(08/001) Killing by Unidentified Assailants…

The tension between People’s Front (Halk Cephesi) and HDP (People’s Democracy Party) turned into an armed conflict in Gazi quarter of Sarıgazi district in İstanbul. The tension roused when members of People’s Front did not allow HDP members to organise election campaign in favour of Selahattin Demirtaş. After the negotiation between the parties on 31 July 2014, the tension decreased. Members of People’s Front staged then a protest against drug dealers in the neighbourhood. An armed quarrel occurred between members of People’s Front and drug dealers.

Meanwhile a crowd gathered in front of HDP premises for a public meeting. İbrahim Öksüz (14) was shot to death during the public meeting by unidentified assailants. İbrahim Öksüz (14) was allegedly going home from work.

(08/002) Persons Abducted in Siirt…

HPG militants allegedly raided the construction area of a dam on 31 July 2014 in Şirvan district of Siirt. Militants set the construction equipment to fire and abducted 3 private security guards.

(08/003) Protest Prevented in Van…

The police intervened a group of persons who wanted to stage a protest during the meeting of AKP candidate for state presidency on 31 July 2014. The police used tear gas and rubber bullets to disperse the crowd; 7 persons were abounded and one person was detained during the intervention.

(08/004) Political Party Premises Attacked…

AKP premises in Dicle district of Diyarbakır was attacked with molotov cocktails by unidentified persons on 31 July 2014, the attack caused material damage.

(08/005) tear Gas Use of the Police…

The police intervened a group of persons who wanted to stage a demonstration to protest in the power blackouts on 31 July 2014 in Silopi district of Şırnak. The police used tear gas to disperse the crowd, a tear gas canister fell into the garden of a house and 5 persons were hospitalised for being effected by the gas.

(08/006) Armed Attacks and Attempt of Killing by Unidentified Assailant…

The tension between People’s Front (Halk Cephesi) and HDP (People’s Democracy Party) continues in Gazi quarter of Sarıgazi district in İstanbul. The tension roused when members of People’s Front did not allow HDP members to organise election campaign in favour of Selahattin Demirtaş.

M.C. (17) was shot by unidentified persons during the quarrel between the members of People’s Front and HDP which occurred when members of People’s Front attacked election stand of HDP on 1 August 2014 in Gazi quarter of Sarıgazi district in İstanbul. M.C. was hospitalised and there were reportedly traces of beatings on his/her body.

4 members of Socialist Party of the Oppressed (ESP) were wounded during the incidents on 2 August 2014. The police intervened clashes between the 2 groups and Yılmaz Atay was wounded during the intervention when he was shot at his hand with a tear gas canister.

(08/007) Pressures in Prisons…

According to the news appeared on the press on 4 August 2014 after the visit of MPs to the Karataş (Adana) Women’s Prison, the prisoners were not allowed to grow flowers in the wards. The existing flowers were also ripped off by the guards.

(08/008) Protests Prevented in İzmir…

The police prevented the members of Youth Union of Turkey (TGB) who wanted to stage a protest during the meeting of Prime Minister on 2 August 2014 for his being candidate for presidency. 10 members of TGB were detained during the intervention.

(08/009) Detentions and Arrests…

The police detained sculptor Necdet Kutlucan and 2 students of his sculpture workshop for writing “peace” on a wall on Princess Island in İstanbul on 2 August 2014.

They were released after being given a fine sentence of TL 189 under the Law on Misdemeanours.

(08/010) Political Party Premises Attacked…

An armed attack was organised on 2 August 2014 against DBP premises in Sancaktepe district of İstanbul. The attack caused material damage.

(08/012) Attacks against Presidency Candidates…

The convoy of Selahattin Demirtaş was attacked by ultra-nationalist persons with arms after the meeting in Gaziantep on 1 August 2014. 4 persons were wounded during the attack, the conditions of 2 were reportedly serious.

(08/013) Political Party Premises Attacked…

An armed attack was organised on 2 August 2014 against CHP premises in Evreşe town of Gelibolu district in Çanakkale. The attack caused material damage.

 

05-07 August 2014 Daily Human Rights Report

(08/014) State Presidency Elections…

Hasan Peçe, Independent Turkey Party (BTP) Chair for Rize, and Kemal Pehlivanlar, BTP Vice-Chair for Çayeli district, were attacked by 5 persons on 6 August 2014 in Dörtyol village of Rize while working for Ekmeleddin İhsanoğlu’s state presidency elections campaign.

