(06/019) Abducted and Tortured Person…Democratic Rights Federation member Ceren Ünver announced that she was abducted by the police on 1 June 2014 in Eskişehir and heavily beaten until she fainted. She regained his consciousness in front of his house.
(06/020) Journalist on Trial…
Anadolu (İstanbul) Penal Court of First Instance No 2 started on 3 June 2013 to hear the case against Hafize Kazcı, editor-in-chief with the daily soL, launched on charges of “inciting people not to obey laws and to commit crime”, “praising crime and criminals”, and “inciting people hatred and enmity” for the news appeared on the paper during Gezi Park demonstrations.
After the testimony of Hafize Kazcı and opinion of the lawyers, the court adjourned the hearing to 14 October 2014 to ask whether the indictment was prepared within the limits of statutory period.

Antalya Penal Court of First Instance No 17 continued on 2 June 2014 to hear the case against lawyer Nusret Gürgöz and 4 prisoners incarcerated in Antalya L-type Prison launched on charges of “insulting public officers” and “slander”.
On 28 June 2012, Nusret Gürgöz visited the prison and prepared a report on the torture incidents occurred in the prison. Upon the release of the report, a guard made an official complaint against Nusret Gürgöz and 4 prisoners with whom Nusret Gürgöz interview during the visit.
After the testimonies of the prisoners, the court adjourned the hearing for the completion of deficient documents.

On 2 June 2014, Telecommunications Communication Presidency prevented access to information sharing site ask.fm as a precautionary measure. The prevention suspended after a while.
(06/023) Gezi Park Trials…
Kocaeli Penal Court of First Instance No 4 started on 2 June 2014 to hear the case against 238 persons launched on charges of “violating the Law on Meetings and Demonstrations”, “damaging public property” and resisting security forces”. The case was launched for attending Gezi Park demonstrations held in Kocaeli.
The court decided to take the testimonies of 7 defendants each day and adjourned the hearing.

İzzettin Yardım (55), headman of Yerli Çoban village in Eruh district of Siirt, was reportedly abducted on 3 June 2014 by 2 unknown armed persons.

Worker’s Health and Job Safety Assembly announced on 2 June 2014 that at least 414 workers died in May 2014 during work accidents due to untaken security measures.
(06/026) Protest Intervened in Rize…
On 3 June 2014, gendarmerie soldiers intervened a sit-in action started by the women of Şimşirli village of İkizdere district in Rize on 1 June 2014 to protest in the cutting down the trees for the construction of a hydroelectric power plant. Gendarmerie soldiers attacked the villagers with truncheons and 25 women were wounded during the intervention. Gendarmerie soldiers detained 6 persons.

The police intervened a group of persons by using tear gas and water cannons on 3 June 2014 in Cizre district of Şırnak when they wanted to march to protest in the constructions of new military stations. N.C. (13) was wounded when s/he was shot at head with a tear gas canister.

(06/028) Extra-judicial Killing in Kilis…
Mihemmed Reşit (13) was shot to death when soldiers opened fire when a group of people tried on 4 June 2014 to pass the border from İktidam village in Rojava region of Syria to Ergikanı village of Kilis. Ömer Ömer and Ömer Fereç were also wounded during the incident.

According to the news appeared on the press on 4 June 2014, Gulli Taş (60) who did not obey stop warning and drove away from police control in Şanlıurfa for not having a driving license was reportedly beaten by 6 police officers after being caught.

According to the news appeared on the press on 4 June 2014, Ekrem Çiçek (60) who was arrested after the KCK operation conducted in 2009 in Diyarbakır and suffering from hypertension had a brain haemorrhage when he fell on the ground during bath in the prison. He was hospitalised and is being kept in intensive care.

According to the news appeared on the press, 4 prisoners were beaten by the prison guards on 4 June 2014 when they objected to be handcuffed from behind during transfer to the hospital.

İstanbul Penal Court of First Instance No 33 continued on 5 June 2014 to hear the case against the lawyers Tamer Doğan, Ali Şafak, Zeycan Balcı Şimşek, Efkan Bolaç, Sinan Varlık, Sinan Zincir and Hüseyin Boğatekin launched on charges of “resisting public officers to prevent from duty” and “violating the Law on Meetings and Demonstrations”.
The lawyers protested on 20 January 2013 in front of İstanbul Çağlayan Court House the operation conducted against the members of Progressive Lawyers Association on 18 January 2013 in connection with a “DHKP-C investigation”.
After the testimonies of the lawyers, the court adjourned the hearing for the completion of deficient documents.

