 on charges of “constituting an illegal structure and acting in the context of it” since 16 September 2013.

On 11 October 2013 the court heard the defendants and the presentation of the evidences and prolonged the pre-trial detention period before adjourning the hearing to 13 January 2014.

Fourteen people had been killed in the incident in Lice District of Diyarbakır Province on 22 October 1993. Gendarmerie Regional Commander General Bahtiyar Aydın had gone to the district to evaluate the situation in the place of incident and killed allegedly with a “stray bullet” fired by “terrorists”. A tape of Ayhan Esen, a staff of Antalya Gendarmerie Command revealed out that he had been killed in connection with inner clash inside the army. A day before the limitation of time the investigation was relaunched reported on 21 October 2013.

Mehmet Eliveren (19) and Yılmaz Eliveren (17) had been killed by special task force police officers on the grounds that they had been “PKK militants attempted to invade the district” in Genç District of Bingöl Province on 17 April 1999. Bayram Yıldız (19) had been released from Osmaniye T Type of Closed Prison in May 2013. He had been detained on the grounds that a warrant had been issued against him in Mersin Province on 21 October 2013 and sent to Adana. Makbule Yıldız who attempted to learn the condition of her brother stated that her brother was beaten and his head was bleeding.

(10/150) Ongoing case on torture and ill-treatment in detention…

Ş.M. had been stabbed and in a fight and in Üsküdar District of İstanbul Province in 2011 and sent to the police station from the hospital (Haydarpaşa Numune Eğitim ve Araştırma Hastanesi) on the grounds that he had stabbed another person. He alleged began to run away from the station and police vehicle hit him to stop ans he was detained again.

Ş.M. learned that Forensic Medicine Institute prepared a report that claims the bruises in his body “caused by the fight” as he was transferred to the prosecutor’s office.

after the incident Ş.M. claimed that he was tortured in the station, İstanbul Bar Association’s “The Board to Combat Torture and Ill-Treatment” provided a lawyer and a case was lounched in Anadolu Penal Court of Peace No. 20 against police officer M.T. on charges of “simple wounding”.

The head of the court noticed the huge differences between the two reports (given by the hospital and the institute) and the correlation between the report and the victim’s narration of the incident and asked for the footage of the cameras in the station.

The footage was not sent to court and the judge consider this as an evidence that supports the torture allegations and adjudicated to lack of subject-matter jurisdiction and send the case to Heavy Penal Court on the grounds that the incident could amount to torture under Article 94 of the TPC, reported on 22 October 2013.

On 21 October 2013 Samsun Heavy Penal Court No. 3 began to hear the case against serviceman Utku Kalı who had allegedly leaked the intelligence information on the bomb attack that killed 53 people in Reyhanlı District of Hatah Province. Utku Kalı who have been medically treated in the army hospital due to torture in detention and in prison was not brought to court on the grounds that “the correspondence was not finalised” yet.

The court jury declined the demands of the lawyers of Utku Kalı, and adjourned the hearing to get the legal argument of the defendant on 11 November 2013.

(10/155) Lice Massacre and the case on the murder of Bahtiyar Aydın…

The prosecutor asked for life sentence in solitary confinement and with no possibility of parole for both of the defendants, retired Colonel Eşref Hatipoğlu and former Senior Lieutenant Tünay Yanardağ. Diyarbakır Heavy Penal Court No. 8 will begin to hear the case the days to come.

(10/156) The investigation on the murder of Süleyman Yeter with torture…

The deputy commissariat Ahmet Okuducu who has been the perpetrator of the murder of Süleyman Yeter with torture was detained in Samsun Province and arrested on 12 June 2013. Süleyman Yeter had been detained in the framework of the MLKP investigation in Istanbul Province on 4 Nisan 1999 and killed with torture on 7 Nisan 1999. The prosecutor had asked the court to sentence the defendant with “homicide with torture in order to make the person confess his/her crimes” under 452/1 of the former TPC (number 765).

On 22 October 2013 Istanbul Heavy Penal Court No. 6 sentenced Ahmet Okuducu to 15 years of imprisonment on charges of “murder with torture”. Then commuted the sentence to 10 years on the grounds that the perpetrators were 4 people and the real perpetrator could not be identified.

(10/166) Exhumation of the mass grave in Şırnak Province…

Four villager, Mehmet Özkan (60), Mehmet Kaya (56), Şerif Ekin (20) and Abdulselam Demir (26), who had been detained on the grounds that they had been harbouring militants of illegal organisation and three PKK militants who Ids could not be determined from Bana (Ormaniçi) Village of Güçlükonak District of Şırnak Province on 4 June 1994. None knows their whereabouts since then. On 23 October 2013 with the application of the families Cizre Chief Public Prosecution Office decided to exhume the mass grave inside the village cemetery.

Four bodies that were rolled with blankets were found. The body recognised with the help of the clothes that he was wearing as Mehmet Özkan has 16 bullets and the other one Mehmet Kaya’s 18 bullets on it.

The remnants were sent to İstanbul Forensic Medicine Institute to be evaluated.