Ultra-nationalists attacked on 5 and 6 August 2014 in Rize an election booth opened for Selahattin Demirtaş’ campaign for state presidency. The attack caused material damage.

A bus used for the Prime Minister’s presidency elections campaign was attacked by unidentified persons on 5 August 2014 in Kozan district of Adana. The attack caused material damage.

(08/015) Students on Trial…

According to the news appeared on the press on 6 August 2014, a court case was launched against 38 university students who occupied 2 faculty buildings in Aegean University in İzmir to protest in the death of 301 mine workers in Soma district of Manisa.

The indictment wants the defendants to be sentenced for “preventing the right to education”, “damaging public property”, “resisting security forces”, “violating the Law on Meetings and Demonstrations” and “making propaganda of an illegal organisation”. İzmir Heavy Penal Court No 2 will start to hear the case on 14 October 2014.

(08/016) Extra-judicial Killing in Şanlıurfa…

Cuman Bilal Osi (39) was shot to death by the Turkish troops when he wanted to pass the border to flee from armed attacks of ISIS in Kobanê province of Rojava to Ceylanpınar district of Şanlıurfa on 6 August 2014.

(08/017) House Raids in Muş…

The police conducted raids against coffee houses in Bulancak district of Giresun and detained 3 persons.

(08/018) Physician Beaten by the Police…

Furkan Ali Uygur, physician at Palandöken (Erzurum) State Hospital, made an official complaint against the police officer İ.İ. on the grounds that İ.İ. beat him on 1 August 2014 for working dilatorily during examination of a convict.

(08/019) Torture and Ill-treatment in Custody…

Ferhat Toprak ve Yusuf Ulu who were detained during house raids conducted on 3 August 2014 in Siirt for throwing stones to security forces during demonstrations were given medical reports certifying that they were subjected to torture and ill-treatment in custody.

They also testified to the Public Prosecutor to the effect that they were tortured. Ferhat Toprak was arrested by the court on the allegations of “resisting security forces”.

Fikret Dikilen (34) incarcerated in Kürkçüler (Adana) F-type Prison for sexual assault allegedly committed suicide on 1 August 2014 in his cell by hanging himself.

(08/021) Political Party Executive Detained…

Yıldırım Beyazıt, Socialist Party of the Oppressed Chair for Samsun, was detinaed on 5 August 2014. The reason of the detention was not disclosed.

(08/022) Protest Intervened in Aydın…

The police intervened the members of Youth Union of Turkey (TGB) when they wanted to stage a protest action during the meeting of Prime Minister for state presidency elections. & members of TGB were detained during the intervention.

(08/023) Extra-judicial Killing in Şanlıurfa…

Yusuf İbrahim (22) was shot to death by the Turkish troops when he wanted to pass the border to flee from armed attacks of ISIS in Kobanê province of Rojava to Ceylanpınar district of Şanlıurfa on 6 August 2014.

(08/024) Extra-judicial Killing in Van…

HPG militant Muhammed Hasanzade was shot to death when soldiers opened fire against a group for not obeying stop warning on 6 August 2014 nearby Qeyseran (Yavuzlar) village in Özalp district of Van.

(08/025) Extra-judicial Killing in Şanlıurfa…

2 persons from Rojava were shot to death by the Turkish troops when they wanted to pass the border from Rojava to Viranşehir district of Şanlıurfa on 7 August 2014.

(08/026) Extra-judicial Killing Attempt in Hakkari…

4 members of Dinç family, residents of Navberuja (Yeşilova) village of Şemdinli district in Hakkari, were wounded when soldiers opened fire for not obeying stop warning on 11 August 2014 while passing the border back after visiting their relatives.

(08/027) Impunity for Torture and Sexual Assault in Custody…

According to the news appeared on the press on 7 August 2014, the investigation concerning the torture and sexual assault allegations committed against M.Y. was closed. M.Y. was detained during a demonstration staged on 11 September 2013 in Kadıköy district of İstanbul to protest in the extra-judicial killing of Ahmet Atakan in Hatay. M.Y. was forced to naked search in the police station.

Sub-governorate of Kadıköy did not give permission for investigation against the police officers Ö.Y. and A.S. İstanbul Regional Administrative Court rejected the objection against the decision. On 22 July 2014, Public Prosecutor decided not to prosecute the police officers upon decision of the court.

(08/028) Pressures in Prisons…

According to the news appeared on the press on 9 August 2014, 11 children incarcerated in Van M-type Prison were subjected to torture and ill-treatment by the guards. B.A., mother of R.A. (15), announced that the guards the children were arbitrarily sentenced to solidarity confinement and threatened by the guards to oppress them.