The police intervened a group of persons by using tear gas and water cannons on 4 June 2014 in Lice district of Diyarbakır when they wanted to march to protest in the constructions of new military stations. Ferhat Parlak, correspondent with the Silvan Mücadele newspaper, was wounded when he was shot at head with a tear gas canister.

The police conducted house raids on 4 June 2014 in Siirt against university students’ houses in connection with a “KCK investigation” and detained 17 persons.

The police conducted house raids on 5 June 2014 in Kayseri and detained Muharrem Demirkıran, representative of the Socialist Party of the Oppressed for Kayseri. The reason of the operation was not disclosed.

(06/037) Festus Okey Case…
İstanbul Heavy Penal Court No 21 started on 5 June 2014 to hear the retrial of Festus Okey case. Penal Chambers No. 1 at the Court of Cassation annulled the verdict of the İstanbul Heavy Penal Court in Festus Okey case on the grounds that the demand of the family of Festus Okey to be an intervening party with the case was not taken into consideration. But the court insisted on its verdict in the retrial and sent the file to Court of Cassation Assembly of Criminal Chambers.
On 13 December 2011, İstanbul Heavy Penal Court No. 21 sentenced Cengiz Yıldız, a police officer, to 4 years and 2 months’ imprisonment for “homicide with negligence” under the Article 85/1 TPC. The case was launched for killing of Nigerian refugee Festus Okey who was detained in 2007 for not carrying an ID and shot to death in detention by a police officer.

Gökhan Dağbay who was serving for compulsory military service in Ermiş Border Military Station in Oğuzeli district of Gaziantep reportedly shot himself to death on 5 June 2014 accidentally.
(06/039) Torture and Ill-treatment Trial…
İzmir Heavy Penal Court No 6 started on 5 June 2014 to hear the case against 4 police officers and F.C. In his opinion as to the accusations the Public Prosecutor wanted F.C. to be sentenced to 8 years and 9 months’ imprisonment.
Public Prosecutor also wanted 3 police officers to be sentenced to 13 months’ imprisonment, one police officer to be acquitted. The Public Prosecutor alleged that the torture incident recorded by the cameras was not torture on the grounds the police officers did not beat F.C. with the intention of torture but as a reply to the insults.
The court adjourned the hearing for the preparation of the defence.
On 22 April 2014, İzmir Penal Court of First Instance No 9 concluded to hear the case against police commissioner Mustafa Dinçer and police officers Murat Kavlak and Ümit Sadioğlu launched on charges of “hiding evidences by using their authority”. The court sentenced the defendants to 3 months’ imprisonment, but suspended the sentences for 5 years.
On 16 July 2011, F.C. (37) was beaten and detained in İzmir for not having an ID. He was taken to Karabağlar Polcie Station and a civilian dressed police officer continued to beat him, he was also subjected to sexual assault. According to the recordings disclosed on 9 December 2011, the remaining police officer did not intervene the incident, but kept watching.
After the incident, the police officers made official complaint against F.C. for resisting and insulting public officers. A court case was launched against him on charges of “wounding police officer” and “insulting police officer” with the demand of 6,5 years’ imprisonment.
Though the recordings proved the torture, the indictment dating 28 November 2011 against the police officers T.D., N.A., H.Y. and B.S. only wanted them to be sentenced to terms of imprisonment up to 1,5 years for “simple wound within the limits of use of force”. During the trial the police officers were also accused of “threat” and the expected sentence increased to terms of imprisonment up to 6 years.
According to the expert’s report, the police commissioner Mustafa Dinçer and police officers Murat Kavlak and Ümit Sadioğlu tried to hide the recordings of beating. And the case was launched upon this report according to the article 281 TPC.

According to the news appeared on the press on 5 June 2014, a court case was launched against Abdullah Bağ, chief director with the TV channel Samanyolu, in connection with the news appeared on the TV concerning Prime Ministers election meeting in Niğde on 4 Mart 2014. The indictment wants Abdullah Bağ to be sentenced to a term of imprisonment up to 11 years and 2 months for “insult and slander” and “inciting people hatred and enmity”.
Anadolu (İstanbul) Penal Court of First Instance No 9 will start to hear the case.
(06/041) Protester Convicted…
Trabzon Peace Penal Court No 2 continued on 6 June 2014 to hear the case against Seçil Esmanur Erdem launched for throwing eggs to the convoy of Prime Minister during his visit to Trabzon on 23 November 2013.
The indictment wants Seçil Esmanur Erdem to be sentenced for “insulting public officer” under the Article 125 TPC. After the final defence, the court sentenced the defendant to a fine of TL 7,080 and suspended the sentence.