Salih Kaçmaz (36), (from Diyarbakır Province) a truck driver who came to Bayat Village of Bor District of Niğde Province on 23 October 2013 was shot death by R.K. on the grounds that he was listening Kurdish music in his vehicle.

(10/168) Bomb attack in Hatay Province…

Fifty-three people were killed and 130 people were wounded in the bomb attack in Reyhanlı District of Hatay Province on 11 May 2013. The investigation on the incident against 33 defendants -2 Syrians- was finalised on 23 October 2013.

Adana Prosecutor (Authorised by the Article 10 of the ATL) asked 53 times life sentence in solitary confinement and with no possibility of parole and 130 times 22 years of imprisonment for each of the 19 defendants on charges of homicide and “disrupting the unity and integrity of the state”.

For 14 defendants the prosecutor asked 15 years of imprisonment each on charges of “helping and harbouring an illegal organisation” under Article 220/7 and “being a member of an illegal organisation” under Article 314 of TPC.

Forty-six prisoners in Kayseri Closed Prison were beaten by the prison administration and the guardians and they were transferred to other prisons against their will on 20 October 2013 reported on 23 October 2013. The families of the prisoners gathered in front of the entrance protested the incident.

Sami Hoştan had been a defendant in the Ergenekon case and sentenced to ten years. He had been arrested from another operation and reportedly had liver metastasis and he has medically treated in Edirne Medicine Faculty Oncology Department on 23 October 2013.

Four gendarmerie soldiers have been accompanying him in the hospital in last 28 days and his family applied for his release to İstanbul Heavy Penal Court No. 23.

The prosecutor who has been working on the investigation on 11 villager who had been subjected to forced disappearance after they had been detained from their village, Alacakaya Village of Kulp District of Diyarbakır Province on 9 October 1993, finalised the indictment on 24 October 2013.

Diyarbakır Heavy Penal Court No. 7 accepted the indictment and will be hearing the case soon. The prosecutor asked 11 times life sentence in solitary confinement and with no possibility of parole and 25 years of imprisonment for Yavuz Ertürk, Bolu 2nd Commando Brigade former Commander retired Major General.

Onur Eren Yıldız who had been playing with his niece with toy explosives was detained by the police officers and he later claimed that he was tortured in Beyoğlu District of İstanbul Province on 16 October 2013. Officers sprayed tear gas, his hands were cuffed and he made to lay on the floor and officers stepped on his throat and knees.

A.U. who had been detained and taken to Doğancılar Police Station in Üsküdar District of İstanbul Province in 2011 forced to cavity search. On 24 October 2013 Anadolu Penal Court of Peace No. 18 finalised the case against male police officer M.G. and female police officer İ.T. The court sentenced M.G. to 6 months of imprisonment and to a fine of 3000 TL and acquitted İ.T. due to lack of evidence.

Beyoğlu Municipality had been planning to demolish Emek Cinema (opened: 1924) and the building it is in (building: 1884) on Yeşilçam Street İstiklal Boulevard of İstanbul Province. Police teams interfered to the protesting group against the demolition of Emek cinemas with spraying gas and pressured water. Four people -Hazar Berk Büyüktunca, Özgür İpek, Mehmet Ferit Aka and Berke Göl- had been arrested in the incident on 7 April 2013. An indictment was prepared against the four protestors on charges of “opposing to the Law No. 2911 on Meetings and Demonstrations” and “resisting public officers due to his duty” on 19 April 2013. The prosecutor asked their imprisonment up to 6 years each.

On 24 October 2013 İstanbul Penal Court of First Instance No. 31 went on hearing the case against four demonstrators and acquitted them on the grounds that demonstration is a constitutional right.

(10/182) The case on the 12 September 1980 coup d’état…

A public prosecutor overseeing the investigation into the bloody has asked the court hearing the case to hand down sentences of life imprisonment without the possibility of parole for the leaders of the coup, Gen. Kenan Evren and Gen. Tahsin Şahinkaya, in addition to stripping the retired generals of their rank.

Evren, 95, the former chief of the General Staff who led the 1980 coup and president of Turkey from 1982 to 1989; and Şahinkaya, 88, commander of the Turkish Air Forces (THK) during the coup period, are the only surviving leaders of the 1980 coup.

Prosecutor Selçuk Kocaman gave his legal opinion in the case at the latest hearing at the Ankara 12th High Criminal Court on Friday.

The prosecutor said the actions of Evren and Şahinkaya violated Article 146 of the Turkish Penal Code (TCK), which concerns “crimes committed against state forces” and calls for life without parole.

In his legal opinion, Kocaman referred to coups in Latin America and Europe, saying that even if crimes committed against humanity are not covered by the laws of some of these countries, the European Court of Human Rights (ECtHR) has ruled that the perpetrators of these crimes could be tried in accordance with international law.

“Holding the dictatorships reigning in Latin America responsible for killings, acts of torture and missing persons during their rules has been possible thanks to the implementation of international law. Argentina, Chile, Ecuador, Mexico, Panama, Paraguay, Peru and Uruguay are some of these countries. The rulings of the Inter-American Court of Human Rights suggest that statutes of limitations and the irretroactivity of law do not apply for coup regimes,” the prosecutor said.