(08/029) Pressures in Prisons…

According to the news appeared on the press on 9 August 2014, 10 prisoners incarcerated in Gaziantep H-type Prison were banned from communication and visits for one months for conducting hunger strike to protest in the attacks in Rojava.

According to the news appeared on the press on 7 August 2014, the prisoner Aydın Çubukçu was transferred first to Batman M-type Prison and then to Ordu E-type Prison without his demand after having a liver transplantation surgery in İzmir.

(08/031) Protest Intervened in Van…

A demonstration was staged on 8 August 2014 in Çaldıran district of Van to protest in ISIS attacks in Şengal region of Iraq against the Ezidi people. Hundreds of Ezidis died during the attacks started on 2 August 2014.

The police dispersed the crowd by using tear gas, water cannons and plastic bullets when they wanted to make press announcement. Erdal Akçik was heavily wounded during the incident when he was shot with a tear gas canister.

(08/032) Workers’ Demonstration Intervened…

Gendarmerie soldiers prevented on 11 August 2014 the action of 18 workers who were fired from SÜTAŞ company in Aksaray. The workers wanted to stage a protest in front of the company, but the soldiers detained them under beatings.

(08/033) State Presidency Election…

The police intervened on 7 August 2014 by using tear gas the election booth opened for Selahattin Demirtaş’ campaign for state presidency on Kıbrıs Şehitleri Avenue in İzmir.

Ultra-nationalists attacked on 7 August 2014 in Fındıklı district of Rize an election booth opened for Selahattin Demirtaş’ campaign for state presidency.

Ökkeş Nergis, Party of Labour Chiar for Osmaniye, and Celal Eker, Democratic Regions Party Chair for Hasanbeyli, were attacked by ultra-nationalists on 7 August 2014 when they were making propaganda for Selahattin Demirtaş’ campaign for state presidency in Hasanbeyli district of Osmaniye. The attackers broke Ökkeş Nergis’ nose.

A group of persons who were making propaganda for Selahattin Demirtaş’ campaign for state presidency were attacked on 8 August 2014 in Antalya.

(08/034) Worker Deaths…

Worker’s Health and Job Safety Assembly announced on 4 August 2014 that at least 123 workers died in July 2014 during work accidents due to untaken security measures.

(08/035) Lynching Attempt in Gaziantep…

After the killing of Hıdır Çalan (62) by a Syrian refugee on 11 August 2014 in Gaziantep, lynching attempts targeting Syrians were recorded on 12 August 2014. The person led by the relatives of Hıdır Çalan destroyed the vehicles with Syrian registry plates and tried to lynch Syrians in the neighbourhood. The attacks continued the whole night and at least 10 Syrians were wounded due to being stabbed or beaten with sticks.

(08/036) Torture Trial Concluded…

According to the news appeared on the press on 12 August 2014, the 8th Penal Chamber at the Court of Cassation approved the verdict against 6 police officers and a physician in a torture case. The Chamber also ruled in the decision that beating someone on the streets should be regarded as torture.

Güney Tuna (21) had been beaten by the police officer Muhammed Bağcı on the grounds that he had been drinking in a park in Avcılar District of İstanbul Province on 3 October 2009. Physician Ergin Ertan had given Güney Tuna a report that claims he was healthy.

On 18 December, 2012 Bakırköy Heavy Penal Court No 7 concluded to hear the case against police officer Muhammed Bağcı on charges of “aggravated torture” and Physician Ergin Ertan and five other officers on charges of negligence in office. The court sentenced the Police Officers Muhammet Bağcı and Samet Durmaz to 6 years and 8 months of imprisonment each; Physician Ergin Ertan to 2 months and 15 days of imprisonment. The officers Evren Bakırtaş, Zafer Arık, Fatih Fidan and Enes Paray were acquitted.

The Chamber quashed the verdict against the police officer Samet Durmaz.

(08/037) Extra-judicial Killing Attempt in Hakkari…

Ayhan Dinç, correspondent with the İhlas News Agency, was wounded when he was shot at his arm by the soldiers on 12 August 2014 nearby the border in Şemdinli district of Hakkari. Ayhan Dinç was following news concerning recent developments on the border.

(08/038) Demonstrators on Trial…

According to the news appeared on the press on 12 August 2014, a court case was launched against 30 persons on charges of “damaging public property” and “violating the Law on Meetings and Demonstrations”.