15 persons who put up tents on Meskan Mountain in Hakkari to protest in the constructions of new military station were arrested on 5 June 2014 on the allegations of “shooting slogans in favour of an illegal organisation” when they were coming back from the mountain.
(06/043) Protest Intervened in Diyarbakır…
Soldiers intervened a group of persons by using tear gas and water cannons on 5 June 2014 in Lice district of Diyarbakır while they were protesting in the constructions of new military stations. On person was wounded when he was shot at head with a tear gas canister. One soldier was reportedly wounded during the incident.
(06/044) Villagers on Trial…
Rize Penal Court of First Instance started on 5 June 2014 to hear the case against 39 persons launched on charges of “violating work and labour freedom”, “insult and threatening”, “staging a damaging action”, and “violating the immunity of workplace”.
The case was launched in connection with closing Rize-Erzurum road to protest in the cutting down the trees for the construction of a hydroelectric power plant in August 2013 by the villagers of Şimşirli village of İkizdere district in Rize.
The court started to take the testimonies of the defendants and adjourned the hearing to 24September 2014 for the continuation of the testimonies.

(06/045) Extra-judicial Killing in Diyarbakır…
Military troops intervened on 7 June 2014 in protests on the Diyarbakır-Lice road against the construction of new military station by using real bullets, tear gas and water cannons.
The intervention continued when the crowd resisted and responded, the protesters Ramazan Baran (26) and Baki Akdemir (50) were shot in the chest and died. Abdullah Akkulu and 2 other persons were wounded. The condition of Abdullah Akkulu was reported to be serious.
The Ministry of Interior Affairs appointed to inspectors to investigate the incident, but the persons who killed 2 persons were not identified yet.
(06/046) Killing of Hrant Dink Investigation…
According to the news appeared on the press on 5 June 2014, Bakırköy (İstanbul) Heavy Penal Court No 8 lifted on 21 May 2014 the decision of Public Prosecutor in İstanbul not to prosecute public officers in connection with the Hrant Dink’s killing. ECtHR sentenced Turkey on 14 September 2010 in the Dink v. Turkey application for lack of effective investigation.
Upon decision of Bakırköy (İstanbul) Heavy Penal Court No 8, a court case can be opened against Former İstanbul Security Director Celallettin Cerrah and security officials Ahmet İlhan Güler, Bülent Köksal, İbrahim Pala, İbrahim Şevki Eldivan, Volkan Altunbulak, Bahadır Tekin, Özcan Özkan and former İstanbul vice-Governor Ergun Güngör.

Gürsel Erdoğan who was serving for compulsory military service in Dereyanı Gendarmerie Station in Yeşilli district of Mardin allegedly shot himself to death accidentally with his rifle during on 7 June 2014. He was registered to Alaca district of Çorum. Some agencies released news saying that Gürsel Erdoğan died during a car accident.

According to the news appeared on the press on 7 June 2014, Burhan Kaya incarcerated in Sincan (Ankara) F-type Prison No 2 was not taken to a general hospital for months despite the confirmation of Public Prosecutor in Ankara. He is suffering from COPD, prostate, and hyper-tension. There are also bulks in his bowels and on his kidneys with the risk of cancer.

According to the news appeared on the press on 7 June 2014, Bakırköy (İstanbul) Penal Court of First Instance No 34 concluded to hear the case against Feleknas Uca, former member of EP, launched after she was detained on 13 November 2012 in Atatürk Airport carrying 248 boxes B1 vitamins brought for the prisoners on hunger strike.
The court sentenced Feleknas Uca to 10 months’ imprisonment under the Law to Fight Smuggling for “illegally bringing drugs for commercial use”. The sentence was converted to a fine of TL 1,000.

Hanifi Katkat and Serdar Çeliktemel who were among 5 persons detained during the march on 6 June 2014 in Silvan district of Diyarbakır to support the protest on Lice-Diyarbakır road against the construction of new military stations were arrested on 7 June 2014 on the allegations of “resisting security forces”.
(06/051) KCK/TM Main Trial in Diyarbakır…
Diarbakır Heavy Penal Court No 2 decided on 6 June 2014 to release the remanded defendants former Cizre Mayor Aydın Budak, Musa Farisoğlulları, Aygül Arat, Mustafa Ocaklık and Abdülserdest Tan to be tried without remand in the KCK/TM Main Trial in Diyarbakır. The case was launched after the operation conducted on 14 April 2009 in connection with a “KCK Investigation”. There are still 36 remanded defendants in this case.