In the meantime, the National Intelligence Organization (MİT) has responded to a request from the court for information and documents about the “Civilian Affairs Coordination Group” as mentioned in the Bayrak (Flag) Operation Plan, which was a written document prepared in the staging of the 1980 coup.

In its response, MİT said it has found no information or records on the group in its archives.

The next hearing will be held on 27 December 2013.

On 28 October 2013 Ankara Heavy Penal Court No. 6 began to hear the case against police officer Ahmet Şahbaz on the murder of Ethem Sarısülük. The court heard the lawyers of the both sides and adjudicated to get the legal argument of the defendant via Voice and Image Communication System/Ses ve Görüntü Bilişim Sistemi (SEGBİS) and adjourned the hearing to 2 December 2013.

Police teams searched the courthouse for explosives and after the hearing interfered to the groups waiting outside the courthouse with gas bombs and water cannons and detained 21 people. Seven people were also wounded.

(10/184) Investigation on the forced disappearance in detention in Şırnak…

Six peasants had been detained in Derecik Region of Görümlü Village of Silopi District of Şırnak Province on 14 May 1993 with the order of former Şırnak Brigade Commander Mete Sayar on the grounds that they had been “helping and harbouring an illegal organisation” and no one knows their whereabouts since then.

A case was launched three days before the limitation of time against Mete Sayar, Görümlü 1st Mechanised Infantry Battalion Commander retired colonel Hasan Basri Vural, 3rd Company Team Commander Lieutenant İbrahim Kıraç, Captain Murat Ali Yıldız, Lieutenant Serdar Tekin and 2nd Commando Battalion Command Tansel Erok and the prosecutor asked for life sentence reported on 23 June 2013.

The first hearing will be held in Şırnak Heavy Penal Court on 5 November 2013. But the court, taking the “security warning” of Şırnak Governorate in to consideration, sent the case file to Ministry of Justice reported on 26 October 2013.

(10/185) Exhumation for the people subjected to forced disappearance in Mardin Province…

The remnant found in the exhumation in the cemetery for unidentified people in Güçlükonak District of Şırnak Province on 22 February 2012 was identified as Ahmet Güler who had been detained in Hirareş (Özbaşoğlu) Village on 22 June 1993. Ahmet Güler’s funeral was held on 28 October 2013.

(10/186) The case on the forced disappearances in Kulp …

The prosecutor who has been working on the investigation on 11 villagers who had been subjected to forced disappearance after they had been detained from their village, Alacakaya Village of Kulp District of Diyarbakır Province on 9 October 1993, finalised the indictment on 24 October 2013.

Diyarbakır Heavy Penal Court No. 7 accepted the indictment and will be hearing the case soon. The prosecutor asked 11 times life sentence in solitary confinement and with no possibility of parole and 25 years of imprisonment for Yavuz Ertürk, Bolu 2nd Commando Brigade former Commander retired Major General.

The first hearing will be held on 26 December 2013.

(10/187) Lice Massacre and the case on the murder of Bahtiyar Aydın…

Fourteen people had been killed in the incident in Lice District of Diyarbakır Province on 22 October 1993. Gendarmerie Regional Commander General Bahtiyar Aydın had gone to the district to evaluate the situation in the place of incident and killed allegedly with a “stray bullet” fired by “terrorists”. A tape of Ayhan Esen, a staff of Antalya Gendarmerie Command revealed out that he had been killed in connection with inner clash inside the army. A day before the limitation of time the investigation was relaunched reported on 21 October 2013. Diyarbakır Heavy Penal Court No. 8 accepted the indictment on 22 October 2013.

According to the indictment, there is no evidence of a PKK attack to the Lice District and the murder of Bahtiyar Aydın by PKK militants was found; the attacks were conducted on the houses of members of the pro-Kurdish Democracy Party (DEP) and on civilians and there is also no evidence concerning the attacks on the police buildings. The prosecutor asked for life sentence in solitary confinement and with no possibility of parole for both of the defendants, retired Colonel Eşref Hatipoğlu and former Senior Lieutenant Tünay Yanardağ. Diyarbakır Heavy Penal Court No. 8 will begin to hear the case the days to come.

The first hearing will be held in Diyarbakır Heavy Penal Court No. 8 on 16 January 2014.

Nine people had been killed by burning their house on the grounds that they had been helping and harbouring illegal organisation in Korkut District of Muş Province on Altınova Municipality of 17 May 1993.

Muş Heavy Penal Court had accepted the indictment against Hasköy Gendarmerie Headquarters Commander Captain B.K., Infantry First-lieutenant H.A., Gökyazı Gendarmerie Headquarters Commander Master Sergeant T.N. and Special Task Force Department vice director Ş.U.

On 4 September 2013 the court began to hear the case and impose probations and ban of leaving Turkey on the defendants. The hearing was adjourned to 20 November 2013.

The case was transferred for security reasons by the Ministry of Justice to Kırıkkale Heavy Penal Court and the first hearing in Kırıkkale will be held on 4 December 2013