On 14 March 2014, the police intervened a tent put up in Didim district of Aydin to protest in the death of Berkin Elvan on 11 March 2014 and detained 30 persons. Berkin Elvan was shot at his head with a tear gas canister by the police during Gezi Park demonstrations.

The indictment wants the defendants to be sentenced to 11 years’ imprisonment. Didim Penal Court of First Instance No 2 will start to hear the case.

(08/039) Workers’ Demonstration Prevented…

The police intervened on 12 August 2014 the tent of 12 members of the union in health sector Dev-Sağlık-İş and detained 2 workers. The workers were on action to protest in the being fired from Kocaeli University Medical School for demanding right to be member of a union and collective bargaining.

(08/040) Detentions and Arrests…

Mesut Uysal, former People’s Labour Party Chair for Şırnak and member of Kürdistan National Assembly (KNK), was detained on 12 August 2014 in Esenboğa Airport in Ankara when he arrived Turkey. He was living abroad for years.

Mesut Uysal was kept in police custody the day and was released in the evening on the grounds there was no official warrant against him.

(08/041) Death in Prison…

Ali Acar incarcerated in Alanya (Antalya) L-type Prison allegedly committed suicide on 12 August 2014 by hanging himself.

(08/042) Lynching Attempts in Gaziantep…

After the killing of Hıdır Çalan (62) by a Syrian refugee on 11 August 2014 in Gaziantep, lynching attempts targeting Syrians continued on 13 and 14 August 2014.

Due to the lynching attempts and attacks, Syrians were evacuated from the city. The police also detained 50 persons for involving the incidents.

(08/043) Compensation for Killing by Unidentified Assailants…

The body of Abdullah Öztürk was found dead after being abducted by alleged PKK militants on 19 September 2011 nearby Eruh district of Siirt.

2 PKK militants were killed during operations conducted upon information provided by him. He was rewarded by the officials by making his name public. His family launched a compensation case against the Ministry of Interior Affairs alleging that Abdullah Öztürk was identified on the grounds that his name was revealed.

According to the news appeared on the press on 15 August 2014, Batman Administrative Court concluded to hear the case. The court decided that Abdullah Öztürk was on PKK’s black list for being informant, but the state had to take necessary measures to protect him. The court ruled TL 297,000 compensation to be paid to the family of Abdullah Öztürk.

(08/044) Hasan Ferit Gedik Case…

Anadolu (İstanbul) Heavy Penal Court No 10 started on 14 August 2014 to hear the case concerning the killing of Hasan Ferit Gedik on 30 September 2013 during the armed attack by drug dealers against the members of People’s Front in Gülsuyu quarter of Maltepe district in İstanbul. 35 defendants including 15 remanded defendants are on trial for being involved in the incidents on 28-29-30 September 2013.

The defendants attacked before the hearing family of Hasan Ferit Gedik and audiences, the court adjourned the hearing to 4 September 2014 without starting to hear.

(08/045) Attacks against Syrian Refugees…

A quarrel occurred between Syrian refugees and dwellers of Fatih Sultan Mehmet quarter in Kilis on 14 August 2014. One Syrian was wounded during the incident. The houses of Syrian were stoned and 75 Syrian refugees were evacuated from the neighbourhood.

(08/046) Correspondent Detained in Kilis…

Nazım Daştan, correspondent with the Dicle News Agency, was detained by the soldiers nearby the Turkey-Syria border in Deliorman village of Kilis when he was watching the Syrians passing the border. His camera was seized and he was released afterwards.

(08/047) House Raids in Şanlıurfa…

The police conducted house raids in Ceylanpınar district of Şanlıurfa and detained 5 persons on the allegations of attending protests after the local elections. Mazlum Dağtekin was arrested on 14 August 2014 on the allegations of “damaging public property”.

(08/048) Protesters on Trial…

Bingöl Heavy Penal Court continued on 14 August 2014 to hear the case against 24 persons launched on charges of “being member of an illegal organisation”, “making propaganda of an illegal organisation” and “possessing explosives”. The case was launched in connection with the protests staged after the attacks against BDP premises in Bingöl on 21 September 2012. 6 defendants were remanded in this case.

After the testimonies of the defendant by means of teleconference, the court decided to release all the defendants to be tried without remand and adjourned the hearing.

(08/049) Detentions and Arrests…

M. Sadık Geylani and İslam Geylani were detained on 14 August 2014 on a control point in Derecik town of Şemdinli district in Hakkari. M. Sadık Geylani was arrested by the court on the allegations of “aiding and abetting an illegal organisation”.