Siirt Heavy Penal Court continued on 6 June 2014 to hear the case against 18 persons launched after the operations conducted in 2010 in Siirt in connection with a ”KCK Investigation”. 4 of the defendants are remanded in this case.
After the presentation of further evidences, the court decided to release remanded defendants Ahmet Kurhan, Neslihan Filizar, Murat Yıldız and Ömer Gezer to be tried without remand and adjourned the hearing.

Ramazan Ertaş (80), suffering from asthma, allegedly died on 9 June 2014 in Siirt due to excessive use of tear gas during a demonstration staged to protest in the attacks in Lice district of Diyarbakır. The reason of the death will be announced after the forensic examination.

F.A. (6) was shot at his eye at home with a tear gas canister on 9 June 2014 during a demonstration staged in Cizre district of Şırnak to protest in the attacks in Lice district of Diyarbakır. F.A. is under risk to lose his eye.

Peole in Piraziz district of Giresun attempted on 9 June 2014 to lynch the Kurdish people working for the construction of dormitory of a vocational school. The attack allegedly organised on the grounds that the workers kept working during national anthem and attacked a teacher.

A group of persons who wanted to make a press announcement on 8 June 2014 to protest in the construction of new military stations and killings of 2 persons by the soldiers in Lice district of Diyarbakır were attacked y a group of ultra-nationalists. The police intervened the attack and detained 35 persons. The detainees were allegedly beaten in police vehicles and police station.
(06/063) Shop owner Beaten by the Police…
Muradiye Koç (56), a shop owner in Çiğli district of İzmir, and her mentally retarded son were beaten by the police on 7 June 2014 on the grounds that their customers were drinking alcoholic beverages in front of their shop. The police also used tear gas. While Muradiye Koç and his son were accused of “resisting security forces”, her husband made an official complaint against the police officers.

According to the news appeared on the press on 9 June 2014, 3 police officers beat with truncheons and used tear gas against A.Y. (20) and H.O. (18) on 28 May 2014 in Osmangazi district of Bursa allegedly because they swear the police officers.
Upon release of camera recordings of the incident, Bursa Security Directorate announced that A.Y. (20) and H.O. (18) were accused for “damaging public property” and “resisting security forces”. Directorate also announced that police officers were suspended from duty after the video recordings.
(06/065) Police Officers on Trial for Excessive Use of Force …
Human rights supporter and freedom of expression activists, Azerbaijani lawyer İntigam Aliyev (49) was detained under beatings and kept in a cell without windows for 4 hours at Atatürk Airport after having a dispute with a passport police officer on 6 December 2011.
He was accused of “insulting security forces” and deported accordingly with the ban to enter to enter Turkey for one year. Upon his objection the ban was suspended, but a court case was launched on charges of “insult and threat”.
According to the news appeared on the press on 9 June 2014, the compensation case launched by İntigam Aliyev against the Ministry of Interior Affairs concluded and the court ruled TL 8,100.
(06/066) Diyarbakır Prison Massacre Case…
Diyarbakır Heavy Penal Court No 3 concluded on 9 June 2014 to hear the retrial of the case launched in connection with the killing of 10 prisoners under beatings on 24 September 1996 in Diyarbakır E-type Prison.
89 persons including 29 soldiers, 36 police officers, one physician, 2 prison administrators, 4 guards were on trial in this case in two separate files.
The court sentenced 62 defendants to 18 years’ imprisonment for “causing death of persons beyond necessity, but without the intention of killing” and then reduced the sentences to 5 years on the grounds the defendants pleaded guilty. 20 defendants were acquitted, the charges against 6 defendants and physician Serdar Gök who gave the report for the transfer of Kadir Demir to Gaziantep E-type Prison while he was wounded and died accordingly were dropped due to lapse of time.
On 24 September 1996 hundreds of soldiers, officers and guardians had attacked on 33 prisoners with sticks, and batons in Diyarbakır Prison and killed 10 of them. The rest of the prisoners were transferred to Gaziantep E Type of Closed Prison.
The case against 72 defendants was concluded on 27 February 2014 and the court acquitted 3 defendants and the accusations against 7 defendants were suspended due to lapse of time. The court sentenced 62 defendants to 5 years’ imprisonment and 3 years’ suspension from public duty for “killing more than one person beyond intention” and misconduct of duty”.