 

16-18 August 2014 Daily Human Rights Report

(08/051) Person Beaten by Municipal Police Officers…

Street peddler A.Y. announced that some 20 municipal police officers forcibly took him and M.Ç. in a car and beat for a while on 14 August 2014 in Karşıyaka district of İzmir.

(08/052) Attacks against Syrian Refugees…

On 16 August 2014, N.S. and M.N. threatened a Syrian family in Gaziantep to leave the place they were living in. When the family rejected, the discussion turned into a quarrel. N.S. and M.N. were abounded during the fight. After the incident, the police evacuated the house of the Syrians and the Syrians were sent to a refugee camp.

(08/053) Association Char Arrested…

The court of Cassation approved 3 months’ imprisonment sentence given to Abdullah Gürgen, Chair for Human Rights Association Siirt branch, for “violating the Law on Meetings and Demonstrations”. Abdullah Gürgen started on 15 August 2014 to serve his sentence.

(08/054) Demonstration Intervened…

The police intervened and dispersed on 17 August the dwellers of Çıksorut neighbourhood in Gaziantep when they wanted to stage a demonstration with the demand of renovation and cleaning of a park.

(08/055) Persons on Trial…

Şanlıurfa Heavy Penal Court No 2 continued on 15 August 2014 to hear the case against 5 persons launched after the operations conducted against the houses of BDP Youth Assembly members on 3 December 2013 in Şanlıurfa. The indictment wants the remanded defendants Leşker Akman, Kutbettin Saltan, Serhat Mutlu, Derviş İnan and Hikmet Yaygın to be sentenced for “being member of YDG-H and KCK” and “procuring members to an illegal organisation”.

After the defence of the lawyers, the court decided to release the defendants to be tried without remand. and adjourned the hearing.

(08/056) Detentions and Arrests…

7 persons were detained by the gendarmerie on 14 August 2014 on a control point while they were going to Van from Uzim village of Pervari district in Siirt. The reason of detention was not disclosed.

On 14 August 2014 in Şirvan district of Siirt, the police detained 4 persons during ID control on the allegations of “making propaganda of an illegal organisation” for carrying Democratic Patriotic Youth Journal.

 

19 August 2014 Daily Human Rights Report

(08/058) Extra-judicial Killing and Attack against Statue…

On 18 August 2014, Lice Peace Penal Court decided upon application of Diyarbakır Governorate to seize the statue of Mahsum Korkmaz erected in the cemetery for PKK militants in Sisê (Yolçatı) of Lice district in Diyarbakır.

The soldiers attacked in the morning of 19 August 2014 the people who were waiting to protect the statue by closing the Bingöl-Diyarbakır road. The soldiers used real bullets and tear gas to disperse the crowd, and removed the statue. Mehdi (Muhittin) Taşkın was shot at head during the incidents and died, 2 persons were wounded.

(08/059) Operations and Attacks in the South-eastern…

A police officer wounded when a land mine exploded when a police vehicle was on the way to Kapıköy Border Gate on 18 August 2014 in Saray district of Van.

(08/060) Music Group Members Attacked…

3 members of Kurdish music group KomaKarker were attacked by ultra-nationalists on 18 June 2014 on İstiklal Avenue in İstanbul. One of the group members Y.A. was hospitalised due a a hit at the head.

(08/061) Zirve Publishing Massacre…

Malatya Heavy Penal Court No 1 continued on 18 August 2014 to hear the case against 21 persons including 4 remanded defendants launched in connection with the killings of Tilman Ekkehart Geske, Necati Aydın and Uğur Yüksel on 18 April 2007 in Zirve Publishing in Malatya.

Gendarmerie General Command sent a letter to the court that the missionary activities were tracked before 2010, but no documentation of the activities was archived.

After the presentation of the demands of defence lawyers, the court decided continuation of the arrest of the defendants Ruhi Abat, retired Colonel Mehmet Ülger, Major Haydar Yeşil and Varol Bülent Aral, and adjourned the hearing to 15 October 2014.

(08/062) Condition of Prisoners…

Coşkun Selçuk, Chair for Human Rights Assocation İskenderun branch, made a press announcement concerning the condition of Sinan Tutmaz incarcerated in İskenderun (Hatay) E-type Prison. Coşkun Selçuk stressed that Sinan Tutmaz serving the last 16 years in the prison lost his right hand previously and now suffering from hyper-tension, facial paralysis, and there were still shrapnel pieces in his face.