According to the news appeared on the press on 9 June 2014, a court case was launched against Kamuran Bedir (42) on the allegations of flipping the Prime Minister the bird during his visit to İzmir on 16 March 2014 for elections.
İzmir Peace Penal Court will start to hear the case and the indictment wants Kamuran Bedir to be sentenced under the Article 125 TPC for insulting public officers.

The police intervened on 9 June 2014 a group of students in Kocaeli University campus who were protesting killing of 2 persons in Lice district of Diyarbakır and detained 20 students under beatings.

The police intervened on 8 June 2014 a group of persons who were protesting construction of new military stations and military intervention to the protesters in Lice and 8 persons were wounded during the intervention. Serdar Atalay, BDP Chair for Batman, was also beaten by the police when he tried to prevent the intervention.

3 persons were wounded when temporary village guards opened fire in Midyat district of Mardin against a group of persons who were protesting on 9 June 2014 the attacks in Lice. The conditions of Müşerref Alper (50) and Yusuf Akyüz (23) were reportedly serious.

The children Ş.T. and B. M. who were detained during the police intervention against a group of persons who wanted march on 8 June 2014 in Silvan district of Diyarbakır to support the protest on Lice-Diyarbakır road against the construction of new military stations were arrested on 9 June 2014 on the allegations of “carrying out activities in the name of an illegal organisation”, “damaging public property”, and “possessing explosives”.

Aydın Heavy Penal Court No 3 continued on 9 June 2014 to hear the case against 34 persons launched after the operations conducted in Ortaklar town of Aydın in 2011. The defendants testified n Kurdish at the hearing and the court adjourned the hearing to 29 September 2014 for the completion of the deficient documents.

2 Syrians were shot to death and 1 Syrian was wounded by soldiers on 9 June 2014 in Kilis when soldiers opened fire against a car which attempted to pass the border and did not obey stop warning.

M.B. (15) was wounded at his/her head when s/he was shot at head twice with tear gas canister on 10 June 2014 in Şırnak when the police intervened a group of persons staging a protest action against the killings of 2 persons in Lice. M.B. (15) was hospitalised to Şırnak State Hospital and her/his condition is reportedly critical.
(06/077) Spic Bazaar Case…
9th Penal Chamber at the Court of Cassation continued to hear the 3rd appeal case of Pınar Selek on 11 June 2014.
Pınar Selek was sentenced to life imprisonment in the Spice Bazaar Case launched at İstanbul Heavy Penal Court No 12 after the explosion on 9 July 1998 which caused to death of 7 persons. 127 persons were also wounded in the explosion.
The Chamber quashed the verdict on procedural grounds.

Anadolu (İstanbul) Penal Court of First Instance No 39 started on 10 June 2014 to hear the case against 5 persons launched for the placard they opened during a demonstration in Kadıköy district of İstanbul to protest in the death of Berkin Elvan who was shot with tear gas canister during Gezi Park demonstrations and died after 9 months on 11 March 2014.
The indictment wants the defendants Ahmet Ayva, Betül Karakuş, Elif Baydur, Özlem Akyol and Ersin Karadağ to be sentenced for “insulting public officer” under the Article 125 TPC. After the testimonies of the defendants, the court adjourned the hearing to 11 September 2014.
(06/079) Prisoners on Trial…
According to the news appeared on the press on 10 June 2014, a court case was launched against 80 prisoners incarcerated in Mardin E-type Prison for the protests on 15 July 2012 against the violations in the prisons which ended up with fire in one of the wards.
The indictment wants the defendants to be sentenced for “intentionally starting fire”, “damaging public property”, “being member of an illegal organisation”, and making propaganda of an illegal organisation”. Mardin Heavy Penal Court No 1 will start to hear the case.

The police intervened on 10 June 2014 in Varto district of Muş the demonstration staged to protest in the killings of 2 persons in Lice district of Diyarbakır. After the identification of the defendants and presentation of lawyers’ demands, Mardin Heavy Penal Court No 1 continued on 10 June 2014 to her the case against 26 persons including 11 remanded defendants launched on charges of “being member of youth organisation KCK”. The case was launched after the operations in 2010 in connection with a KCK investigation.