(08/063) House Raids in Erzincan…

The police conducted house raids on 19 August 2014 in Erzincan and detained Hasan Sınırtaş, Executive for Pir Sultan Abdal Cultural Association. The reason of the operation was not disclosed.

(08/064) Operations and Attacks in South-east…

One lieutenant was killed and one soldier was wounded when a military troop was attacked on 19 August 2014 nearby Saray district of Van.

(08/065) Suspicious Soldier Death…

Specialist sergeant Uğur İnal allegedly died in Diyarbakır when his rifle fired accidentally. He was on duty in a troop from Mardin, but the troop came to Diyarbakır for the intervention to the statue of Mahsum Korkmaz in Lice district of Diyarbakır on 19 August 2014.

(08/066) Attacks against Syrian Refugees…

The shops run by Syrian refugees were attacked on 19 August 2014 in Barbaros quarter of İskenderun district in Hatay on the allegations that a child was abused in one of the shops. The attacks caused material damage. When the attacks worsened, the police tokk security measures and Governor of İskenderun announced that the allegations were not true.

Bora Sarı incarcerated in Kalkandere (Rize) L-type Prison allegedly hanged himself and died on 11 August 2014.

According to the news appeared on the press on 19 August 2014, Hasan Değirmenci (58) incarcerated in Adana E-type Prison suffering from heart disease and diabetes reportedly died when he had heart attack on the way to hospital.

Socialist Part of the Oppressed (ESP) member Uğur Tuncer who was among 5 persons detained on 17 August 2014 during Gülsuyu Festival in Maltepe district of İstanbul was arrested on 19 August 2014 on the allegations of “making propaganda of an illegal organisation”.

(08/070) Freedom of Expression…

Adana Penal Court of First Instance No 14 started on 19 August to hear the case against Ertan Altıncı’nın (29) launched for shouting “Thief there is” on 23 July 2014 during the meeting of the Prime Minister in Adana for the state presidency elections.

The indictment wants Ertan Altıncı to be sentenced for “insulting a public officer” under the Article 125 TPC. Ertan Altıncı apologised to the complainant and the court adjourned the hearing after his testimony.

(08/071) Freedom of Expression…

According to the news appeared on the press on 19 August 2014, the investigation against Kudret Kaçar was concluded. Public Prosecutor demanded Kudret Kaçar to be sentenced according to the Article 214 TPC for “inciting people to commit crime”. Bursa Penal Court of First Instance No 4 will start to hear the case.

U.Ö. (15) who was detained on 19 August 2014 in Lice district of Diyarbakır on the allegations of throwing blast bomb against the security forces during the protest for killing of Mehdi Taşkın by soldiers was reportedly beaten in the police vehicle.

(08/074) Condition of Prisoners…

Ekrem Çiçek (60) who was arrested in connection with a KCK operation conducted in 2009 in Diyarbakır had brain haemorrhage on 4 June 2014 when he fell on the ground in the bathroom. He was suffering from hypertension.

He was taken to Diyarbakır Training and Research Hospital, but he was transferred to the prison on 17 July 2014 without completion of the treatment on the grounds that there was no space available for him in the hospital. After the attempts of human rights organisations and MPs, the hospital accepted Ekrem Çiçek on 18 July 2014 to be hospitalised.

His sentence was suspended on 20 August 2014 upon medical report by the Forensic Institute.

Serhat Polatsoy incarcerated in Diyarbakır D-type Prison and suffering from a lung problem was released by Şanlıurfa Heavy Penal Court No 2 on the grounds there was no suspicion of escape. He was on trial on charges of “being member of an illegal organisation”. The court adjourned the hearing for the completion of deficient documents.

An armed attack was organised by a group of PKK militants on 20 August 2014 in Kocaköy district of Diyarbakır against the Gendarmerie Command, Security Directorate and public houses. The attack caused material damage.

After the abolishment of specially authorised courts, Şırnak Heavy Penal Court No 1 continued on 20 August 2014 to hear the case against 13 remanded defendants launched after a KCK operation conducted in 2011 in Şırnak and its districts.

The indictment wants the defendants to be sentenced for “being member of an illegal organisation”, “leading an illegal organisation by organising activities of the organisation”, “making propaganda of an illegal organisation”. Ali Çelebi suffering from schizophrenia died on 4 August 2014 in Kabaklı town of Tekirdağ when he was hospitalised after the police used tear gas, beat with truncheons and handcuffed from behind to catch him. His family wanted him to be hospitalised when his condition worsened for having schizophrenia. But he ran away from the ambulance on the way to the hospital and sheltered in the house of his brother. The police was called to catch him.