(06/088) Death of Uğur Kantar under Torture …
Turkish Peace Forces Military Court in Cyprus continued on 11 June 2014 to hear the case concerning the killing of the private Uğur Kantar on 12 October 2011 under torture in Cyprus while he was serving for compulsory military service. Uğur Kantar lost his consciousness on 25 July October 2011 after the torture he was subjected in Cyprus and died on 12 October 2011 in GATA military hospital in Ankara.
After the presentation of the lawyers, the court adjourned the hearing to 23 July 2014 for the preparation of Prosecutor’s opinion as to the accusations.
The indictment wants the defendants Ayhan Arslan and Fırat Keser, who were guards of the correction prison, to be sentenced for “causing death by torturing someone”, the guard Recep Tekin for “intentional wounding by 5 times misconduct of public officer’s authority”, Warden of the Prison Ayhan Şentürk for “misconduct of duty by negligence”, the guards Süleyman Özdoğan, Özkan Belmen and Ahmet Yurdusevdi for “misconduct of duty”.

Aliağa (İzmir) Penal Court of First Instance started on 11 June 2014 to hear the case against 75 female prisoners launched after they protested naked search by hitting the doors of the wards in 2013 in Şakran (İzmir) T-type Prison.
Only 13 defendants were present at the hearing. Only 30 of the defendants are still serving in the prisons. The court did not accept the interpretation on the grounds the interpreter was not official certified and 10 defendants could not testify at the hearing. Remaining defendants pleaded not guilty. The court adjourned the hearing to 21 October 2014 for a certified interpreter to be present.

According to the news appeared on the press on 11 June 2014, a court case was launched against Party of Labour members Tahsine Saran, Abdurrahman Saran, Yoldaş Taş and Yunus Naci Emek after the quarrel they had with the police on 25 April 2014 in Aydın when the police asked them to remove the stand they opened for the Labour Day preparations.
The indictment wants the defendants to be sentenced for “resisting security forces” and Aydın Penal Court of First Instance No 2 will start to hear the case.

According to the news appeared on the press on 11 June 2014, Erzurum Penal Court of First Instance No 4 concluded to hear the case against 14 persons launched after the police intervention to Newroz celebrations in Erzurum on 17 March 2013.

According to the news appeared on the press on 13 June 2014, Diyarbakır Public Prosecutor decided not the prosecute the generals of 1980 coup d’état Kenan Evren and Tahsin Şahinkaya for the official complaint Hakkı Yılmaz made against them for being tortured from 27 September 1985 to 15 June 1986 in Diyarbakır Military Prison.
The Public Prosecutor took the decision on the grounds that lapse of time exceeded in March 2014 for the crimes committed under the state of emergency.

On 15 June 2014 the juvenile İbrahim Aras (15) lost his life in Adana when he was hit by a sound bomb allegedly shot from a scorpion style police car. Eye witnesses claimed that the sound bomb that caused the life of İbrahim Aras was shot from the police vehicle, while the governor in Adana maintained that he died when a bomb in his hands exploded.

Fourteen people and one soldier had been killed in the incident in Lice District of Diyarbakır Province on 22 October 1993. The then Gendarmerie Regional Commander General Bahtiyar Aydın had gone to the district and was killed in the garden of the gendarmerie station by a bullet of unknown people. The trial on the incident started at Izmir Heavy Penal Court 1. On 13 June 2014 the court heard the demands of the lawyers of the parties and decided to halt the case since the retired Colonel Eşref Hatipoğlu, the then commander of Diyarbakır Gendarmerie Regiment and Lieutenant Tünay Yanardağ were high ranking soldiers and their trial required the permission of the Justice Minister.

On 13 June 2014 the case against Ümit Kartal and Ali Yıldırım who during a press conference in Kayseri on 12 June 2013 in support of the actions for Gezi Park had said that the Prime Minister was lying and had been charged with insulting Recep Tayyip Erdoğan “a civil servant because of his duty” was heard. Kayseri Peace Court 9 heard the final defence of the provincial executive of the Labour Party (Emek Partisi) and the local chair of the trade union SES, Ali Yıldırım and sentenced them to 11 months, 20 days imprisonment under Article 125 TPC. The judge later announced to postpone the declaration of the verdict.

According to the news appeared on the press on 18 June 2014, Lütfullah Tacik (17) who was detained by the soldiers on 16 May 2014 while trying to pass the border illegally in Iğdır and transferred to the Repatriation Centre of the Foreigner’s Department in Van on 26 May 32014 to be deported was beaten by a police officer for lying about his age.
Lütfullah Tacik had cerebral haemorrhage when the police officer S.O. working at Illegal Migration and Human Trafficking Department of Foreigner’s Department beat him. He was hospitalised, but died on 31 May 2014.

Ankara Heavy Penal Court No 10 concluded on 18 June 2014 to hear the case against former generals Kenan Evren and Tahsin Şahinkaya who had been the commanders of the 1980 Coup D’état. The indictment wanted the defendants to be sentenced to life imprisonment for being responsible for the crimes committed in the chain of command.
The court sentenced Kenan Evren and Tahsin Şahinkaya to aggravated life imprisonment under the Article 146 of former TPC. The sentence was reduced to life imprisonment and the court ordered judicial control for the defendants who did not attend the hearings.

Ankara Heavy Penal Court No 9 continued on 20 June 2014 to hear the case against 6 soldiers launched in connection with the disappearance of 6 villagers on 14 May 1993 after being detained on order of Mete Sayar, Şırnak Brigade Commander on the day of incident, for aiding and abetting PKK in Derecik hamlet of Görümlü town in Silopi district of Şırnak.
The case was launched just 3 days before the lapse of time. After the testimonies of the defendants and the relatives of villagers, the court adjourned the hearing to 20 June 2014.
The indictment wants the defendants Mete Sayar, retired Colonel Albay Hasan Basri Vural, First Lieutenant İbrahim Kıraç, Captain Murat Ali Yıldız, Lieutenant Serdar Tekin and Tansel Erok to heavy life imprisonment.

Diarbakır Heavy Penal Court No 2 decided on 6 June 2014 to release the remanded defendants Ercan Akyol and Turan Genç to be tried without remand in the KCK/TM Main Trial in Diyarbakır. The case was launched after the operation conducted on 14 April 2009 in connection with a “KCK Investigation”. There are still 34 remanded defendants in this case.

5 police officers who were among 15 police officers detained on the allegations of putting a bug in the office of the Prime Minister made an official complaint on 23 June 2014 for being subjected to torture and ill-treatment in custody.
According to the complaint, police officers were not allowed to change cloths and were not given the opportunity to take shower, shave and brush teeth. They were also given rotten food to keep them hungry.

Mudanya (Bursa) Peace Penal Court No 2 started on 23 June 2014 to hear the case against 28 persons launched for the slogans shouted during a demonstration staged on 11 March 2014 to protest in the killing of Berkin Elvan by the police with a tear gas canister. The indictment wants the defendants to be sentenced under the Article 125 TPC for insulting the Prime Minister.
The court adjourned the hearing to 30 June 2014 for the continuation of the identification of the defendants.

Malatya Heavy Penal Court No 1 continued on 24 June 2014 to hear the case against 21 persons including 8 remanded defendants launched in connection with the killings of Tilman Ekkehart Geske, Necati Aydın and Uğur Yüksel on 18 April 2007 in Zirve Publishing in Malatya.

Public Prosecutor for the Execution of Sentences in Ankara decided on 24 June 2014 to release the prisoner Murat Ekin. Murat Ekin incarcerated in Bolu F-type Prison and suffering from varicosity, herniated disc, bowel laziness, reflux, pharyngitis, and high cholesterol was kept in the prison for the last 3 months despite the bulk mass found in his lung and not hospitalised to to Ankara Numune Hospital for diagnosis. After the examination, he was given a medical report certifying that he was suffering from cancer.

İstanbul Peace Penal Court No 18 continued on 25 June 2014 to hear the case against the police officer Fatih Zengin (23). He was the police officer who sprayed tear gas on Ceyda Sungur (aka woman in red) on 28 May 2013 when people gathered in Gezi Park.
The indictment wants the officer to be sentenced up to 2 years’ imprisonment and dismissal from profession for misconduct of duty by not following the regulations on use of tear gas and intervention to public demonstrations. The defendant was not present at the hearing for having a medical report.
After the demands of the lawyers, the court decided to send Ceyda Sungur to Forensic Institute for determination of the effects of the use of tear gas from close distance and adjourned the hearing to 25 June 2014 for the completion of deficient documents.

Adana Penal Court of First Instance No 10 started on 25 June 2014 to hear the retrial of 20 unionists. The case was launched for attending the general strike, called by the union KESK in public sector on 21 December 2011, in Adana. In the first trial the court acquitted the defendants, but the Court of Cassation quashed the verdict.
The indictment wants the defendants to be sentenced for “violating the Law on Meetings and Demonstrations”. After the identification and testimonies of the defendants, the court adjourned the hearing to 3 November 2014.