Eyewitnesses testified to the effect that the police offceirs Ömer Acar, Mehmet Türkmenoğlu, Yusuf Bozkurt Açıkel, Deniz Polat and Ahmet Sarıkaya beat Ali Çelibi for minutes. According to the news appeared on the press on 24 August 2014, Public Prosecutor in Çengelköy decided on 18 July 2014 not to prosecute the police officers on the grounds that the officers acted in accordance with the Law on Duties and Powers of Police (PVSK).

During a quarrel between A.S., owner of a bakery, and Syrian refugees, 3 persons were stabbed and wounded. A.S. reportedly did not pay the weekly wages of 2 Syrian children working for him on the grounds they did steal money. After the incident, relatives of A.S. set the house of Syrian refugees on fire and the house burnt down.

According to the news appeared on the press on 26 August 2014, the investigation started after the official complaint by Abdurrahman Demir for losing his toes due to the torture having been subjected during 3-months detention in 1984 was concluded. He had been detained after an armed attack against a military vehicle in 1984 nearby Çukurca district of Hakkari.

On 9 May 2011, Abdurrahman Demir made an official complaint against officer R.Y. from Çukurca Gendarmerie Command, first lieutenant M.T. and lieutenant R.K. from Bolu Commando Command, non-commissioned officer T.I from Köprülü Gendarmerie Command. Public Prosecutor in Hakkari accused them for torture and the indictment wants them to be sentenced to a term of imprisonment up to 18 years.

Hakkari Heavy Penal Court No 2 will start to hear the case on 14 October 2014.

The gendarmerie intervened the workers who chained themselves to the gate of M&T advertisement company on 25 August 2014 in Düzce to protest in their being fired. 4 workers were detained during the intervention.

According to the news appeared on the press on 26 August 2014, a court case was launched against 20 persons after the investigation started following the police intervention to the crowd gathered in Atatürk Park in Adana on 31 May 2014 on the anniversary of Gezi Park demonstrations.

The indictment wants the defendants to be sentenced for violating the Law on Meetings and Demonstrations. Adana Penal Court of First Instance No 10 will start to hear the case on 10 December 2014.

Polce officer Ali Kızıloğlu (25) working at the intelligence service of Kayapınar Security Directorate in Diyarbakır was shot to death by unidentified persons on 26 August 2014 when he was going home.

(08/101) Suspicious Private Death…

A private serving for compulsory military service in Çınar gendarmerie station in Diyarbakır allegedly committed suicide by shooting himself on 26 August 2014. He was registered to Bingöl province. The Public Prosecutor appointed to investigate the incident was not allowed to enter the military station.

(08/102) Bomb Attack in Reyhanlı…

After the abolishment of specially authorised courts Adna Heavy Penal Court No 10 decided not to be responsible with case and the files sent to Court of Cassation to decide for further trial, Hatay Heavy Penal Court No 1 continued on 26 August 2014 to hear the case against 33 persons including 15 remanded ones launched in connection with the bomb explosions in Reyhanlı district of in Hatay on 11 May 2013. 2 of the defendants in this case ore of Syrian origin. Two separate bombs exploded during the incident. 52 persons died and 130 persons were wounded. After the identification of the defendants, the court decided the continuation of the arrests. The court also decided to examine the files of Utku Kalı case and adjourned the hearing to 13 May 2014.

A group of 20 officers from İstanbul Municipality reportedly beat a street peddler selling mussel when the objected his stall’s being broken by the officers. A video recording of the incident recorded with a phone was revealed later.

(08/105) Farmers’ Demonstration Intervened…

Gendarmerie soldiers intervened the farmers on 26 August 2014 in Derik district of Mardin when the farmers closed the Derik-Şanlıurfa road to protest in the recent power cuts. The soldiers used tear gas and water cannons to disperse the crowd, Fayık Şengel (25) was wounded during the intervention for being shot at his face with a tear gas canister.

Hatay Heavy Penal Court No 1 rejected on 27 August 2014 the demand for the police officer Ahmet Kuş’ (28) being tried remanded. He was on trial at Hatay Heavy Penal Court No 2 on charges of the killing of Abdullah Cömert (22) on 3 June 2013 in Hatay during Gezi Park demonstrations. Abdullah Cömert was shot at his head with a tear gas canister. The indictment wants the police officer Ahmet Kuş who fired the canister to be sentenced to term of imprisonment up to 25 years.