Eskişehir Heavy Penal Court No 1 continued on 27 June 2014 to hear the case against retired Colonel Ali Osman Akın and active Lieutenant Colonel Kemal Alkan launched on charges of ordering the killing of Nezir Tekçi.
Nezir Tekçi was detained on 26 April 1995 in Yekmal (Aşağı Ölçek) village of Yüksekova district in Hakkari by the soldiers from Bolu 5th Commando Brigade and disappeared since then.
His father Halit Tekçe made the first official complaint concerning the disappearance in 1997 and Military Prosecutor in Van decided not to prosecute on 15 December 1997.
In 2010, the investigation restarted upon testimony of Yunus Şahin who was serving for compulsory military service on the day of the incident and witnessed the killing of Nezir Tekçi. Meanwhile upon official complaint by his family, a court case was launched against the soldiers in September 2011. But the case was transferred to Eskişehir for security reasons.
The indictment wants the defendants to be sentenced for ordering the killing of Nezir Tekçi for not revealing information on PKK militants and exploding his body with a land mine.
After the testimonies of the defendants and presentation of the lawyers, the court rejected the arrest demand for the defendant despite the testimonies of the eyewitnesses. The court decided to send the findings gathered during crime scene investigation to Forensic Institute and adjourned the hearing to 17 October 2014.

Anadolu (İstanbul) Heavy Penal Court No 6 concluded on 25 June 2014 to hear concerning the death of Veysel Albayrak. On 5 October 2013, Veysel Albayrak allegedly did not obey the stop warning in Kartal district of İstanbul and tried to run away with his car. He hit a police officer and killed, and shot to death by the police officers.
The court acquitted 8 police officers on the grounds that the action of the police officers was legitimate and lawful since the car of Veysel Albayrak could be regarded as some sort of weapon.

İstanbul Juvenile Heavy Penal Court No 2 continued on 27 June 2014 to hear the case against Ogün Samast who killed Hrant Dink on 19 January 2007. After the amendments in Anti-Terror Law in 2010, the file of Ogün Samast was separated for being under 18 years on the day of assassination. The indictment wants him to be sentenced for being member of an illegal organisation” and “committing crime as a member of an illegal organisation”.
The defendant was not present at the hearing. The letter sent by the National Intelligence Service (MIT) was read at the hearing. MIT stressed that they are not authorised to reveal whether the documents sent to the Parliamentary Commission for Coup d’États concerning killing of Hrant Dink were state secret.
The court decided to write another letter to MİT to ask for a clear answer whether the information on Ogün Samast was state secret and adjourned the hearing to 17 October 2014.

On 20 December 2011, military forces conducted an operation against HPG militants nearby Heybeli village of Akarsu town in Nusaybin district of Mardin. The soldiers shot two villagers on suspicion of being HPG militants. Yusuf Akın (38) died in the hospital and Mehmet Eren (48) was wounded during the incident.
After the incident, a court case was launched against 5 soldiers on charges of “reckless homicide with the demand of 3 years’ imprisonment.
Mardin Heavy Penal Court No 1 continued on 26 June 2014 to hear the case against the soldiers B.Y., K.E.O., Ş.T., Y.T.K. and D.G.. The court rejected the demand for the arrest of the defendants and adjourned the hearing to 8 September 2014.

İstanbul Heavy Penal Court No 20 concluded on 26 June 2014 to hear the case against police officers F.O., G.A., V.D. and F.K. launched on charges of “torture, wounding, insult, breaking bones by means of torture and deprivation of liberty.
The officers detained Mustaf Çiftçi on 1 May 2009 when he wanted to go to Taksim Square for Labour Day celebrations. He was beaten, sprayed tear gas, and left on sidewalk for being death.
The court acquitted the defendants on the grounds that they were not being proven guilty of the offense.

Abulance driver Hakan Yaman (42) was reportedly beaten by the security guards in Çukurova University in Adana for not stopping at the gate of the university while carrying a patient to the university hospital on 28 June 2014. İstanbul Heavy Penal Court No 2 started on 27 June 2014 to hear the case against 36 persons launched on charges of “being member or leading member of the illegal organisation Revolutionary Quarter”.
During the Gezi Park demonstrations in İstanbul, the police raided the premises of Socialist Democracy Party on 11 June 2013 and detained 72 persons. SDP Central Committee member Ulaş Bayraktar was arrested for “being member of an armed organisation”, SDP Party Assembly member Doğukan Öci and SDP members Furkan Tombul and Ceyhun Dönmez for “committing crime in the name of an illegal organisation though not being a member of the organisation” on 15 June 2013. A court case was launched against 36 released persons afterwards.
After the identification and testimonies of the defendants, the court adjourned the hearing to wait for the court decision for the pedestrianisation of Taksim Square.