The case was transferred to Balıkesir Heavy Penal Court No 2 for security reasons. The court will continue to hear the case on 15 September 2014.

According to the press announcement made on 27 August 2014, Evrim Erdoğdu incarcerated in Şakran (İzmir) Women Prison had an asthma attack in a room in the hospital without windows and ventilation. She was suffering from chronic asthma and transferred to hospital.

According to the news appeared on the press on 27 August 2014, Mansur İlık incarcerated in Diyarbakır E-type Prison was reportedly beaten by 4 guards on 2 August 2014 when he asked for medical treatment for having ache due to the tumour in his liver.

He was taken to the prison’s infirmary, but returned the ward on the grounds there was no physician in the infirmary. He was transferred to the hospital later due to hs heavy aches.

H.E. (9) was shot at face with a tear gas canister and wounded when the police intervened a group of children with tear gas for shouting slogans on 31 August 2014 in Nusaybin district of Mardin.

(08/114) Person Beaten by the Police…

Seyhan Duman was sprayed tear gas and beaten by the police on 30 August 2014 in Van he had a dispute with the officers while parking on Cumhuriyet Boulevard. The reason of the dispute was not disclosed. Seyhan Duman was detained in the hospital when he went to take a medical report to make an official complaint. There were traces of beatings on his head, back and arms.

(08/115) Torture and Rape Allegation in Sheltered Housing…

According to the news appeared on the press on 29 August 2014, 2 workers of Gaziantep Municipality Sheltered Housing informed both the Municipality and press that 3 women were kept in a room and subjected to torture and rape by 3 workers in the shelter.

They were allegedly fired for informing the press about the incident. Executive Vice-Mayor Mehmet Durdu Yetkinşekerci announced that an investigation was started and the director of the shelter was suspended from duty.

(08/116) Festus Okey Case…

According to the news appeared on the press on 29 August 2014, Public Prosecutor in İstanbul started an investigation against police officers Ömer Akçay, Erdoğan Tuna, Kamotay Akçil, Mehmet Aldemir, Osman Çağlar Kale and related public officers on the allegations of “murder in the first degree”. They lost the most important evidence in the case of Festus Okey.

İstanbul Heavy Penal Court No 21 concluded on 5 June 2014 to hear the retrial of Festus Okey case. Penal Chambers No 1 at the Court of Cassation annulled the verdict of the İstanbul Heavy Penal Court in Festus Okey case on the grounds that the demand of the family of Festus Okey to be an intervening party with the case was not taken into consideration. But the court insisted on its verdict in the retrial and sent the file to Court of Cassation Assembly of Criminal Chambers.

On 13 December 2011, İstanbul Heavy Penal Court No. 21 sentenced Cengiz Yıldız, a police officer, to 4 years and 2 months’ imprisonment for “homicide with negligence” under the Article 85/1 TPC. The case was launched for killing of Nigerian refugee Festus Okey who was detained in 2007 for not carrying an ID and shot to death in detention by a police officer.

According to the press announcement made on 30 August 2014, 5 persons including 3 children were beaten and kept in cell without a bed in Maltepe (İstanbul) Child and Youth Prisons and Kartal (İstanbul) H-type Prison. They were incarcerated in Sincan (Ankara) F-type Prison No 2, but transferred to İstanbul for examinations in İstanbul Forensic Institute.

According to the news appeared on the press on 29 August 2014, Public Prosecutor in Ankara concluded the investigation against 26 persons started for attending the Gezi Park protests in Ankara.

The indictment wants 26 persons to be sentenced for “being member of an illegal organisation”, “making propaganda of an illegal organisation”, “resisting public officers” and “damaging public property”. If the court accepts the indictment, the trial will start.

İstanbul Governorate did not allow the 1 September Peace Day celebrations planned to be held on 31 August on Kadıköy Square. The decision was taken on the grounds of traffic flow and delivered on 30 August 2014 to the organising committee. After the negotiations, the Governorate allowed a one-hour celebration.

The police intervened on 29 August 2014 the workers who started a sit-in action in front of Esenyurt (İstanbul) Municipality for not being paid for the last 2 years. 20 persons including workers and their supporters were detained under beatings.

The police conducted operations on 28 August 2014 in İstanbul and detained Cem Madendere and Duygu Okay on the grounds that their fingerprints on a barrette found after the incident occurred following 1 May celebrations.

The police conducted house raid on 29 August 2014 in Diyarbakır and detained Adem Özkan, student at Dicle University Medical School. The reason of the raid was not disclosed.
